H.F. 732 Section 1. Section 124E.2, subsection 2, paragraph i, Code 1 2019, is amended to read as follows: 2 i. Untreatable Severe or chronic pain. 3 Sec. 2. Section 124E.2, subsections 5 and 6, Code 2019, are 4 amended to read as follows: 5 5. “Health care practitioner” means an individual licensed 6 under chapter 148 to practice medicine and surgery or 7 osteopathic medicine and surgery , a physician assistant 8 licensed under chapter 148C, or an advanced registered nurse 9 practitioner licensed under chapter 152 or 152E, who is a 10 patient’s primary care provider. “Health care practitioner” 11 shall not include a physician assistant licensed under chapter 12 148C or an advanced registered nurse practitioner licensed 13 pursuant to chapter 152 or 152E . 14 6. “Medical cannabidiol” means any pharmaceutical 15 grade cannabinoid found in the plant Cannabis sativa L. or 16 Cannabis indica or any other preparation thereof that has 17 a tetrahydrocannabinol level of no more than three percent 18 and that is delivered in a form recommended by the medical 19 cannabidiol board, approved by the board of medicine, and 20 adopted by the department pursuant to rule. 21 Sec. 3. Section 124E.2, subsection 8, Code 2019, is amended 22 by striking the subsection. 23 Sec. 4. Section 124E.4, subsection 1, paragraph f, Code 24 2019, is amended by striking the paragraph. 25 Sec. 5. Section 124E.9, Code 2019, is amended by adding the 26 following new subsections: 27 NEW SUBSECTION . 13. A medical cannabidiol dispensary 28 may employ a pharmacist or pharmacy technician licensed or 29 registered pursuant to chapter 155A. 30 NEW SUBSECTION . 14. A medical cannabidiol dispensary shall 31 not dispense more than a combined total of twenty grams of 32 tetrahydrocannabinol to a patient and the patient’s primary 33 caregiver in a ninety-day period. The department may decrease 34 this limit by rule as provided in section 124E.11, subsection 35 -1- LSB 2764HV (2) 88 ss/rh 1/ 3
H.F. 732 2, paragraph “c” . 1 Sec. 6. Section 124E.11, subsection 1, paragraph b, 2 subparagraph (1), subparagraph division (c), Code 2019, is 3 amended to read as follows: 4 (c) To authorized employees of a medical cannabidiol 5 dispensary, but only for the purpose purposes of verifying that 6 a person is lawfully in possession of a medical cannabidiol 7 registration card issued pursuant to this chapter and that a 8 person has not purchased tetrahydrocannabinol in excess of the 9 amount authorized by this chapter . 10 Sec. 7. Section 124E.11, subsection 2, Code 2019, is amended 11 by adding the following new paragraph: 12 NEW PARAGRAPH . j. Collect and evaluate data on patient 13 demographics, effective treatment options, clinical outcomes, 14 and quality of life outcomes for the purpose of reporting on 15 the benefits, risks, and outcomes encountered by patients with 16 a debilitating medical condition engaged in the use of medical 17 cannabidiol. 18 EXPLANATION 19 The inclusion of this explanation does not constitute agreement with 20 the explanation’s substance by the members of the general assembly. 21 This bill relates to the medical cannabidiol Act (Code 22 chapter 124E). 23 The bill replaces “untreatable pain” with “severe and 24 chronic pain” on the list of debilitating medical conditions 25 for which medical cannabidiol may be recommended by a health 26 care practitioner. 27 The bill adds physician assistants and advanced registered 28 nurse practitioners to the list of health care practitioners 29 who may certify a person to receive a medical cannabidiol 30 registration card. 31 The bill removes the percentage cap on the amount of 32 tetrahydrocannabinol (THC) that medical cannabidiol, as defined 33 in Code section 124E.2(6), is allowed to contain. The bill 34 prohibits a dispensary from dispensing more than 20 grams of 35 -2- LSB 2764HV (2) 88 ss/rh 2/ 3
H.F. 732 THC to a patient or a patient’s caregiver in a 90-day period. 1 The bill allows the department of public health to lower this 2 limit by rule. The bill allows the department to disclose 3 certain patient information to authorized employees of medical 4 cannabidiol dispensaries to ensure that a person has not 5 purchased THC in excess of this limit. 6 The bill removes the prohibition on certain felons who are 7 patients applying for a medical cannabidiol registration card. 8 The bill allows a medical cannabidiol dispensary to employ 9 a pharmacist or pharmacy technician licensed or registered 10 pursuant to Code chapter 155A. 11 The bill directs the department of public health to adopt 12 rules for the collection and evaluation of data regarding 13 patient demographics, effective treatment options, clinical 14 outcomes, and quality of life outcomes for the purpose of 15 reporting on the benefits, risks, and outcomes encountered by 16 patients with a debilitating medical condition engaged in the 17 use of medical cannabidiol. 18 -3- LSB 2764HV (2) 88 ss/rh 3/ 3
