H.F. 328 Section 1. Section 235F.1, subsection 17, Code 2019, is 1 amended to read as follows: 2 17. “Vulnerable elder” means a person sixty years of age or 3 older who is unable to protect himself or herself from elder 4 abuse as a result of age or a mental or physical condition 5 or because of a personal circumstance which results in an 6 increased risk of harm to the person . 7 EXPLANATION 8 The inclusion of this explanation does not constitute agreement with 9 the explanation’s substance by the members of the general assembly. 10 Currently, under Code section 235F.1(17), “vulnerable elder” 11 is defined as a person 60 years of age or older who is unable to 12 protect himself or herself from elder abuse either as a result 13 of the person’s age or as a result of the person’s mental 14 or physical condition. This bill amends this definition to 15 provide that a “vulnerable elder” is a person 60 years of age 16 or older who is unable to protect himself or herself from elder 17 abuse as a result of the person’s mental or physical condition 18 or because of a personal circumstance which results in an 19 increased risk of harm to the person. 20 -1- LSB 1463HV (2) 88 mo/rh 1/ 1
