H.F. 443 DIVISION I 1 COMMON CORE STANDARDS PROHIBITED 2 Section 1. NEW SECTION . 256.25 Common core standards 3 prohibited. 4 1. The state board shall terminate all plans, 5 programs, activities, efforts, and expenditures relating 6 to implementation of the educational initiative commonly 7 referred to as the common core standards, or any derivative 8 or permutation of that educational initiative including but 9 not limited to the Iowa common core standards that have been 10 enacted, adopted, or implemented by the general assembly, the 11 state board, or the department, including but not limited to 12 any assessments, data collection, and instructions based on 13 or involving that educational initiative. To further protect 14 state and local control of public education, the state board 15 and the department are prohibited from adopting, aligning to, 16 or implementing, any other national or multistate consortium 17 standards from any source requiring the use of any assessments 18 aligned with any other national or multistate consortium 19 standards from any source, and, subject to section 256.7, 20 subsection 21, paragraph “b” , subparagraph (1), the state board 21 and the department shall do all of the following: 22 a. Respect and support the ultimate right of a parent to 23 opt the parent’s child out of public school, and out of any 24 public school activity, practice, or testing that the parent 25 finds unacceptable, with no negative repercussions to, or 26 financial impact on, the child, parent, or school, and with 27 no interference from this state. This paragraph shall not be 28 construed to prohibit this state from funding public education 29 on a per-pupil basis as provided in chapter 257. 30 b. (1) By January 1, 2020, for the school year beginning 31 July 1, 2020, and each succeeding school year, adopt and 32 implement state academic content standards for kindergarten 33 through grade twelve in English language arts, mathematics, 34 science, and social studies that are the same as the academic 35 -1- LSB 2069YH (7) 88 kh/jh 1/ 16
H.F. 443 standards in effect for the state of Massachusetts during 1 the academic year beginning July 1, 2008, except that any 2 reference in those standards to the state of Massachusetts 3 shall be changed to Iowa and any state history or government 4 content standards shall be changed to reflect the history 5 and government of Iowa. The department shall distribute the 6 standards to school districts and shall post the standards 7 on the department’s internet site within ten days following 8 adoption of the state academic content standards pursuant to 9 this paragraph “b” . 10 (2) Adopt by January 1, 2020, for the school year 11 beginning July 1, 2020, validated state assessments of student 12 achievement based on the assessment used in Massachusetts 13 during the 2008-2009 school year and aligned to the academic 14 standards in effect in Massachusetts during the 2008-2009 15 school year. 16 c. Take and direct the director and any other state public 17 employee or authority to take all steps necessary to terminate 18 areas of federal control of the Iowa educational process. 19 In so doing, the state board and the department shall be 20 prohibited from doing any of the following: 21 (1) Adopting or implementing any national or multistate 22 consortium standard from any source, or the use of any 23 assessments aligned with a national or multistate consortium 24 standard that cedes control of Iowa educational standards in 25 any manner, including but not limited to English language arts, 26 mathematics, science, social studies, history, or sexuality 27 standards or next generation science standards. 28 (2) Joining any consortium or any other organization if 29 participation in that consortium or organization would cede any 30 measure of control over any aspect of Iowa public education to 31 that consortium or organization. 32 d. (1) Adopt, at the discretion of the state board but 33 not earlier than five years after the adoption of standards as 34 required under paragraph “b” , state academic content standards 35 -2- LSB 2069YH (7) 88 kh/jh 2/ 16
H.F. 443 for kindergarten through grade twelve to replace the English 1 language arts, mathematics, science, and social studies 2 content standards adopted under paragraph “b” . The content 3 standards adopted under this paragraph “d” shall be developed 4 independently and not as part of a multistate consortium. 5 However, the content standards shall emphasize coherence, 6 focus, and essential knowledge, have evidence of successful 7 application and results, and may be administered using computer 8 technology. The department shall not implement content 9 standards adopted by the state board under this paragraph “d” 10 until all of the following conditions are met: 11 (a) The state board submits the content standards to the 12 general assembly. 13 (b) The general assembly’s standing committees on education 14 hold a joint public hearing on the proposed content standards 15 and provide public notice of the public hearing at least ten 16 days prior to the public hearing. 