1.
For
purposes
of
this
section:
3
a.
“Household
hazardous
plant”
means
a
plant
or
plant
4
product,
designated
by
rule
of
the
department
of
natural
5
resources,
which
is
used
for
residential
purposes
and
which
6
may
produce
personal
injury
or
illness
to
humans
or
animals
if
7
ingested
or
consumed.
8
b.
“Label”
means
a
written,
printed,
or
graphic
notice
or
9
statement
on
the
immediate
container
of
a
household
hazardous
10
plant.

2.
A
person
shall
not
distribute,
sell,
or
offer
for
12
retail
sale
in
the
state
a
household
hazardous
plant
unless
13
the
plant
bears
a
label
containing
a
warning
or
caution
14
statement
prominently
displayed
thereon,
in
accordance
with
15
rules
prescribed
by
the
department,
identifying
the
plant
as
a
16
hazardous
household
plant
which
may
produce
injury
or
illness
17
if
ingested
or
consumed.

EXPLANATION
19
The
inclusion
of
this
explanation
does
not
constitute
agreement
with
20
the
explanation’s
substance
by
the
members
of
the
general
assembly.

This
bill
prohibits
a
person
from
distributing,
selling,
or
22
offering
for
retail
sale
in
the
state
a
household
hazardous
23
plant
unless
the
plant
bears
a
label
containing
a
prominent
24
warning
or
caution
statement,
in
accordance
with
rules
25
prescribed
by
the
department
of
natural
resources
identifying
26
the
plant
as
a
hazardous
household
plant
which
may
produce
27
injury
or
illness
if
ingested
or
consumed.
The
bill
defines
28
“household
hazardous
plant”
to
mean
a
plant
or
plant
product,
29
designated
by
the
department,
which
is
used
for
residential
30
purposes
and
which
may
produce
personal
injury
or
illness
to
31
humans
or
animals
if
ingested
or
consumed.

Pursuant
to
Code
section
455F.10,
a
person
who
violates
the
33
bill
is
guilty
of
a
simple
misdemeanor.
A
simple
misdemeanor
34
is
punishable
by
confinement
for
no
more
than
30
days
or
a
fine
