There is appropriated to the 1 department of administrative services for the fiscal year 2 beginning July 1, 2019, and ending June 30, 2020, from the 3 revolving funds designated in chapter 8A and from internal 4 service funds created by the department such amounts as the 5 department deems necessary for the operation of the department 6 consistent with the requirements of chapter 8A . 7 Sec. 3. STATE EMPLOYEE HEALTH INSURANCE ADMINISTRATION 8 CHARGE. For the fiscal year beginning July 1, 2019, and ending 9 June 30, 2020, the monthly per contract administrative charge 10 which may be assessed by the department of administrative 11 services shall be $2 per contract on all health insurance plans 12 administered by the department. 13 Sec. 4. AUDITOR OF STATE. 14 1. IOWA ETHICS AND CAMPAIGN DISCLOSURE BOARD. Notwithstanding section 321A.3, subsection 1 , for the 27 fiscal year beginning July 1, 2019, and ending June 30, 2020, 28 the first $750,000 collected and transferred to the treasurer 29 of state with respect to the fees for transactions involving 30 the furnishing of a certified abstract of a vehicle operating 31 record under section 321A.3, subsection 1 , shall be transferred 32 to the IowAccess revolving fund created in section 8B.33 for 33 the purposes of developing, implementing, maintaining, and 34 expanding electronic access to government records as provided 35 -3- LSB 1000HV (2) 88 gh/tm 3/ 21

The department shall, in coordination with the health 9 facilities division, make the following information available 10 to the public as part of the department’s development efforts 11 to revise the department’s internet site: 12 (1) The number of inspections conducted by the division 13 annually by type of service provider and type of inspection. 14 (2) The total annual operations budget for the division, 15 including general fund appropriations and federal contract 16 dollars received by type of service provider inspected. 17 (3) The total number of full-time equivalent positions in 18 the division, to include the number of full-time equivalent 19 positions serving in a supervisory capacity, and serving as 20 surveyors, inspectors, or monitors in the field by type of 21 service provider inspected. 22 (4) Identification of state and federal survey trends, 23 cited regulations, the scope and severity of deficiencies 24 identified, and federal and state fines assessed and collected 25 concerning nursing and assisted living facilities and programs. 26 c. It is the intent of the general assembly that the 27 department and division continuously solicit input from 28 facilities regulated by the division to assess and improve 29 the division’s level of collaboration and to identify new 30 opportunities for cooperation. 31 5. EMPLOYMENT APPEAL BOARD 32 a. Administrative costs charged by the department of 27 inspections and appeals for items funded under this subsection 28 shall not exceed 4 percent of the amount appropriated in this 29 subsection. 30 7. Notwithstanding section 2 8.39 , the department of inspections and appeals, in 3 consultation with the department of management, may reallocate 4 moneys appropriated in this section as necessary to best 5 fulfill the needs of the department provided for in the 6 appropriation. However, the department of inspections and 7 appeals shall not reallocate moneys appropriated to the child 8 advocacy board in this section. 9 Sec. 13. DEPARTMENT OF INSPECTIONS AND APPEALS —— LICENSE OR 10 REGISTRATION FEES. 11 1. For the fiscal year beginning July 1, 2019, and ending 12 June 30, 2020, the department of inspections and appeals 13 shall collect any license or registration fees or electronic 14 transaction fees generated during the fiscal year as a result 15 of licensing and registration activities under chapters 99B , 16 137C , 137D , and 137F . 17 2. From the fees collected by the department under this 18 section on behalf of a municipal corporation with which 19 the department has an agreement pursuant to section 137F.3 , 20 through a statewide electronic licensing system operated by 21 the department, notwithstanding section 137F.6, subsection 2 , 22 the department shall remit the amount of those fees to the 23 municipal corporation for whom the fees were collected less 24 any electronic transaction fees collected by the department to 25 enable electronic payment. 26 3. From the fees collected by the department under this 27 section, other than those fees described in subsection 2, 28 the department shall deposit the amount of $800,000 into the 29 general fund of the state prior to June 30, 2020. 30 4. From the fees collected by the department under this 31 section, other than those fees described in subsections 2 and 32 3, the department shall retain the remainder of the fees for 33 the purposes of enforcing the provisions of chapters 99B , 137C , 34 137D , and 137F . Notwithstanding section 8.33 , moneys retained 35 -11- LSB 1000HV (2) 88 gh/tm 11/ 21