17 (c) The content standards are specifically authorized by a 18 constitutional majority of each house of the general assembly 19 and approved by the governor. 20 (2) Adopt, following the adoption and implementation of 21 state academic content standards for kindergarten through 22 grade twelve in the manner specified in subparagraph (1), 23 assessments aligned with such content standards which shall 24 replace the assessments adopted under paragraph “b” . Each 25 year, as soon as reasonably possible, the aggregated results 26 shall be available on the department’s internet site for review 27 by the public. In collecting student achievement data in 28 order to post the results on the department’s internet site 29 under this subparagraph, the department shall not collect data 30 about the values, attitudes, beliefs, and personality traits 31 of a student or the student’s family or medical, behavioral, 32 mental, biometric, or psychometric data of a student or of the 33 student’s family. The department shall not administer state 34 assessments under this subparagraph until all of the following 35 -3- LSB 2069YH (7) 88 kh/jh 3/ 16
H.F. 443 conditions are met: 1 (a) The department submits the proposed state assessments 2 to the general assembly. 3 (b) The general assembly’s standing committees on education 4 hold a joint public hearing on the proposed state assessments 5 and provide public notice of the public hearing at least ten 6 days prior to the public hearing. 7 (c) The proposed state assessments are specifically 8 authorized by a constitutional majority of each house of the 9 general assembly and approved by the governor. 10 2. The board of directors of each school district, 11 considering the academic content standards adopted and 12 implemented under this section, shall do all of the following: 13 a. Establish a fundamental academic curriculum for students 14 enrolled in the school district in kindergarten through grade 15 twelve that defines academic objectives to be achieved by all 16 students and is based upon the school district’s educational 17 mission, long-range student goals and student performance 18 objectives, and graduation requirements under section 256.7, 19 subsection 26. The fundamental academic curriculum may vary 20 from the state academic content standards adopted pursuant to 21 this section. 22 b. After consulting with the school district’s teachers and 23 administrators, determine the aligned instructional program 24 for delivering the school district’s fundamental academic 25 curriculum and identify the courses and programs in which the 26 fundamental academic curriculum will be taught. 27 c. Provide adequate time and transparency for public review 28 and comment on the aligned instructional programs by all 29 interested members of the community before final adoption of 30 the fundamental academic curriculum. 31 3. This state shall retain sole control over the 32 development, establishment, and revision of course of study 33 standards for kindergarten through grade twelve. 34 4. This section shall not be construed to promote any 35 -4- LSB 2069YH (7) 88 kh/jh 4/ 16
H.F. 443 religious or nonreligious doctrine, promote discrimination 1 for or against a particular set of religious beliefs or 2 nonbeliefs, or promote discrimination for or against religion 3 or nonreligion. 4 5. This section does not require any school district to 5 utilize all or any part of the academic content standards 6 adopted under this section. The state board and the department 7 shall not impose any financial consequence on a school district 8 that adopts academic content standards differing from those 9 adopted and implemented under this section. 10 DIVISION II 11 ELIMINATING COMMON CORE REFERENCES —— PROVIDING FOR RELATED 12 MATTERS 13 Sec. 2. Section 256.7, subsection 21, paragraph b, Code 14 2019, is amended to read as follows: 15 b. A set of core academic indicators in mathematics and 16 reading in grades four, eight, and eleven, a set of core 17 academic indicators in science in grades eight and ten, and 18 another set of core indicators that includes but is not limited 19 to graduation rate, postsecondary education, and successful 20 employment in Iowa. Annually, the department shall report 21 state data for each indicator in the condition of education 22 report. 23 (1) Rules adopted pursuant to this subsection shall specify 24 that the statewide summative assessment of student progress 25 administered by school districts for purposes of the core 26 academic indicators shall be the summative assessment developed 27 by the Iowa testing program within the university of Iowa 28 college of education and administered by the Iowa testing 29 program’s designee. 30 (2) For the school year beginning July 1, 2018, and each 31 succeeding school year, the rules shall also require all of the 32 following: 33 (a) That all students enrolled in school districts in 34 grades three through eleven be administered an assessment in 35 -5- LSB 2069YH (7) 88 kh/jh 5/ 16
