H.F. 758 grants account for the fiscal year beginning July 1, 2019, and 1 ending June 30, 2020, not more than $265,950 is allocated for 2 the early childhood Iowa office and other technical assistance 3 activities. Moneys allocated under this lettered paragraph 4 may be used by the early childhood Iowa state board for the 5 purpose of skills development and support for ongoing training 6 of staff. However, except as otherwise provided in this 7 subsection, moneys shall not be used for additional staff or 8 for the reimbursement of staff. 9 b. Of the amount appropriated in this subsection for 10 deposit in the school ready children grants account of the 11 early childhood Iowa fund, $2,318,018 shall be used for efforts 12 to improve the quality of early care, health, and education 13 programs. Moneys allocated pursuant to this paragraph may be 14 used for additional staff and for the reimbursement of staff. 15 The early childhood Iowa state board may reserve a portion 16 of the allocation, not to exceed $88,650 for the technical 17 assistance expenses of the early childhood Iowa state office, 18 including the reimbursement of staff, and shall distribute 19 the remainder to early childhood Iowa areas for local quality 20 improvement efforts through a methodology identified by the 21 early childhood Iowa state board to make the most productive 22 use of the funding, which may include use of the distribution 23 formula, grants, or other means. 24 c. Of the amount appropriated in this subsection for 25 deposit in the school ready children grants account of 26 the early childhood Iowa fund, $825,030 shall be used for 27 support of professional development and training activities 28 for persons working in early care, health, and education by 29 the early childhood Iowa state board in collaboration with 30 the professional development component groups maintained by 31 the early childhood Iowa stakeholders alliance pursuant to 32 section 256I.12, subsection 7, paragraph “b”, and the early 33 childhood Iowa area boards. Expenditures shall be limited to 34 professional development and training activities agreed upon by 35 -6- LSB 1003HV (3) 88 kh/tm 6/ 34

The moneys appropriated in this subsection shall be 17 used for implementation and expansion of early head start 18 pilot projects addressing the comprehensive cognitive, social, 19 emotional, and developmental needs of children from birth to 20 age three, including prenatal support for qualified families. 21 The projects shall promote healthy prenatal outcomes and 22 healthy family functioning, and strengthen the development of 23 infants and toddlers in low-income families. Priority shall be 24 given to those organizations that have previously qualified for 25 and received state funding to administer an early head start 26 project. 27 11. TEXTBOOKS OF NONPUBLIC SCHOOL PUPILS 28 a. The department may charge school districts and accredited 6 nonpublic schools a fee for the system not to exceed the actual 7 costs to purchase a statewide license for the early warning 8 assessment minus the moneys received by the department under 9 this subsection. The fee shall be determined by dividing the 10 actual remaining costs to purchase the statewide license for 11 the school year by the number of pupils assessed under the 12 system in the current fiscal year. School districts may use 13 moneys received pursuant to section 257.10, subsection 11, and 14 moneys received for purposes of implementing section 279.68, 15 subsection 2, to pay the early warning assessment system fee. 16 21. IOWA READING RESEARCH CENTER 17 a. For 13 the fiscal year beginning July 1, 2019, and ending June 30, 14 2020, the state board of regents may use notes, bonds, or 15 other evidences of indebtedness issued under section 262.48 to 16 finance projects that will result in energy cost savings in an 17 amount that will cause the state board to recover the cost of 18 the projects within an average of six years. 19 Sec. 12. PRESCRIPTION DRUG COSTS. Notwithstanding section 20 270.7, the department of administrative services shall pay 21 the state school for the deaf and the Iowa braille and sight 22 saving school the moneys collected from the counties during the 23 fiscal year beginning July 1, 2019, for expenses relating to 24 prescription drug costs for students attending the state school 25 for the deaf and the Iowa braille and sight saving school. 26 Sec. 13. Section 257.35, Code 2019, is amended by adding the 27 following new subsection: 28 NEW SUBSECTION . 13A. Notwithstanding subsection 1, and in 29 addition to the reduction applicable pursuant to subsection 30 2, the state aid for area education agencies and the portion 31 of the combined district cost calculated for these agencies 32 for the fiscal year beginning July 1, 2019, and ending June 33 30, 2020, shall be reduced by the department of management by 34 fifteen million dollars. The reduction for each area education 35 -20- LSB 1003HV (3) 88 kh/tm 20/ 34
