H.F. 756 Section 1. SUBSTANCE ABUSE APPROPRIATION. 1 1. The appropriations made in this subsection are in the 8 amounts anticipated to be received from the federal government 9 for the designated federal fiscal years under 42 U.S.C., ch. 10 6A, subch. XVII, part B, subpart ii, which provides for the 11 prevention and treatment of substance abuse block grant. 12 The department shall expend the funds appropriated in this 13 subsection as provided in the federal law making the funds 14 available and in conformance with chapter 17A . 15 b. Of the funds appropriated for each federal fiscal year 16 in this subsection, an amount not exceeding 5 percent shall be 17 used by the department for administrative expenses. 18 c. (1) For the state fiscal year beginning July 1, 2019, 19 the department shall expend no less than an amount equal to 20 the amount expended for treatment services in the state fiscal 21 year beginning July 1, 2018, for pregnant women and women with 22 dependent children. 23 (2) For the state fiscal year beginning July 1, 2020, the 24 department shall expend no less than an amount equal to the 25 amount expended for treatment services in the state fiscal 26 year beginning July 1, 2019, for pregnant women and women with 27 dependent children. 28 2. At least 20 percent of the funds remaining from the 29 appropriation made in subsection 1 for each federal fiscal year 30 shall be allocated for prevention programs. 31 3. In implementing the federal prevention and treatment of 32 substance abuse block grant under 42 U.S.C., ch. 6A, subch. 33 XVII, and any other applicable provisions of the federal Public 34 Health Service Act under 42 U.S.C., ch. 6A, the department 35 -1- LSB 1021HV (2) 88 hb/tm 1/ 19
H.F. 756 shall apply the provisions of Pub. L. No. 106-310, §3305, 1 as codified in 42 U.S.C. §300x-65, relating to services 2 under such federal law being provided by religious and other 3 nongovernmental organizations. 4 Sec. 2. COMMUNITY MENTAL HEALTH SERVICES APPROPRIATION. 5 1. a. The appropriations made in this subsection are in the 12 amounts anticipated to be received from the federal government 13 for the designated federal fiscal years under 42 U.S.C., ch. 14 6A, subch. XVII, part B, subpart i, which provides for the 15 community mental health services block grant. The department 16 shall expend the funds appropriated in this subsection as 17 provided in the federal law making the funds available and in 18 conformance with chapter 17A . 19 c. The department shall allocate not less than 95 percent 20 of the amount of the block grant each federal fiscal year for 21 eligible community mental health services for carrying out 22 the plan submitted to and approved by the federal substance 23 abuse and mental health services administration or required 24 by the federal substance abuse and mental health services 25 administration for the fiscal year involved. 26 d. Of the amount allocated to eligible services providers 27 in paragraph “c”, 70 percent of the amount each federal fiscal 28 year shall be distributed to the state’s accredited community 29 mental health centers established in accordance with chapter 30 230A or applicable administrative rule. If a mental health 31 services provider was designated as authorized in section 32 230A.107, subsection 2, the provider remains eligible to 33 receive funding distributed pursuant to this paragraph as 34 a community mental health center. The funding distributed 35 -2- LSB 1021HV (2) 88 hb/tm 2/ 19
H.F. 756 shall be used by recipients of the funding for the purpose of 1 staff training or services to adults with a serious mental 2 illness and children with a serious emotional disturbance. 3 The distribution amounts shall be announced at the beginning 4 of the federal fiscal year and distributed on a quarterly 5 basis. By December 15, 2019, recipients of the funding shall 6 submit a report to the department of human services identifying 7 amounts expended or intended to be expended for the purposes 8 designated in this paragraph during the federal fiscal year in 9 which the moneys are received. The department shall compile 10 the reports received from recipients into a single report to be 11 submitted to the governor and the general assembly by January 12 15, 2020. Recipients shall also submit quarterly reports 13 containing data consistent with the performance measures 14 approved by the federal substance abuse and mental health 15 services administration. 