H.F. 443 mathematics and English language arts, including reading and 1 writing, during the last quarter of the school year and all 2 students enrolled in school districts in grades five, eight, 3 and ten be administered an assessment in science during the 4 last quarter of the school year. 5 (b) That the assessment, at a minimum, assess the core 6 academic indicators identified in this paragraph “b” ; be 7 aligned with the Iowa common core standards in both content 8 and rigor; accurately describe student achievement and 9 growth for purposes of the school, the school district, and 10 state accountability systems; provide valid, reliable, and 11 fair measures of student progress toward college or career 12 readiness; and meet the summative assessment requirements of 13 the federal Every Student Succeeds Act , Pub. L. No. 114-95 . 14 (c) That the assessment be available for administration in 15 both paper-and-pencil and computer-based formats and include 16 assessments in mathematics, science, and English language arts, 17 including reading and writing. 18 (d) That the assessment be peer-reviewed by an independent, 19 third-party evaluator to determine that the assessment is 20 aligned with the Iowa core academic standards, provides a 21 measurement of student growth and student proficiency, and 22 meets the summative assessment requirements of the federal 23 Every Student Succeeds Act , Pub. L. No. 114-95 . The assessment 24 developed by the Iowa testing program within the university of 25 Iowa college of education shall be adjusted as necessary to 26 meet the requirements of this subparagraph (2) as determined 27 by the peer review. 28 Sec. 3. Section 256.7, subsection 26, paragraph a, 29 unnumbered paragraph 1, Code 2019, is amended to read as 30 follows: 31 Adopt rules that establish a core curriculum and high school 32 graduation requirements for all students in school districts 33 and accredited nonpublic schools that include at a minimum 34 satisfactory completion of four years of English and language 35 -6- LSB 2069YH (7) 88 kh/jh 6/ 16
H.F. 443 arts, three years of mathematics, three years of science, and 1 three years of social studies. 2 Sec. 4. Section 256.7, subsection 26, paragraph a, 3 subparagraph (3), Code 2019, is amended by striking the 4 subparagraph. 5 Sec. 5. Section 256.7, subsection 26, paragraphs b and c, 6 Code 2019, are amended by striking the paragraphs. 7 Sec. 6. Section 256.7, subsection 28, Code 2019, is amended 8 to read as follows: 9 28. Adopt a set of core state academic content standards 10 applicable to all students in kindergarten through grade twelve 11 in every school district and accredited nonpublic school in 12 accordance with section 256.25, subsection 1 . For purposes of 13 this subsection , “core content “assessment standards” includes 14 reading, mathematics, and science. School districts and 15 accredited nonpublic schools shall include, at a minimum, the 16 core state academic content standards adopted pursuant to this 17 subsection in any set of locally developed content standards. 18 School districts and accredited nonpublic schools are strongly 19 encouraged to set higher expectations in local standards. As 20 changes in federal law or regulation occur, the state board is 21 authorized to amend the core content standards as appropriate. 22 Sec. 7. Section 256.7, subsection 32, paragraph b, 23 subparagraph (1), unnumbered paragraph 1, Code 2019, is amended 24 to read as follows: 25 Adopt rules which require that educational instruction and 26 course content delivered primarily over the internet be aligned 27 with the Iowa core state academic standards as applicable. 28 Under such rules, a school district may develop and offer to 29 students enrolled in the district educational instruction and 30 course content for delivery primarily over the internet. A 31 school district providing educational instruction and course 32 content that are delivered primarily over the internet shall 33 annually submit to the department, in the manner prescribed by 34 the department, data that includes but is not limited to the 35 -7- LSB 2069YH (7) 88 kh/jh 7/ 16
H.F. 443 following: 1 Sec. 8. Section 256.9, subsection 49, paragraph a, Code 2 2019, is amended to read as follows: 3 a. Develop and distribute, in collaboration with the area 4 education agencies, core curriculum technical assistance and 5 implementation strategies that school districts and accredited 6 nonpublic schools shall may utilize, including but not limited 7 to the development and delivery of formative and end-of-course 8 model assessments classroom teachers may use to measure student 9 progress on the core curriculum adopted pursuant to section 10 256.7, subsection 26 . The department shall, in collaboration 11 with the advisory group convened in accordance with paragraph 12 “b” and educational assessment providers, identify and make 13 available to school districts end-of-course and additional 14 model end-of-course and additional assessments to align with 15 the expectations included in the Iowa core curriculum. 