H.F. 758 agency shall be prorated based on the reduction that the agency 1 received in the fiscal year beginning July 1, 2003. 2 Sec. 14. Section 261.25, subsections 1 and 2, Code 2019, are 3 amended to read as follows: 4 1. There is appropriated from the general fund of the state 5 to the commission for each fiscal year the sum of forty-six 6 forty-seven million six seven hundred thirty three thousand 7 nine four hundred fifty-one sixty-three dollars for tuition 8 grants to qualified students who are enrolled in accredited 9 private institutions. 10 2. There is appropriated from the general fund of the state 11 to the commission for each fiscal year the sum of three hundred 12 seventy-six eighty-six thousand two hundred twenty dollars 13 for tuition grants for qualified students who are enrolled in 14 eligible institutions. Of the moneys appropriated under this 15 subsection , not more than eighty thousand dollars annually 16 shall be used for tuition grants to qualified students who 17 are attending an eligible institution under section 261.9, 18 subsection 3 , paragraph “b” . 19 Sec. 15. Section 261.86, subsection 1, unnumbered paragraph 20 1, Code 2019, is amended to read as follows: 21 A national guard educational assistance program service 22 scholarship is established to be administered by the college 23 student aid commission for members of the Iowa national guard 24 who are enrolled as undergraduate students in a community 25 college, an institution of higher learning under the state 26 board of regents, or an accredited private institution. The 27 college student aid commission shall adopt rules pursuant 28 to chapter 17A to administer this section . An individual 29 is eligible for the national guard educational assistance 30 service scholarship program if the individual meets all of the 31 following conditions: 32 Sec. 16. If the amount 9 appropriated in a fiscal year for purposes of this section is 10 insufficient to provide educational assistance scholarships 11 to all national guard members who apply for the program and 12 who are determined by the adjutant general to be eligible 13 for the program, the adjutant general shall, in coordination 14 with the commission, determine the distribution of educational 15 assistance scholarships . However, educational assistance 16 scholarship awards paid pursuant to this section shall not 17 be less than fifty percent of the resident tuition rate 18 established for institutions of higher learning under the 19 control of the state board of regents or fifty percent of 20 the tuition rate at the institution attended by the national 21 guard member, whichever is lower. Neither eligibility nor 22 educational assistance scholarship award determinations shall 23 be based upon a national guard member’s unit, the location at 24 which drills are attended, or whether the eligible individual 25 is a member of the Iowa army or air national guard. 26 3. a. (1) An Except as provided in subparagraph (2), an 27 eligible member of the national guard, attending an institution 28 as provided in subsection 1 , paragraph “d” , shall not receive 29 educational assistance scholarship awards under this section 30 for more than one hundred twenty semester, or the equivalent, 31 credit hours of undergraduate study. 32 (2) An eligible member of the national guard, attending an 33 institution as provided in subsection 1, paragraph “d” , who is 34 enrolled in a program of education leading to a postsecondary 35 -22- LSB 1003HV (3) 88 kh/tm 22/ 34
H.F. 758 degree that meets the eligibility requirements for the federal 1 Edith Nourse Rogers STEM scholarship established under 38 2 U.S.C. §3320, shall not receive scholarship awards issued under 3 this section for more than one hundred thirty semester, or the 4 equivalent, credit hours of undergraduate study. 5 (3) A national guard member who has met the educational 6 requirements for a baccalaureate degree is ineligible for 7 educational assistance a scholarship award under this section . 8 b. A member of the national guard who received educational 9 assistance under this section prior to July 1, 2015, shall 10 be deemed to have received educational assistance for the 11 following number of credit hours for educational assistance 12 received before that date: 13 (1) For each semester that the member received educational 14 assistance while attending an institution as a full-time 15 student, twelve credit hours. 16 (2) For each semester that the member received educational 17 assistance while attending an institution as a part-time 18 student, six credit hours. 19 (3) For each trimester or quarter that the member received 20 educational assistance while attending an institution as a 21 full-time or part-time student, the number of credit hours that 22 are determined to be the semester equivalent by the college 23 student aid commission. 24 4. The eligibility of applicants and scholarship award 25 amounts of educational assistance to be paid shall be 26 certified by the adjutant general of Iowa to the college 27 student aid commission, and all amounts that are or become 28 due to a community college, accredited private institution, 29 or institution of higher learning under the control of the 30 state board of regents under this section shall be paid to the 31 college or institution by the college student aid commission 32 upon receipt of certification by the president or governing 33 board of the educational institution as to accuracy of charges 34 made, and as to the attendance and academic progress of the 35 -23- LSB 1003HV (3) 88 kh/tm 23/ 34
