H.F. 457 Section 1. Section 124.204, subsection 4, paragraph z, Code 1 2019, is amended to read as follows: 2 z. 3,4-methylenedioxymethamphetamine (MDMA) , except 3 as otherwise provided by rules of the board for medicinal 4 purposes . 5 Sec. 2. Section 124.204, subsection 7, Code 2019, is amended 6 to read as follows: 7 7. Exclusions. This section does not apply to marijuana, : 8 a. Marijuana or tetrahydrocannabinols or chemical 9 derivatives of tetrahydrocannabinol when utilized for medicinal 10 purposes pursuant to rules of the board. 11 b. 3,4-methylenedioxymethamphetamine (MDMA), when utilized 12 for medicinal purposes pursuant to rules of the board. 13 EXPLANATION 14 The inclusion of this explanation does not constitute agreement with 15 the explanation’s substance by the members of the general assembly. 16 This bill relates to the classification of MDMA 17 (3,4-methylenedioxymethamphetamine) as a schedule I controlled 18 substance. The bill allows the board of pharmacy to reclassify 19 MDMA for medicinal purposes. 20 The bill also provides that the classification as a schedule 21 I controlled substance under Code section 124.204 and the 22 penalties specified in Code section 124.401 do not apply to 23 MDMA when utilized for medicinal purposes pursuant to rules of 24 the board of pharmacy. 25 Current law provides that the manufacture, delivery, or 26 possession with the intent to manufacture or deliver MDMA is 27 a class “C” felony pursuant to Code section 124.401(1)(c)(9). 28 A class “C” felony is punishable by confinement for no more 29 than 10 years and a fine of at least $1,000 but not more than 30 $10,000. 31 -1- LSB 2277HH (3) 88 ss/rh 1/ 1