16 Sec. 9. Section 256.42, subsection 6, Code 2019, is amended 17 to read as follows: 18 6. Coursework offered under the initiative shall be 19 rigorous and high quality, and the department shall annually 20 evaluate the quality of the courses and ensure that coursework 21 is aligned with the state’s core curriculum and core state 22 academic content requirements and standards adopted pursuant to 23 section 256.7, subsection 28, and section 256.25, subsection 24 1 , as well as national standards of quality for online courses 25 issued by an internationally recognized association for 26 kindergarten through grade twelve online learning. 27 Sec. 10. Section 257.11, subsection 9, Code 2019, is amended 28 to read as follows: 29 9. Shared classes and curriculum standards. A school 30 district shall ensure that any course made available to a 31 student through any sharing agreement between the school 32 district and a community college or any other entity providing 33 course programming pursuant to this section to students 34 enrolled in the school district meets the expectations 35 -8- LSB 2069YH (7) 88 kh/jh 8/ 16
H.F. 443 contained in the core curriculum adopted pursuant to section 1 256.7, subsection 26 . The school district shall ensure that 2 any course that has the capacity to generate college credit 3 shall be equivalent to college-level work. 4 Sec. 11. Section 260C.14, subsection 22, paragraph b, Code 5 2019, is amended to read as follows: 6 b. Collaborate with the state board of regents to meet 7 the requirements specified in section 262.9, subsection 33 , 8 including but not limited to developing a systematic process 9 for expanding academic discipline and meetings between the 10 community college faculty and faculty of the institutions 11 of higher education governed by the state board of regents, 12 developing criteria to prioritize core curriculum areas, 13 promoting greater awareness of articulation-related activities, 14 facilitating additional opportunities for individual 15 institutions to pursue program articulation agreements for 16 career and technical educational programs, and developing 17 and implementing a process to examine a minimum of eight 18 new associate of applied science degree programs for which 19 articulation agreements would serve students’ continued 20 academic success in those degree programs. 21 Sec. 12. Section 261E.9, subsection 2, paragraph b, Code 22 2019, is amended to read as follows: 23 b. A regional academy may include in its curriculum virtual 24 or internet-based coursework and courses delivered via the Iowa 25 communications network, career and technical courses, core 26 curriculum coursework, courses required pursuant to section 27 256.7, subsection 26 , or section 256.11, subsections 4 and 5 , 28 and asynchronous learning networks. 29 Sec. 13. Section 262.9, subsection 33, paragraph c, Code 30 2017, is amended by striking the paragraph. 31 Sec. 14. Section 279.61, subsection 1, paragraph a, 32 subparagraph (1), Code 2019, is amended to read as follows: 33 (1) Prepare the student for successful completion of the 34 core curriculum developed high school graduation requirements 35 -9- LSB 2069YH (7) 88 kh/jh 9/ 16
H.F. 443 adopted by the state board of education pursuant to section 1 256.7, subsection 26 , by the time the student graduates from 2 high school. 3 Sec. 15. Section 279.61, subsection 2, Code 2019, is amended 4 to read as follows: 5 2. The board of directors of each school district shall 6 report annually to each student enrolled in grades nine through 7 twelve in the school district, and, if the student is under 8 the age of eighteen, to each student’s parent or guardian, the 9 student’s progress toward meeting the goal of successfully 10 completing the core curriculum and high school graduation 11 requirements adopted by the state board of education pursuant 12 to section 256.7, subsection 26 , and toward achieving the goals 13 of the student’s career and academic plan. 14 Sec. 16. Section 280.3, subsection 2, Code 2019, is amended 15 to read as follows: 16 2. The minimum educational program shall be the curriculum 17 graduation requirements set forth in subsection 3 of this 18 section 256.7, subsection 26, and the educational program set 19 forth in section 256.11 , except as otherwise provided by law. 20 The board of directors of a public school district shall not 21 allow discrimination in any educational program on the basis of 22 race, color, creed, sex, marital status, or place of national 23 origin. 24 Sec. 17. Section 280.3, subsection 3, Code 2019, is amended 25 by striking the subsection. 26 Sec. 18. Section 284.6, subsection 9, Code 2019, is amended 27 to read as follows: 28 9. Moneys received pursuant to section 257.10, subsection 29 10 , or section 257.37A, subsection 2 , shall be maintained 30 as a separate listing within a school district’s or area 31 education agency’s budget for funds received and expenditures 32 made pursuant to this subsection . The department shall not 33 require a school district or area education agency to allocate 34 a specific amount or percentage of moneys received pursuant to 35 -10- LSB 2069YH (7) 88 kh/jh 10/ 16