H.F. 758 individual at the educational institution. The college student 1 aid commission shall maintain an annual record of the number of 2 participants and the dollar value of the educational assistance 3 provided awards issued . 4 5. For purposes of this section , unless otherwise required, 5 “educational assistance” means the same as Scholarships awarded 6 under this section may be used by the recipient for the 7 recipient’s “cost of attendance” as defined in Tit. IV, pt. B, 8 of the federal Higher Education Act of 1965 as amended. 9 Sec. 18. Section 284.13, subsection 1, paragraphs a, b, c, 10 e, f, and g, Code 2019, are amended to read as follows: 11 a. For the fiscal year beginning July 1, 2018 2019 , and 12 ending June 30, 2019 2020 , to the department, the amount of 13 five hundred eight thousand two hundred fifty dollars for the 14 issuance of national board certification awards in accordance 15 with section 256.44 . Of the amount allocated under this 16 paragraph, not less than eighty-five thousand dollars shall 17 be used to administer the ambassador to education position in 18 accordance with section 256.45 . 19 b. For the fiscal year beginning July 1, 2018 2019 , and 20 ending June 30, 2019 2020 , up to seven hundred twenty-eight 21 thousand two hundred sixteen dollars to the department for 22 purposes of implementing the professional development program 23 requirements of section 284.6 , assistance in developing model 24 evidence for teacher quality committees established pursuant to 25 section 284.4, subsection 1 , paragraph “b” , and the evaluator 26 training program in section 284.10 . A portion of the funds 27 allocated to the department for purposes of this paragraph may 28 be used by the department for administrative purposes and for 29 not more than four full-time equivalent positions. 30 c. For the fiscal year beginning July 1, 2018 2019 , 31 and ending June 30, 2019 2020 , an amount up to one million 32 seventy-seven thousand eight hundred ten dollars to the 33 department for the establishment of teacher development 34 academies in accordance with section 284.6, subsection 10 . H.F. 758 portion of the funds allocated to the department for purposes 1 of this paragraph may be used for administrative purposes. 2 e. For the fiscal year beginning July 1, 2018 2019 , and 3 ending June 30, 2019 2020 , to the department an amount up to 4 twenty-five thousand dollars for purposes of the fine arts 5 beginning teacher mentoring program established under section 6 256.34 . 7 f. For the fiscal year beginning July 1, 2018 2019 , and 8 ending June 30, 2019 2020 , to the department an amount up 9 to six hundred twenty-six thousand one hundred ninety-one 10 dollars shall be used by the department for a delivery system, 11 in collaboration with area education agencies, to assist in 12 implementing the career paths and leadership roles considered 13 pursuant to sections 284.15 , 284.16 , and 284.17 , including but 14 not limited to planning grants to school districts and area 15 education agencies, technical assistance for the department, 16 technical assistance for districts and area education agencies, 17 training and staff development, and the contracting of external 18 expertise and services. In using moneys allocated for purposes 19 of this paragraph, the department shall give priority to school 20 districts with certified enrollments of fewer than six hundred 21 students. A portion of the moneys allocated annually to the 22 department for purposes of this paragraph may be used by the 23 department for administrative purposes and for not more than 24 five full-time equivalent positions. 25 g. For the fiscal year beginning July 1, 2019 2020 , and 26 for each subsequent fiscal year, to the department, ten 27 million dollars for purposes of implementing the supplemental 28 assistance for high-need schools provisions of section 284.11 . 29 Annually, of the moneys allocated to the department for 30 purposes of this paragraph, up to one hundred thousand dollars 31 may be used by the department for administrative purposes and 32 for not more than one full-time equivalent position. 33 Sec. 19. The criteria shall be 5 based on need for instruction in English as a second language 6 in the region served by each community college as determined by 7 factors including data from the latest federal decennial census 8 and outreach efforts to determine regional needs. 9 (4) From the moneys appropriated in this lettered paragraph 10 “b”, $210,000 shall be transferred to the department of human 11 services for purposes of administering a pilot project to 12 provide access to international resources to Iowans and new 13 Iowans to provide economic and leadership development resulting 14 in Iowa being a more inclusive and welcoming place to live, 15 work, and raise a family. The pilot project shall provide 16 supplemental support services for international refugees to 17 improve learning, English literacy, life skills, cultural 18 competencies, and integration in a county with a population 19 over 350,000 as determined by the 2010 federal decennial 20 census. The department of human services shall utilize a 21 request for proposals process to identify the entity best 22 qualified to implement the pilot project. 23 c. IOWA INDUSTRIAL NEW JOBS TRAINING ACT —— FY 35 -28- LSB 1003HV (3) 88 kh/tm 28/ 34