16 2. An amount not exceeding 5 percent of the funds 17 appropriated in subsection 1 for each federal fiscal year shall 18 be used by the department of human services for administrative 19 expenses. From the funds set aside by this subsection for 20 administrative expenses, the department shall pay to the 21 auditor of state an amount sufficient to pay the cost of 22 auditing the use and administration of the state’s portion of 23 the funds appropriated in subsection 1. The auditor of state 24 shall bill the department for the costs of the audits. 25 Sec. 3. MATERNAL AND CHILD HEALTH SERVICES APPROPRIATIONS. 26 1. The department shall expend the funds 2 appropriated in this subsection as provided in the federal law 3 making the funds available and in conformance with chapter 17A . 4 b. Funds appropriated in this subsection shall not be used 5 by the university of Iowa hospitals and clinics for indirect 6 costs. 7 2. An amount not exceeding 10 percent of the funds 8 appropriated in subsection 1 for each federal fiscal year shall 9 be used by the department of public health for administrative 10 expenses. 11 3. The departments of public health, human services, and 12 education and the university of Iowa’s mobile and regional 13 child health specialty clinics shall continue to pursue to the 14 maximum extent feasible the coordination and integration of 15 services to women and children. 16 4. a. Sixty-three percent of the amount remaining after 17 the allocation made in subsection 2 for each federal fiscal 18 year shall be allocated to supplement appropriations for 19 maternal and child health programs within the department of 20 public health. Thirty-seven percent of the amount remaining after 26 the allocation made in subsection 2 for each federal fiscal 27 year shall be allocated to the university of Iowa hospitals 28 and clinics under the control of the state board of regents 29 for mobile and regional child health specialty clinics. The 30 university of Iowa hospitals and clinics shall not receive an 31 allocation for indirect costs from the funds for this program. 32 Priority shall be given to establishment and maintenance of a 33 statewide system of mobile and regional child health specialty 34 clinics. 35 -4- LSB 1021HV (2) 88 hb/tm 4/ 19

The department of public health shall administer the 1 statewide maternal and child health program and the disabled 2 children’s program by conducting mobile and regional child 3 health specialty clinics and conducting other activities to 4 improve the health of low-income women and children and to 5 promote the welfare of children with actual or potential 6 handicapping conditions and chronic illnesses in accordance 7 with the requirements of Tit. V of the federal Social Security 8 Act. 9 Sec. 4. PREVENTIVE HEALTH AND HEALTH SERVICES 10 APPROPRIATIONS. 11 1. XVII, part A, which provides for the preventive 21 health and health services block grant. The department shall 22 expend the funds appropriated in this subsection as provided in 23 the federal law making the funds available and in conformance 24 with chapter 17A . 25 2. Of the funds appropriated in subsection 1 for each 26 federal fiscal year, an amount not exceeding 10 percent shall 27 be used by the department for administrative expenses. 28 3. Of the funds appropriated in subsection 1 for each 29 federal fiscal year, the specific amount of funds stipulated 30 by the notice of the block grant award shall be allocated for 31 services to victims of sex offenses and for rape prevention 32 education. 33 4. After deducting the funds allocated in subsections 2 and 34 3, the remaining funds appropriated in subsection 1 for each 35 -5- LSB 1021HV (2) 88 hb/tm 5/ 19
H.F. 756 federal fiscal year may be used by the department for healthy 1 people 2020 and Iowa’s health improvement plan 2012-2016 2 program objectives, preventive health advisory committee, and 3 risk reduction services, including nutrition programs, health 4 incentive programs, chronic disease services, emergency medical 5 services, monitoring of the fluoridation program and start-up 6 fluoridation grants, and acquired immune deficiency syndrome 7 services. The moneys specified in this subsection shall not be 8 used by the university of Iowa hospitals and clinics or by the 9 state hygienic laboratory for the funding of indirect costs. 10 Sec. 5. STOP VIOLENCE AGAINST WOMEN GRANT PROGRAM 11 APPROPRIATION. 12 1. XII-H, which provides for grants to combat violent 22 crimes against women. The department of justice shall expend 23 the funds appropriated in this subsection as provided in the 24 federal law making the funds available and in conformance with 25 chapter 17A . 26 2. An amount not exceeding 10 percent of the funds 27 appropriated in subsection 1 shall be used by the department of 28 justice for administrative expenses. From the funds set aside 29 by this subsection for administrative expenses, the department 30 shall pay to the auditor of state an amount sufficient to pay 31 the cost of auditing the use and administration of the state’s 32 portion of the funds appropriated in subsection 1. 33 Sec. 6. RESIDENTIAL SUBSTANCE ABUSE TREATMENT FOR STATE 34 PRISONERS FORMULA GRANT PROGRAM. There is appropriated from 35 -6- LSB 1021HV (2) 88 hb/tm 6/ 19