H.F. 443 section 257.10, subsection 10 , or section 257.37A, subsection 1 2 , for professional development related to implementation of 2 the core curriculum state academic content standards under 3 section 256.7, subsection 26 28 . A school district shall 4 certify to the department how the school district allocated 5 the funds and that moneys received under this subsection 6 were used to supplement, not supplant, the professional 7 development opportunities the school district would otherwise 8 make available. For budget years beginning on or after July 9 1, 2017, all or a portion of the moneys received pursuant 10 to section 257.10, subsection 10 , that remain unexpended and 11 unobligated at the end of a fiscal year may, pursuant to 12 section 257.10, subsection 10 , paragraph “d” , be transferred 13 for deposit in the school district’s flexibility account 14 established under section 298A.2, subsection 2 . 15 DIVISION III 16 STATE MANDATE 17 Sec. 19. STATE MANDATE FUNDING SPECIFIED. In accordance 18 with section 25B.2, subsection 3, the state cost of requiring 19 compliance with any state mandate included in this Act shall 20 be paid by a school district from state school foundation aid 21 received by the school district under section 257.16. This 22 specification of the payment of the state cost shall be deemed 23 to meet all of the state funding-related requirements of 24 section 25B.2, subsection 3, and no additional state funding 25 shall be necessary for the full implementation of this Act 26 by and enforcement of this Act against all affected school 27 districts. 28 DIVISION IV 29 EFFECTIVE DATE 30 Sec. 20. EFFECTIVE DATE. This Act, being deemed of 31 immediate importance, takes effect upon enactment. 32 EXPLANATION 33 The inclusion of this explanation does not constitute agreement with 34 the explanation’s substance by the members of the general assembly. 35 -11- LSB 2069YH (7) 88 kh/jh 11/ 16
H.F. 443 This bill provides for the termination and elimination of 1 all plans, programs, activities, efforts, and expenditures 2 relating to implementation of the educational initiative 3 commonly referred to as the common core standards, or any 4 derivative or permutation of that educational initiative 5 including but not limited to the Iowa common core standards 6 that have been enacted, adopted, or implemented by the general 7 assembly, the state board of education, or the department 8 of education, including but not limited to any assessments, 9 data collection, and instructions based on or involving that 10 educational initiative. 11 DIVISION I —— COMMON CORE STANDARDS PROHIBITED. The bill 12 establishes new Code section 256.25. The new Code section 13 prohibits the state board from adopting, aligning to, or 14 implementing any other national or multistate consortium 15 standards from any source requiring the use of any assessments 16 aligned with any other national or multistate consortium 17 standards from any source and requires the state board and 18 the department to respect and support the ultimate right of a 19 parent to opt the parent’s child out of public school, and out 20 of any public school activity, practice, or testing that the 21 parent finds unacceptable, with no negative repercussions to, 22 or financial impact on, the child, parent, or school, and with 23 no interference from the state. 24 Also, by January 1, 2020, for the school year beginning 25 July 1, 2020, and each succeeding school year, the state board 26 and the department must adopt and implement state academic 27 content standards for kindergarten through grade twelve 28 (K-12) in English language arts, mathematics, science, and 29 social studies that are the same as the academic standards in 30 effect for the state of Massachusetts during the academic year 31 beginning July 1, 2008, except that any reference in those 32 standards to the state of Massachusetts shall be changed to 33 Iowa and any state history or government content standards 34 shall be changed to reflect the history and government of 35 -12- LSB 2069YH (7) 88 kh/jh 12/ 16

The department shall distribute the standards to school 1 districts and shall post the standards on the department’s 2 internet site within 10 days following adoption of the state 3 academic content standards. At the same time, the state 4 board and the department must also adopt validated state 5 assessments of student achievement based on the assessment used 6 in Massachusetts during the 2008-2009 school year and aligned 7 to the academic standards in effect in Massachusetts during the 8 2008-2009 school year. 9 The bill directs the state board, the department, and the 10 director of the department, and any other state public employee 11 or authority to take all steps necessary to terminate areas of 12 federal control of the Iowa educational process; and prohibits 13 these entities from adopting or implementing any national 14 or multistate consortium standard from any source, or the 15 use of any assessments aligned with a national or multistate 16 consortium standard that cedes control of Iowa educational 17 standards in any manner; or from joining any consortium or 18 any other organization if participation in that consortium or 19 organization would cede any measure of control over any aspect 20 of Iowa public education to that consortium or organization. 