H.F. 709 Section 1. NEW SECTION . 232.108A Suspension of child 1 support order —— child in need of assistance proceedings. 2 If, at any time during the judicial proceedings following 3 the filing of a petition pursuant to section 232.87, the 4 custody or physical care of a child is granted to a party who is 5 obligated to pay support for the child under an existing child 6 support order entered under chapter 234, 252A, 252C, 252F, 7 598, or 600B, or any other chapter, the juvenile court shall 8 issue a notice to the appropriate district court requesting 9 suspension of any existing child support obligation for the 10 party relating to the child. Upon receipt by the district 11 court of the notice and documentation that established any 12 such existing child support obligation, the district court 13 shall suspend the support obligation of the party. If, 14 pursuant to an order issued by the juvenile court, the child 15 is subsequently returned to the child’s home, the district 16 court shall reinstate the support obligation of the party 17 obligated to pay support for the child prior to the suspension 18 as specified in this section. 19 EXPLANATION 20 The inclusion of this explanation does not constitute agreement with 21 the explanation’s substance by the members of the general assembly. 22 This bill requires that if, at any time during the judicial 23 proceedings following the filing of a petition to determine 24 if a child is a child in need of assistance, the custody 25 or physical care of a child is granted to a party who is 26 obligated to pay support for the child under an existing child 27 support order, the juvenile court shall issue a notice to 28 the appropriate district court requesting suspension of any 29 existing child support obligation for the party relating to the 30 child. Upon receipt by the district court of the notice and 31 documentation that established any such existing child support 32 obligation, the district court shall suspend the support 33 obligation of the party.
