life-sustaining
procedures
from
minor
child

court

A
court
of
law
or
equity
shall
not
have
the
authority
to
4
require
the
withdrawal
of
life-sustaining
procedures
from
a
5
minor
child
over
the
objection
of
the
minor
child’s
parent
or
6
guardian,
unless
there
is
conclusive
medical
evidence
that
7
the
minor
child
has
died
and
any
electronic
brain,
heart,
or
8
respiratory
monitoring
activity
exhibited
to
the
contrary
9
is
a
false
artifact.
For
the
purposes
of
this
section,
10
“life-sustaining
procedure”
means
the
same
as
defined
in
section
11
144A.2.

EXPLANATION
13
The
inclusion
of
this
explanation
does
not
constitute
agreement
with
14
the
explanation’s
substance
by
the
members
of
the
general
assembly.

This
bill
provides
that
a
court
of
law
or
equity
shall
not
16
have
the
authority
to
require
the
withdrawal
of
life-sustaining
17
procedures
from
a
minor
child
over
the
objection
of
the
minor
18
child’s
parent
or
guardian,
unless
there
is
conclusive
medical
19
evidence
that
the
minor
child
has
died
and
any
electronic

heart,
or
respiratory
monitoring

exhibited
to

the

For
the
purposes
of
the

bill,
“life-sustaining
procedure”
means
the
same
as
under
the

life-sustaining
procedures
Act
(Code
chapter
144A).