EDWARD BYRNE MEMORIAL JUSTICE ASSISTANCE GRANT 15 PROGRAM APPROPRIATION. Each federal fiscal year, the administrator of the 11 division of community action agencies of the department 12 of human rights shall allocate not less than 96 percent of 13 the amount of the block grants to eligible community action 14 agencies for programs benefiting low-income persons. Each 15 eligible agency shall receive a minimum allocation of not 16 less than $100,000. The minimum allocation shall be achieved 17 by redistributing increased funds from agencies experiencing 18 a greater share of available funds. The funds shall be 19 distributed on the basis of the poverty-level population in the 20 area represented by the community action areas compared to the 21 size of the poverty-level population in the state. 22 2. An amount not exceeding 4 percent of the funds 23 appropriated in subsection 1 for each federal fiscal year shall 24 be used by the division of community action agencies of the 25 department of human rights for administrative expenses. From 26 the funds set aside by this subsection for administrative 27 expenses, the division of community action agencies of the 28 department of human rights shall pay to the auditor of state 29 an amount sufficient to pay the cost of auditing the use and 30 administration of the state’s portion of the funds appropriated 31 in subsection 1. The auditor of state shall bill the division 32 of community action agencies for the costs of the audits. 33 Sec. 9. COMMUNITY DEVELOPMENT APPROPRIATIONS. 34 1. An amount not exceeding $1,100,000 for the federal 13 fiscal year beginning October 1, 2019, shall be used by the 14 economic development authority for administrative expenses for 15 the community development block grant. The total amount used 16 for administrative expenses includes $600,000 for the federal 17 fiscal year beginning October 1, 2019, of funds appropriated 18 in subsection 1 and a matching contribution from the state 19 equal to $500,000 from the appropriation of state funds for 20 the community development block grant and state appropriations 21 for related activities of the economic development authority. 22 From the funds set aside for administrative expenses by this 23 subsection, the economic development authority shall pay to 24 the auditor of state an amount sufficient to pay the cost of 25 auditing the use and administration of the state’s portion of 26 the funds appropriated in subsection 1. The auditor of state 27 shall bill the authority for the costs of the audit. 28 b. An amount not exceeding $1,100,000 for the federal 29 fiscal year beginning October 1, 2020, shall be used by the 30 economic development authority for administrative expenses for 31 the community development block grant. The total amount used 32 for administrative expenses includes $600,000 for the federal 33 fiscal year beginning October 1, 2020, of funds appropriated 34 in subsection 1 and a matching contribution from the state 35 -9- LSB 1021HV (2) 88 hb/tm 9/ 19
H.F. 756 equal to $500,000 from the appropriation of state funds for 1 the community development block grant and state appropriations 2 for related activities of the economic development authority. 3 From the funds set aside for administrative expenses by this 4 subsection, the economic development authority shall pay to 5 the auditor of state an amount sufficient to pay the cost of 6 auditing the use and administration of the state’s portion of 7 the funds appropriated in subsection 1. The auditor of state 8 shall bill the authority for the costs of the audit. 9 Sec. 10. SURFACE TRANSPORTATION BLOCK GRANT PROGRAM 10 APPROPRIATION. The 21 department shall expend the moneys appropriated in this section 22 as provided in the federal law making the funds available and 23 in conformance with chapter 17A . 24 Sec. 11. LOW-INCOME HOME ENERGY ASSISTANCE APPROPRIATIONS. 25 1. H.F. 756 94, subch. II, which provides for the low-income home energy 1 assistance block grants. The division of community action 2 agencies of the department of human rights shall expend the 3 funds appropriated in this subsection as provided in the 4 federal law making the funds available and in conformance with 5 chapter 17A . 