1.
Section
148G.1,
Code
2019,
is
amended
by
adding
1
the
following
new
subsection:

NEW
SUBSECTION
.
10A.
“Sleep
diagnostic
testing
facility”
3
means
a
building
or
place
situated
in
a
fixed
location
4
or
a
mobile
entity
that
is
used
to
provide
sleep-related
5
services
and
includes
sleep-related
disorder
centers
and
6
laboratories
for
sleep-related
respiratory
disorders,
but
7
does
not
include
a
hospital
licensed
under
chapter
135B
that
8
provides
sleep-related
services
for
its
patients,
including
9
sleep-related
services
provided
under
arrangements
made
by
10
the
hospital
for
its
patients
whereby
the
hospital
exercises
11
professional
responsibility
over
the
arranged
services.

2.
Section
148G.3,
Code
2019,
is
amended
to
read
as
13
follows:

148G.3
Location
of
services.
15
The
practice
of
polysomnography
shall
take
place
only
in
a
16
facility
that
is
accredited
by
a
nationally
recognized
sleep
17
medicine
laboratory
or
center
accrediting
agency,
in
a
facility
18
operated
by
a
hospital
or
a
hospital
licensed
under
chapter
19
135B
,
or
in
a
patient’s
home
,
with
testing
equipment
provided
20
by
a
sleep
diagnostic
testing
facility,
or
hospital
licensed
21
under
chapter
135B
with
a
physical
location
in
the
state
of
22
Iowa,
or
a
mobile
testing
company
with
a
physical
location
in
23
the
state
of
Iowa
or
within
ninety
miles
of
the
state
of
Iowa,
24
pursuant
to
rules
adopted
by
the
board;
provided,
however,
that
25
the
scoring
of
data
and
the
education
of
patients
may
take
26
place
in
another
setting.

Supervision
of
sleep-related

services
in
a
patient’s
home.

Sleep-related
services
provided
in
a
patient’s
home
shall

be
conducted
under
the
general
supervision
of
a
physician
or

qualified
health
care
professional
prescriber
or
a
person
32
supervised
by
an
American
academy
of
sleep
medicine
board
33
certified
physician
or
qualified
health
care
professional
34
prescriber
and
the
results
thereof
shall
be
interpreted
by
an

Patients
shall
be
educated
on
the
proper
use
of
testing

equipment
by
a
respiratory
care
practitioner,
respiratory
care

polysomnography
practitioner,
registered
polysomnographic

technologist,
or
American
academy
of
sleep
medicine
board
5
certified
physician
employed
by
or
affiliated
with
the
sleep
6
diagnostic
testing
facility
providing
the
sleep-related
7
services,
or
by
a
person
supervised
by
such
a
person.

NEW
SECTION
.
148G.3B
Operation
of
sleep
diagnostic
9
testing
facilities.

A
sleep
diagnostic
testing
facility
shall
comply
with
all
of
11
the
following
standards:

1.
A
sleep
diagnostic
testing
facility
shall
be
supervised
13
by
an
American
academy
of
sleep
medicine
board
certified
14
physician.
15
2.
A
sleep
diagnostic
testing
facility
shall
be
accredited
16
by
a
nationally
recognized
sleep
medicine
laboratory
or
center
17
accrediting
agency.
18
3.
Data
from
the
provision
of
sleep-related
services
shall
19
be
interpreted
by
an
American
academy
of
sleep
medicine
board
20
certified
physician.
21
4.
All
sleep-related
services
shall
be
conducted
by
or
22
under
the
general
supervision
of
an
American
academy
of
sleep
23
medicine
board
certified
physician
or
qualified
health
care
24
professional
prescriber.

The
inclusion
of
this
explanation
does
not
constitute
agreement
with
27
the
explanation’s
substance
by
the
members
of
the
general
assembly.

This
bill
concerns
the
practice
of
polysomnography
in
Iowa.
29
The
bill
adds
a
requirement
that
any
in-home
sleep
30
diagnostic
testing
be
performed
with
equipment
provided
by
a
31
sleep
diagnostic
testing
facility,
hospital,
or
mobile
testing
32
company
with
a
physical
location
in
Iowa
or
within
90
miles
of
33
Iowa
and
that
the
patient
receive
education
on
the
proper
use
34
of
such
equipment
by
a
certified
respiratory
care
practitioner,

and

practitioner,
registered

polysomnographic
technologist,
or
physician

by
or

the

bill
also

services
provided
in
a
patient’s
home

the

such
a
person,
and
data
from
the
provision
of

sleep-related
services
shall
be
interpreted
by
a
physician.

The
bill
requires
a

diagnostic
testing
facility,

as
defined
in
the
bill,
to
be
accredited
by
a
nationally
11
recognized
sleep
medicine
laboratory
or
center
accrediting
12
agency.