Notwithstanding section 260E.2, for 1 the fiscal year beginning July 1, 2018, and ending June 30, 2 2019, “new job” includes a new, existing, or recalled job 3 in an industry which, for purposes of this section, means 4 a business existing on the effective date of this section 5 and located in a county with a population between 40,500 and 6 41,000, as determined by the 2010 federal decennial census, 7 that was declared a disaster area by the governor following a 8 weather-related natural disaster which impacted the county on 9 or about July 19, 2018. 10 Sec. 22. Section 260I.2, subsection 2, paragraph c, Code 11 2019, is amended to read as follows: 12 c. Moneys Except as provided in section 260I.10, subsection 13 4, moneys in the fund shall be allocated pursuant to the 14 formula established in section 260C.18C . Notwithstanding 15 section 8.33 , moneys in the fund at the close of the fiscal 16 year shall not revert to the general fund of the state but 17 shall remain available for expenditure for the purpose 18 designated for subsequent fiscal years. Notwithstanding 19 section 12C.7, subsection 2 , interest or earnings on moneys in 20 the fund shall be credited to the fund. 21 Sec. 23. Section 260I.3, subsection 1, Code 2019, is amended 22 to read as follows: 23 1. The department state board of education, in consultation 24 with the economic development authority, shall adopt rules 25 pursuant to this chapter 17A defining eligibility criteria 26 for persons applying to receive tuition assistance under this 27 chapter . 28 Sec. 24. Section 260I.3, subsection 2, paragraph a, Code 29 2019, is amended to read as follows: 30 a. The applicant’s family income for the six three months 31 prior to the date of application or documentation of a 32 life-changing event . 33 Sec. 25. Section 260I.3, Code 2019, is amended by adding the 34 following new subsection: 35 -29- LSB 1003HV (3) 88 kh/tm 29/ 34
H.F. 758 NEW SUBSECTION . 6. The community college receiving the 1 application may limit an applicant to one eligible certificate 2 program or to eligible programs within one career pathway, 3 based on the funding available to the community college for 4 purposes of this program. 5 Sec. 26. Section 260I.4, subsection 4, Code 2019, is amended 6 by striking the subsection. 7 Sec. 27. Section 260I.7, Code 2019, is amended to read as 8 follows: 9 260I.7 Initial assessment. 10 An applicant for tuition assistance under this chapter shall 11 complete an initial assessment administered by the community 12 college receiving the application to determine the applicant’s 13 readiness to complete an eligible certificate program. The 14 assessment shall include assessments for completion of a 15 national career readiness certificate, including the areas of 16 reading for information, applied and mathematics , and locating 17 information . An applicant shall complete any additional 18 assessments and occupational research required by an eligible 19 certificate program. 20 Sec. 28. Section 260I.10, Code 2019, is amended by adding 21 the following new subsection: 22 NEW SUBSECTION . 4. The department of education, in 23 coordination with the community colleges, may adjust the 24 allocations generated pursuant to section 260I, subsection 2, 25 paragraph “c” , to ensure efficient delivery of services. 26 Sec. 29. Section 260I.11, Code 2019, is amended to read as 27 follows: 28 260I.11 Rules. 29 The department of state board of education, in consultation 30 with the economic development authority and the community 31 colleges, shall adopt rules pursuant to chapter 17A and this 32 chapter to implement the provisions of this chapter . 33 Sec. 30. H.F. 758 The section of this division of this Act relating to FY 1 2018-2019 definitions under the Iowa industrial new jobs 2 training Act. 3 EXPLANATION 4 The inclusion of this explanation does not constitute agreement with 5 the explanation’s substance by the members of the general assembly. 6 This bill appropriates moneys for fiscal year 2019-2020 from 7 the general fund of the state and other funds to the college 8 student aid commission, the department for the blind, the 9 department of education, and the state board of regents and its 10 institutions. The bill is organized by divisions. 11 DIVISION I —— FY 2019-2020. The bill appropriates to the 12 department for the blind for its administration. 13 The bill includes appropriations to the college student aid 14 commission for general administrative purposes, administration 15 of the future ready Iowa grant and scholarship programs, the 16 health care professional recruitment program, the national 17 guard educational assistance program, the all Iowa opportunity 18 scholarship program, the teach Iowa scholar program, the rural 19 Iowa primary care loan repayment program, the health care loan 20 repayment program, the future ready Iowa skilled workforce 21 last-dollar scholarship program, and the future ready Iowa 22 skilled workforce grant program. The standing appropriations 23 for Iowa tuition grants for students attending accredited 24 private institutions are increased. 25 The statutory provision establishing the national guard 26 educational assistance program is renamed the national guard 27 service scholarship program, and scholarship recipients who 28 are enrolled in a postsecondary degree program that meets the 29 eligibility requirements for the federal Edith Nourse Rogers 30 STEM scholarship established under 38 U.S.C. §3320, can exceed 31 the 120 semester hour limitation for scholarship awards. 32 The bill appropriates moneys to the department of education 33 for purposes of the department’s general administration, 34 career and technical education (CTE) administration, division 35 -31- LSB 1003HV (3) 88 kh/tm 31/ 34