6 2. Up to 15 percent, or up to 25 percent if a waiver is 7 approved by the United States department of health and human 8 services, of the amount appropriated in this section that is 9 actually received for each federal fiscal year shall be used 10 for residential weatherization or other related home repairs 11 for low-income households. Of this allocation amount, not more 12 than 10 percent may be used for administrative expenses. 13 3. After subtracting the allocation in subsection 2, up to 14 10 percent of the remaining moneys for each federal fiscal year 15 are allocated for administrative expenses of the low-income 16 home energy assistance program of which $377,000 is allocated 17 each federal fiscal year for administrative expenses of the 18 division. The costs of auditing the use and administration 19 of the portion of the appropriation in this section that is 20 retained by the state shall be paid from the amount allocated 21 in this subsection each federal fiscal year to the division. 22 The auditor of state shall bill the division for the audit 23 costs. 24 4. The remaining moneys of the appropriation made in this 25 section for each federal fiscal year following the allocations 26 made in subsections 2 and 3, shall be used to help eligible 27 households as defined in 42 U.S.C., ch. 94, subch. II, to meet 28 home energy costs. 29 5. Not more than 10 percent of the amount appropriated in 30 this section each federal fiscal year that is actually received 31 may be carried forward for use in the succeeding federal fiscal 32 year. 33 6. Expenditures for assessment and resolution of energy 34 problems shall be limited to not more than 5 percent of the 35 -11- LSB 1021HV (2) 88 hb/tm 11/ 19

SOCIAL SERVICES BLOCK GRANT PLAN. The department 22 of human services during each state fiscal year shall develop a 23 plan for the use of federal social services block grant funds 24 for the subsequent state fiscal year. 25 The proposed plan shall include all programs and services 26 at the state level which the department proposes to fund with 27 federal social services block grant funds, and shall identify 28 state and other funds which the department proposes to use to 29 fund the state programs and services. 30 The proposed plan shall also include all local programs and 31 services which are eligible to be funded with federal social 32 services block grant funds, the total amount of federal social 33 services block grant funds available for the local programs and 34 services, and the manner of distribution of the federal social 35 -13- LSB 1021HV (2) 88 hb/tm 13/ 19
H.F. 756 services block grant funds to the counties. The proposed plan 1 shall identify state and local funds which will be used to fund 2 the local programs and services. 3 The proposed plan shall be submitted with the department’s 4 budget requests to the governor and the general assembly. 5 Sec. 14. PROJECTS FOR ASSISTANCE IN TRANSITION FROM 6 HOMELESSNESS. 7 1. Upon receipt of the minimum formula grant from 8 the federal substance abuse and mental health services 9 administration to provide mental health services for the 10 homeless, for the federal fiscal years beginning October 1, 11 2019, and October 1, 2020, the department of human services 12 shall assure that a project which receives funds under the 13 formula grant shall do all of the following: 14 a. Provide outreach and engagement to homeless individuals 15 and individuals at risk of homelessness and assesses those 16 individuals for serious mental illness. 17 b. Enroll those individuals with serious mental illness who 18 are willing to accept services through the project. 19 c. Provide case management to homeless persons. 20 d. Provide appropriate training to persons who provide 21 services to persons targeted by the grant. 22 e. Assure a local match share of 25 percent. 23 f. Refer homeless individuals and individuals at risk of 24 homelessness to primary health care, job training, educational 25 services, and relevant housing services. 26 2. A project may expend funds for community mental health 27 services, diagnostic services, crisis intervention services, 28 habilitation and rehabilitation services, substance-related 29 disorder services, supportive and supervisory services to 30 homeless persons living in residential settings that are 31 not otherwise supported, and housing services including 32 minor renovation, expansion, and repair of housing, security 33 deposits, planning of housing, technical assistance in 34 applying for housing, improving the coordination of housing 35 -14- LSB 1021HV (2) 88 hb/tm 14/ 19
