1.
Section
321.463,

amended
to
read
as
follows:

Self-propelled
implements
Notwithstanding
any

provision
of
this
section
to
the
contrary,
the
weight
on

any
one
axle
of
a
self-propelled
implement
of
husbandry
5
used
exclusively
for
the
application
of
organic
or
inorganic
6
plant
food
materials,
agricultural
limestone,
or
agricultural
7
chemicals
,
unless
traveling
under
a
permit
issued
pursuant
8
to
section
321E.8A
,
operated
on
the
highways
of
this
state
9
shall
be
operated
in
compliance
with
this
section
not
exceed
10
twenty-five
thousand
pounds
.

(2)
A
self-propelled
implement
of
husbandry
used
12
exclusively
for
the
application
of
organic
or
inorganic
13
plant
food
materials,
agricultural
limestone,
or
agricultural
14
chemicals
shall
comply
with
the
other
provisions
of
this
15
section
and
chapter
when
operated
over
a
bridge
in
this
state,
16
other
than
any
provision
limiting
the
weight
on
any
one
axle
to
17
less
than
twenty-five
thousand
pounds.
A
local
authority
may
18
issue
a
special
permit,
based
on
a
statewide
standard
developed
19
by
the
department,
allowing
the
operation
over
a
bridge
20
within
its
jurisdiction
of
such
a
self-propelled
implement
of
21
husbandry
with
a
weight
in
excess
of
the
weights
allowed
under
22
this
chapter.

Sec.
2.
Section
321E.3,
subsection
1,
Code
2019,
is
amended
24
to
read
as
follows:

1.
Permits
issued
under
this
chapter
shall
be
issued
by
26
the
authority
responsible
for
the
maintenance
of
the
system
of
27
highways
or
streets.
However,
the
department
may
issue
permits
28
on
primary
road
extensions
in
cities
in
conjunction
with
29
movements
on
the
rural
primary
road
system.
The
department
30
may
issue
an
all-systems
permit
under
section
321E.8
which
31
is
valid
for
movements
on
all
highways
or
streets
under
the
32
jurisdiction
of
either
the
state
or
those
local
authorities
33
that
have
indicated
to
the
department
in
writing,
including
by
34
means
of
electronic
communication,
those
streets
or
highways

for
which
an
all-systems
permit
is
not
valid.
The
department
1
may
issue
annual
permits
pursuant
to
section
321E.8A
valid
only
2
for
operation
on
noninterstate
highways
in
counties
stipulated
3
in
the
permit.

Sec.
3.
Section
321E.7,
subsection
4,
Code
2019,
is
amended
5
by
striking
the
subsection.

Sec.
4.
REPEAL.
Section
321E.8A,
Code
2019,
is
repealed.

EXPLANATION

The
inclusion
of
this
explanation
does
not
constitute
agreement
with
9
the
explanation’s
substance
by
the
members
of
the
general
assembly.

This
bill
prohibits
the
weight
on
any
one
axle
of
a
11
self-propelled
implement
of
husbandry
used
exclusively
for
12
the
application
of
organic
or
inorganic
plant
food
materials,
13
agricultural
limestone,
or
agricultural
chemicals
operated
14
on
the
highways
from
exceeding
25,000
pounds.
Such
a
15
self-propelled
implement
of
husbandry
must
comply
with
the
16
other
provisions
of
Code
section
321.463
and
Code
chapter
321
17
when
operated
over
a
bridge,
other
than
any
provision
limiting
18
the
weight
on
any
one
axle
to
less
than
25,000
pounds.
The
19
bill
authorizes
a
local
authority
to
issue
a
special
permit,
20
based
on
a
statewide
standard
developed
by
the
department
of
21
transportation,
allowing
the
operation
over
a
bridge
within
22
the
local
authority’s
jurisdiction
of
such
a
self-propelled
23
implement
of
husbandry
with
a
weight
in
excess
of
the
weights
24
allowed.
A
violation
of
Code
section
321.463
is
punishable
25
by
a
scheduled
fine
in
the
amounts
set
forth
in
Code
section
26
321.463(11).

The
bill
repeals
a
provision
authorizing
overweight
permits
28
for
such
self-propelled
implements
of
husbandry
originally
29
purchased
or
ordered
prior
to
February
1,
2007,
and
strikes
the
30
corresponding
references
to
the
provision.

Under
Code
section
321.1,
an
“implement
of
husbandry”
32
is
a
vehicle
or
special
mobile
equipment
manufactured,
33
designed,
or
reconstructed
for
agricultural
purposes
and,
34
except
for
incidental
uses,
exclusively
used
in
the
conduct
of
35

agricultural
operations.
“Implements
of
husbandry”
includes
1
certain
all-terrain
vehicles,
fence-line
feeders,
and
vehicles
2
used
exclusively
for
the
application
of
organic
or
inorganic
3
plant
food
materials,
organic
agricultural
limestone,
or
4
agricultural
chemicals.
To
be
considered
an
implement
of
5
husbandry,
a
self-propelled
implement
of
husbandry
must
be
6
operated
at
speeds
of
35
miles
per
hour
or
less.