H.F. 758 of vocational rehabilitation services including independent 1 living programs, the entrepreneurs with disabilities program, 2 and independent living centers, state library for general 3 administration and the enrich Iowa program, public broadcasting 4 division, career and technical education reimbursement for 5 expenditures made by CTE regional planning partnerships, school 6 food service, early childhood Iowa fund, expansion of the 7 federal Individuals with Disabilities Education Improvement 8 Act birth through age three services, early head start 9 projects, textbooks for nonpublic school pupils, the student 10 achievement and teacher quality program, statewide student 11 assessment, statewide clearinghouse to expand work-based 12 learning, postsecondary summer classes for high school students 13 program, jobs for America’s graduates specialists, attendance 14 center performance/general internet site and data system 15 support, the online state job posting system, successful 16 progression for early readers, an early warning system for 17 literacy, the Iowa reading research center, computer science 18 professional development incentive fund, the Iowa learning 19 online initiative, children’s mental health school-based 20 training and support, distribution to the midwestern higher 21 education compact to pay Iowa’s member state annual obligation, 22 and community colleges. 23 The division provides that moneys appropriated for the 24 postsecondary summer classes for high school program for FY 25 2018-2019 and FY 2019-2020 shall carry over for expenditure for 26 the same purpose in the following fiscal year. The bill also 27 provides a supplemental appropriation to moneys appropriated 28 for purposes of the public broadcasting division for FY 29 2018-2019. These provisions take effect upon enactment. 30 For the 2019-2020 fiscal year, the bill reduces the standing 31 appropriations for at-risk children under Code section 279.51, 32 for payment of claims for nonpublic school transportation, and 33 for instructional support state aid. The bill also reduces 34 state aid for area education agencies and the portion of the 35 -32- LSB 1003HV (3) 88 kh/tm 32/ 34
H.F. 758 combined district costs calculated for these agencies by $15 1 million. 2 The bill appropriates moneys to the state board of regents 3 for the board office, universities’ general operating 4 budgets; the western Iowa regents resource center and the 5 quad-cities graduate studies center; Iowa public radio; the 6 state university of Iowa; Iowa state university of science 7 and technology; the university of northern Iowa; and for the 8 Iowa school for the deaf and the Iowa braille and sight saving 9 school. 10 DIVISION II —— WORKFORCE TRAINING PROGRAMS —— APPROPRIATIONS 11 FY 2019-2020. The bill appropriates moneys from the Iowa 12 skilled worker and job creation fund to the department of 13 education and the college student aid commission. 14 The bill also modifies the definition of “new job” for 15 purposes of the Iowa industrial new jobs training Act, to 16 provide that, for FY 2018-2019, the term includes a new, 17 existing, or recalled job in an industry which for purposes of 18 the provision means an existing business located in a county 19 with a population between 40,500 and 41,000, as determined by 20 the 2010 federal decennial census, that was declared a disaster 21 area by the governor following a weather-related natural 22 disaster which impacted the county on or about July 19, 2018. 23 The provision takes effect upon enactment. 24 The gap tuition assistance Act, established under Code 25 chapter 260I, is amended to provide that a criterion for 26 assessing financial need shall be based on the applicant’s 27 family income for the three months prior to the date of 28 application or documentation of a life-changing event. 29 Currently, the criterion is based on the applicant’s family 30 income for the six months prior to the application date. 31 Under the bill, the community college receiving the 32 application may limit an applicant to one eligible certificate 33 program or to eligible programs within one career pathway, 34 based on the funding available to the community college for 35 -33- LSB 1003HV (3) 88 kh/tm 33/ 34

However, a provision making a person 1 ineligible to receive tuition assistance for more than one 2 eligible certificate program is stricken. 3 The requirement that an initial assessment include 4 assessments for completion of a national career readiness 5 certificate, including applied mathematics and locating 6 information is stricken, though the bill requires that the 7 assessment include areas of reading and mathematics. 8 Currently, moneys in the gap tuition assistance fund must 9 be allocated according to a formula established in Code, but 10 under the bill the department of education, in coordination 11 with the community colleges, may adjust the allocations to 12 ensure efficient delivery of services. A requirement that 13 the department adopt rules in consultation with the economic 14 development authority and the community colleges is modified 15 to eliminate consultation with the authority.
