Section 162.2A, subsection 3, paragraph d, Code 1 2019, is amended by striking the paragraph. 2 EXPLANATION 3 The inclusion of this explanation does not constitute agreement with 4 the explanation’s substance by the members of the general assembly. 5 BILL’S PROVISION. This bill amends a provision in Code 6 chapter 162 which regulates the sale, purchase, housing, 7 care, handling, treatment, and transportation of certain 8 nonagricultural animals in commercial establishments by the 9 department of agriculture and land stewardship (Code section 10 162.1). The bill eliminates a requirement that an application 11 form for the issuance or renewal of an authorization to 12 operate a commercial establishment include the applicant’s 13 identification number, which may be a tax identification number 14 (Code section 162.2A). 15 BACKGROUND. A commercial establishment includes an animal 16 shelter, pound, or research facility operated by a person 17 issued a certificate of registration (Code sections 162.3, 18 162.4, and 162.4A); a pet shop, boarding kennel, or commercial 19 kennel operated by a person issued a state license (Code 20 sections 162.5, 162.5A, and 162.6); or a dealer, commercial 21 breeder, or public auction operated by a person who is either 22 issued a state license or a permit. A permit is issued if the 23 person is licensed under the federal Animal Welfare Act (7 24 U.S.C. ch. 54) by the United States department of agriculture 25 (Code sections 162.7, 162.8, and 162.9A). 26 -1- LSB 1521YH (2) 88 da/rn 1/ 1
