Section
1.
SHORT
TITLE.
This
Act
shall
be
known
as
1
“Adalynn’s
law”.
2
Sec.
2.
NEW
SECTION
.
216C.13
Adult
changing
stations.
3
1.
For
purposes
of
this
section,
“adult
changing
station”
4
means
a
universally-accessible,
height-adjustable
adult
5
changing
table
placed
within
an
enclosed
restroom
facility
6
or
other
similar
facility
that
is
for
use
by
persons
with
7
disabilities
who
need
assistance
with
diapering.
8
2.
An
adult
changing
station
shall
be
installed
and
9
maintained
at
all
of
the
following
locations:
10
a.
Any
building
or
facility
to
which
the
public
is
invited
11
or
in
which
the
public
is
permitted,
on
which
construction
will
12
commence
on
or
after
January
1,
2022.
13
b.
Any
building
or
facility
to
which
the
public
is
invited
14
or
in
which
the
public
is
permitted,
on
which
construction
15
of
renovations
to
the
building
or
facility
will
commence
on
16
or
after
January
1,
2025,
and
where
such
renovations
will
17
require
a
permit,
certificate,
authorization,
or
other
required
18
document
or
where
the
renovations
will
cost
ten
thousand
19
dollars
or
more.

c.
Any
building
or
facility
to
which
the
public
is
invited
21
or
in
which
the
public
is
permitted,
with
the
capacity
to
serve
22
one
thousand
five
hundred
or
more
persons
in
any
one
day,
23
including
but
not
limited
to
state
buildings
and
facilities.

d.
Shopping
malls
and
retail
stores
with
a
floor
space
of
25
forty
thousand
square
feet
or
more.
26
e.
Entertainment
venues
with
a
floor
space
of
forty
thousand
27
square
feet
or
more,
including
but
not
limited
to
theaters,
28
concert
halls,
auditoriums,
and
other
facilities
primarily
used
29
for
exhibiting
motion
pictures,
stage
performances,
lectures,
30
musical
recitals,
and
other
similar
performances,
bingo

facilities,
gambling
structures,
and
indoor
arenas
including

sports
arenas.

Public
transportation
facilities
under
the
authority

of
the
state
or
its
political
subdivisions,
including
bus

A
facility

defined

Each
location
required
to
install
and
maintain
an
adult
12
changing
station,
as
provided
for
in
subsection
2,
shall
13
ensure
that
the
entrance
to
each
adult
changing
station
has
14
conspicuous
signage
indicating
the
location
of
the
adult
15
changing
station.
16
4.
A
person
who
violates
this
section
shall
be
assessed
a
17
civil
penalty
by
the
department
of
human
rights
which
is
not
18
to
exceed
two
hundred
fifty
dollars.
Moneys
collected
under
19
this
subsection
shall
be
remitted
to
the
treasurer
of
state
for
20
deposit
in
the
general
fund
of
the
state.

Sec.
3.
IMPLEMENTATION
OF
ACT.
Section
25B.2,
subsection
22
3,
shall
not
apply
to
this
Act.

Sec.
4.
EFFECTIVE
DATE.
This
Act
takes
effect
January
1,
24
2021.

EXPLANATION

The
inclusion
of
this
explanation
does
not
constitute
agreement
with
27
the
explanation’s
substance
by
the
members
of
the
general
assembly.

This
bill
requires
the
installation
and
maintenance
of
29
adult
changing
stations
at
certain
locations.
The
bill
30
defines
the
term
“adult
changing
station”.
An
adult
changing
31
station
is
required
to
be
installed
and
maintained
in
certain
32
buildings
and
facilities
with
future
construction
dates;
33
certain
buildings
or
facilities
undergoing
future
renovations;
34
buildings
or
facilities
with
the
capacity
to
serve
1,500
or
35

more
persons
in
any
one
day;
shopping
malls,
retail
stores,
1
and
certain
entertainment
venues
with
a
floor
space
of
40,000
2
square
feet
or
more;
certain
public
transportation
facilities;

galleries,
libraries,
museums,
and
tourist
information
centers;
4
parks,
playgrounds,
recreational
centers,
zoos,
and
amusement
5
or
theme
parks;
certain
airports;
rest
areas;
education
6
facilities;
hospitals;
and
rehabilitation
facilities.
Each
7
location
required
to
install
an
adult
changing
station
is
8
required
to
install
conspicuous
signage
at
the
entrance
of
each
9
adult
changing
station
indicating
its
location.
10
A
violation
of
the
bill
is
punishable
by
a
civil
penalty
11
not
to
exceed
$250
to
be
assessed
by
the
department
of
human
12
rights.
Moneys
collected
are
to
be
remitted
to
the
treasurer
13
of
state
for
deposit
in
the
general
fund.

The
bill
may
include
a
state
mandate
as
defined
in
Code
15
section
25B.3.
The
bill
makes
inapplicable
Code
section
25B.2,
16
subsection
3,
which
would
relieve
a
political
subdivision
from
17
complying
with
a
state
mandate
if
funding
for
the
cost
of
18
the
state
mandate
is
not
provided
or
specified.
Therefore,
19
political
subdivisions
are
required
to
comply
with
any
state
20
mandate
included
in
the
bill.
21
The
bill
takes
effect
January
1,
2021.

The
bill
shall
be
known
as
Adalynn’s
law.