H.F. 759 by the department pursuant to this subsection that remain 1 unencumbered or unobligated at the end of the fiscal year 2 shall not revert but shall remain available for expenditure 3 for the purposes of enforcing the provisions of chapters 99B , 4 137C , 137D , and 137F during the succeeding fiscal year. The 5 department shall provide an annual report to the department of 6 management and the legislative services agency on fees billed 7 and collected and expenditures from the moneys retained by 8 the department in a format as determined by the department 9 of management in consultation with the legislative services 10 agency. 11 Sec. 14. H.F. 759 Sec. 30. EFFECTIVE DATE. This division of this Act, being 1 deemed of immediate importance, takes effect upon enactment. 2 DIVISION IV 3 IOWA CODE CHANGES 4 Sec. 31. Section 8A.111, Code 2019, is amended by adding the 5 following new subsection: 6 NEW SUBSECTION . 12. By December 31, 2020, and by the same 7 date each year thereafter, an annual report submitted to the 8 general assembly and to the chairpersons and ranking members of 9 the senate and house committees on appropriations containing 10 a listing of real property owned or leased by the state, as 11 included in the department’s searchable database maintained 12 under section 8A.321, subsection 15. The report shall be 13 grouped by county and shall include identifying information for 14 each real property listed, including but not limited to the 15 physical address. If real property is leased by the state, the 16 report shall also include the rental or lease costs of such 17 real property. 18 Sec. 32. Section 8A.321, Code 2019, is amended by adding the 19 following new subsection: 20 NEW SUBSECTION . 15. By January 1, 2020, in consultation 21 with the office of the chief information officer, develop and 22 maintain a searchable database available on the department’s 23 internet site containing a listing, by location, of real 24 property owned or leased by the state. Real property listed 25 in the database shall be searchable by county, address, and 26 any other methods as deemed beneficial to the public by the 27 director. If real property listed in the database is leased by 28 the state, the database shall also include the rental or lease 29 costs of such real property. The department shall update the 30 searchable database annually. 31 Sec. 33. Section 8B.9, Code 2019, is amended by adding the 32 following new subsection: 33 NEW SUBSECTION . 6. Beginning October 1, 2019, a quarterly 34 report regarding the status of technology upgrades or 35 -19- LSB 1000HV (2) 88 gh/tm 19/ 21
H.F. 759 enhancements for state agencies, submitted to the general 1 assembly and to the chairpersons and ranking members of 2 the senate and house committees on appropriations. The 3 quarterly report shall also include a listing of state agencies 4 coordinating or working with the office and a listing of state 5 agencies not coordinating or working with the office. 6 Sec. 34. Section 137C.9, subsection 1, paragraph c, Code 7 2019, is amended to read as follows: 8 c. For a hotel containing more than one hundred one guest 9 rooms or more , one hundred fifty dollars. 10 EXPLANATION 11 The inclusion of this explanation does not constitute agreement with 12 the explanation’s substance by the members of the general assembly. 13 DIVISION I —— FY 2019-2020. This bill relates to and 14 appropriates moneys to various state departments, agencies, 15 and funds for the fiscal year beginning July 1, 2019, and 16 ending June 30, 2020. The bill makes appropriations to 17 state departments and agencies including the department of 18 administrative services, auditor of state, Iowa ethics and 19 campaign disclosure board, the office of the chief information 20 officer, department of commerce, offices of governor and 21 lieutenant governor, the governor’s office of drug control 22 policy, department of human rights, department of inspections 23 and appeals, department of management, Iowa public information 24 board, department of revenue, secretary of state, treasurer of 25 state, and Iowa public employees’ retirement system. 26 DIVISION II —— STANDING APPROPRIATIONS —— LIMITATIONS. The 27 bill limits a standing appropriation for enforcement of Code 28 chapter 453D relating to tobacco product manufacturers under 29 Code section 453D.8. The appropriation for FY 2019-2020 shall 30 not exceed $17,525. 31 DIVISION III —— SUPPLEMENTAL APPROPRIATIONS. The bill requires the 1 director of the department of administrative services to 2 consult with the office of the chief information officer 3 to develop and maintain a searchable database available on 4 the department’s internet site containing a listing or real 5 property owned or leased by the state, as described in the 6 bill, by January 1, 2020. The department shall update the 7 searchable database annually. The bill also requires the 8 department to submit an annual report to the general assembly 9 and to the chairpersons and ranking members of the senate and 10 house committees on appropriations containing a listing of 11 real property owned or leased by the state, as included in the 12 department’s searchable database, by December 31, 2020, and by 13 the same date each year thereafter. 14 The bill requires the office of the chief information 15 officer to submit a quarterly report to the general assembly 16 and to the chairpersons and ranking members of the senate 17 and house committees on appropriations regarding the status 18 of technology upgrades or enhancements for state agencies, 19 beginning October 1, 2019.
