cost-of-living

in

authorized
during

by
the

pursuant
to
section

of
the
federal
Social

U.S.C.
§415.

b.
Every
employer,
as
defined
in
the
federal
Fair
Labor
16
Standards
Act
of
1938,
as
amended
to
January
1,
2007,
shall
pay
17
to
each
of
the
employer’s
employees,
as
defined
in
the
federal
18
Fair
Labor
Standards
Act
of
1938,
as
amended
to
January
1,
19
2007,
the
state
hourly
wage
stated
in
paragraph
“a”
,
or
the
20
current
federal
minimum
wage,
pursuant
to
29
U.S.C.
§206,
as
21
amended,
whichever
is
greater.

c.
For
purposes
of
determining
whether
an
employee
of
a
23
restaurant,
hotel,
motel,
inn,
or
cabin,
who
customarily
and
24
regularly
receives
more
than
thirty
sixty
dollars
a
month
in
25
tips
is
receiving
the
minimum
hourly
wage
rate
prescribed
by
26
this
section
,
the
amount
paid
the
employee
by
the
employer
27
shall
be
deemed
to
be
increased
on
account
of
the
tips
by
an
28
amount
determined
by
the
employer,
not
to
exceed
forty
percent
29
of
the
applicable
minimum
wage.
An
employee
may
file
a
written
30
appeal
with
the
labor
commissioner
if
the
amount
of
tips
31
received
by
the
employee
is
less
than
the
amount
determined
by
32
the
employer
under
this
subsection
.

An
employer
is
not
required
to
pay
an
employee
the

applicable
state
hourly
wage
provided
in
paragraph
“a”
until
the

wage
to

as

of
January

1,
2022.
The
bill
increases
the
state
minimum
hourly
wage
for

employees
employed
for
less
than
90
days
to
$7.20
as
of
July
1,

2019,
$8.05

2021,

of

1,

and

The
bill
increases
the
state
minimum
hourly
wage,

employees

security

dollar
amount
of
monthly
tips
an

must
receive
in
order
to
be
subject
to
an
alternative

minimum
wage
calculation
for
employees
who
receive
tips
from

bill
authorizes
a
county
or
city
to
establish
a
minimum

wage
that
exceeds
the

wage
