Section
1.
Section
2.69,
subsection
4,
Code
2019,
is
amended
1
by
adding
the
following
new
paragraph:

PARAGRAPH
.
0d.
Review
and
analyze
approximately
3
one-third
of
all
professional
licenses,
certifications,
and
4
registrations
available
in
the
state
during
each
two-year
5
period,
such
that
each
license,
certification,
and
registration
6
shall
be
reviewed
within
six
years.
The
committee
may
require
7
the
submission
of
information
by
the
relevant
licensing,
8
certifying,
or
registering
entities
and
other
interested
9
parties.
The
committee
shall
consider
the
direct
and
indirect
10
costs,
utility,
and
health
and
safety
implications
of
11
requiring
such
licenses,
certifications,
and
registrations.
12
The
committee
shall
include
in
the
report
required
pursuant
13
to
paragraph
“d”
a
recommendation
regarding
whether
the
14
legislature
should
enact
legislation
that:
15
(a)
Repeals
a
professional
license,
certification,
or
16
registration.
17
(b)
Converts
an
occupational
license
to
a
certification
or
18
registration,
or
converts
a
certification
to
a
registration.
19
(c)
Changes
the
requisite
qualifications
for
a
professional
20
license,
certification,
or
registration.
21
(d)
Redefines
the
scope
of
practice
of
a
professional
22
license,
certification,
or
registration.
23
(e)
Reflects
any
other
recommendation
made
by
the
24
committee.

Sec.
2.
Section
2.69,
subsection
4,
paragraph
d,
Code
2019,
26
is
amended
to
read
as
follows:

d.
Issue
a
report,
including
its
findings
and
28
recommendations,
to
the
general
assembly.
The
general
assembly
29
shall
vote
on
the
adoption
of
each
report.

3.
Section
84A.5,
Code
2019,
is
amended
by
adding
the

following
new
subsection:

in
the
state

The
department
of
workforce
development
shall
2
update
the
list
as
soon
as
practicable
after
the
conclusion
of

each
session
of
the
general
assembly.

Sec.
4.
NEW
SECTION
.
272C.13
Disqualifications
for
criminal
5
convictions
limited.
6
An
individual
may
petition
a
licensing
board,
in
a
form
7
prescribed
by
the
licensing
authority,
for
a
determination
as
8
to
whether
the
individual’s
criminal
record
will
prevent
the
9
individual
from
receiving
a
license.
The
licensing
board
shall
10
issue
such
determinations
within
thirty
days
of
receipt.
The
11
licensing
board
may
charge
a
fee
to
recoup
the
costs
of
such
12
a
determination,
provided
that
such
a
fee
shall
not
exceed
13
twenty-five
dollars.

EXPLANATION
15
The
inclusion
of
this
explanation
does
not
constitute
agreement
with
16
the
explanation’s
substance
by
the
members
of
the
general
assembly.
17
This
bill
relates
to
professional
licensing
in
this
state.
18
The
bill
instructs
the
state
government
efficiency
review
19
committee
to
review
and
analyze
approximately
one-third
of
20
all
professional
licenses,
certifications,
and
registrations
21
issued
in
the
state
during
each
two-year
period
in
which
22
the
committee
must
meet.
The
bill
authorizes
the
committee
23
to
require
the
submission
of
information
from
the
relevant
24
licensing,
certifying,
and
registering
entities
and
other
25
interested
parties.
The
bill
requires
the
committee
to
26
consider
the
direct
and
indirect
costs,
utility,
and
27
health
and
safety
implications
of
requiring
such
licenses,
28
certifications,
and
registrations.
The
committee
is
required
29
to
make
recommendations
regarding
the
reviewed
licenses,
30
certifications,
and
registrations
in
its
statutorily
mandated
31
report.
The
bill
requires
the
general
assembly
to
vote
on
the
32
adoption
of
each
such
report.

The
bill
requires
the
department
of
workforce
development

to
maintain
on
the
internet
site
of
the
department
a
list
of

issued
in
the
state
and
the
requirements
to
receive
each

license,
certification,

registration.
The
bill
directs
the
3
department
to
update
the
list
as
soon
as
practicable
after
the
4
conclusion
of
each
session
of
the
general
assembly.

The
bill
also
allows
a
person
seeking
to
obtain
a
6
professional
license
to
submit
a
petition
to
a
licensing
board
7
for
a
determination
as
to
whether
that
person’s
criminal
record
8
will
disqualify
the
person
from
receiving
a
license
from
the
9
board.
A
licensing
board
must
issue
a
determination
within
30
10
days
of
receiving
a
petition
and
may
charge
a
fee
of
up
to
$25
11
to
recoup
the
costs
of
such
a
determination.