21 This state shall retain sole control over the development, 22 establishment, and revision of course of study standards for 23 K-12. 24 After not less than five years and at the discretion of 25 the state board, the state board may adopt state academic 26 content standards to replace the standards that were based on 27 Massachusetts’ standards. However, these replacement content 28 standards must be developed independently and not as part of a 29 multistate consortium. Such content standards shall emphasize 30 coherence, focus, and essential knowledge, have evidence of 31 successful application and results, and may be administered 32 using computer technology. The department shall not implement 33 the replacement content standards until the state board submits 34 the content standards to the general assembly, the general 35 -13- LSB 2069YH (7) 88 kh/jh 13/ 16
H.F. 443 assembly’s standing committees on education hold a joint public 1 hearing on the proposed content standards and provide public 2 notice of the public hearing at least 10 days prior to the 3 public hearing; and the content standards are specifically 4 authorized by a constitutional majority of each house of the 5 general assembly and approved by the governor. 6 Each year, as soon as reasonably possible, the aggregated 7 results shall be available on the department internet site 8 for review by the public. In collecting student achievement 9 data for posting on the internet site, the department shall 10 not collect data about the values, attitudes, beliefs, and 11 personality traits of a student or the student’s family or 12 medical, behavioral, mental, biometric, or psychometric data of 13 a student or of the student’s family. 14 Prior to implementing the proposed state assessments, the 15 department must submit them to the general assembly, the 16 standing committees on education must hold a public hearing on 17 the proposed assessments and post notice of the hearing 10 days 18 prior to the hearing, and the general assembly and the governor 19 must specifically authorize the assessments in the same manner 20 as the state academic content standards. 21 School districts must establish a fundamental academic 22 curriculum for students enrolled in the school district in K-12 23 that defines academic objectives to be achieved by all students 24 and is based upon the school district’s educational mission, 25 long-range student goals and student performance objectives, 26 and the state’s graduation requirements. H.F. 443 for public review and comment on the aligned instructional 1 programs by all interested members of the community before 2 final adoption of the fundamental academic curriculum. 3 New Code section 256.25 includes language providing that 4 the new Code section shall not be construed to promote any 5 religious or nonreligious doctrine, promote discrimination 6 for or against a particular set of religious beliefs or 7 nonbeliefs, or promote discrimination for or against religion 8 or nonreligion; and that the new Code section does not require 9 any school district to utilize all or any part of the academic 10 content standards adopted. The state board and the department 11 shall not impose any financial consequence on a school district 12 that adopts academic content standards differing from those 13 adopted and implemented under the new Code section. 14 DIVISION II —— ELIMINATING COMMON CORE REFERENCES 15 —— PROVIDING FOR RELATED MATTERS. The bill eliminates 16 requirements and references to the (Iowa) common core or 17 core curriculum and to core content standards, but continues 18 to direct the state board of education to adopt high school 19 graduation requirements and state academic content standards. 20 Provisions directing school districts to cooperate with each 21 eighth grade student on a core curriculum plan to meet core 22 curriculum requirements are amended to replace “core curriculum 23 plan” with “graduation plan” and “core curriculum requirements” 24 with “high school graduation requirements”. The term “core 25 content standards” is replaced with the term “state academic 26 content standards”. Such standards will remain applicable 27 to all students in kindergarten through grade 12 in every 28 school district and accredited nonpublic school. Corresponding 29 changes are made throughout the Code, and obsolete language is 30 eliminated. 31 DIVISION III —— STATE MANDATE. The bill may include a state 32 mandate as defined in Code section 25B.3. The 1 specification is deemed to constitute state compliance with 2 any state mandate funding-related requirements of Code section 3 25B.2. The inclusion of this specification is intended to 4 reinstate the requirement of political subdivisions to comply 5 with any state mandates included in the bill. 6 DIVISION IV —— EFFECTIVE DATE.
