H.F. 572 Section 1. Section 123.130, subsection 1, Code 2019, is 1 amended to read as follows: 2 1. Any person holding a class “A” beer permit issued by the 3 division shall be authorized to manufacture and sell, or sell 4 at wholesale, beer for consumption off the premises, such sales 5 within the state to be made only to persons holding subsisting 6 class “A”, “B”, or “C” beer permits, both a class “C” native 7 wine permit and a class “A” wine permit pursuant to section 8 123.178B, subsection 4 , or liquor control licenses issued in 9 accordance with the provisions of this chapter . A class “A” 10 or special class “A” beer permit does not grant authority to 11 manufacture wine as defined in section 123.3, subsection 48 . 12 However, if the person holding a class “A” or special class “A” 13 permit is a manufacturer of beer in this state, the person may 14 sell up to a total of one hundred barrels per year of the beer 15 it manufactures in this state to persons holding a retail beer 16 permit or retail liquor control license. 17 EXPLANATION 18 The inclusion of this explanation does not constitute agreement with 19 the explanation’s substance by the members of the general assembly. 20 This bill authorizes a person holding a class “A” or special 21 class “A” permit that manufactures beer in this state to 22 sell up to a total of 100 barrels per year of the beer it 23 manufactures to retail beer permitees or retail liquor control 24 licensees. 25 -1- LSB 2219YH (2) 88 ec/rn 1/ 1