H.F. 756 services, the costs associated with matching eligible homeless 1 individuals with appropriate housing, and one-time rental 2 payments to prevent eviction. 3 Sec. 15. CHILD CARE AND DEVELOPMENT APPROPRIATION. II-B, which provides for the child care and 14 development block grant. The department shall expend the funds 15 appropriated in this section as provided in the federal law 16 making the funds available and in conformance with chapter 17A . 17 Moneys appropriated in this section that remain unencumbered 18 or unobligated at the close of the fiscal year shall revert to 19 be available for appropriation for purposes of the child care 20 and development block grant in the succeeding fiscal year. 21 Sec. 16. PROCEDURE FOR REDUCED FEDERAL FUNDS. 22 1. Unless otherwise necessary to meet federal requirements, 23 if the funds received from the federal government for the 24 block grants specified in this Act are less than the amounts 25 appropriated, the funds actually received shall be prorated 26 by the governor for the various programs, other than for the 27 services to victims of sex offenses and for rape prevention 28 education under section 4, subsection 3, of this Act, for which 29 each block grant is available according to the percentages that 30 each program is to receive as specified in this Act. However, 31 if the governor determines that the funds allocated by the 32 percentages will not be sufficient to accomplish the purposes 33 of a particular program, or if the appropriation is not 34 allocated by percentage, the governor may allocate the funds in 35 -15- LSB 1021HV (2) 88 hb/tm 15/ 19
H.F. 756 a manner which will accomplish to the greatest extent possible 1 the purposes of the various programs for which the block grants 2 are available. 3 2. Before the governor implements the actions provided for 4 in subsection 1, the following procedures shall be taken: 5 a. The chairpersons and ranking members of the senate and 6 house standing committees on appropriations, the appropriate 7 chairpersons and ranking members of subcommittees of those 8 committees, and the director of the legislative services agency 9 shall be notified of the proposed action. 10 b. The notice shall include the proposed allocations, 11 and information on the reasons why particular percentages or 12 amounts of funds are allocated to the individual programs, 13 the departments and programs affected, and other information 14 deemed useful. Chairpersons and ranking members notified shall 15 be allowed at least two weeks to review and comment on the 16 proposed action before the action is taken. 17 Sec. 17. PROCEDURE FOR INCREASED FEDERAL FUNDS. 18 1. Unless otherwise necessary to meet federal requirements, 19 if funds received from the federal government in the form of 20 block grants exceed the amounts appropriated in sections 1, 2, 21 3, 4, 7, 9, and 13 of this Act, the excess shall be prorated 22 to the appropriate programs according to the percentages 23 specified in those sections, except additional funds shall not 24 be prorated for administrative expenses. 25 2. If actual funds received from the federal government 26 from block grants exceed the amount appropriated in section 12 27 of this Act for the low-income home energy assistance program, 28 not more than 15 percent of the excess may be allocated to the 29 low-income residential weatherization program and not more than 30 10 percent of the excess may be used for administrative costs. 31 3. If funds received from the federal government from 32 community services block grants exceed the amount appropriated 33 in section 8 of this Act, 100 percent of the excess is 34 allocated to the community services block grant program. 35 -16- LSB 1021HV (2) 88 hb/tm 16/ 19
H.F. 756 Sec. 18. PROCEDURE FOR EXPENDITURE OF ADDITIONAL FEDERAL 1 FUNDS. If other federal grants, receipts, and funds and other 2 nonstate grants, receipts, and funds become available or are 3 awarded which are not available or awarded during the period 4 in which the general assembly is in session, but which require 5 expenditure by the applicable department or agency prior to 6 March 15 of the fiscal years beginning July 1, 2019, and July 7 1, 2020, these grants, receipts, and funds are appropriated to 8 the extent necessary, provided that the fiscal committee of 9 the legislative council is notified within 30 days of receipt 10 of the grants, receipts, or funds and the fiscal committee of 11 the legislative council has an opportunity to comment on the 12 expenditure of the grants, receipts, or funds. 13 Sec. 19. OTHER GRANTS, RECEIPTS, AND FUNDS. Federal grants, 14 receipts, and funds and other nonstate grants, receipts, and 15 funds, available in whole or in part of the state fiscal years 16 beginning July 1, 2019, and July 1, 2020, are appropriated to 17 the following departments and agencies that are designated 18 by and for the purposes set forth in the grants, receipts, 19 or conditions accompanying the receipt of the funds, unless 20 otherwise provided by law: 21 1.
