H.F. 2548 Section 1. Section 321.194, subsection 2, paragraph a, Code 1 2020, is amended by adding the following new subparagraph: 2 NEW SUBPARAGRAPH . (03) If the licensee resides on a farm 3 or is employed for compensation on a farm in this state, 4 the licensee may operate a motor vehicle during the hours 5 of 5:00 a.m. to 10:00 p.m. for the purpose of assisting the 6 person’s parents, guardians, or employers with farm work or in 7 connection with any farm job, employment, or other farm-related 8 work, including traveling to or from the location of the farm 9 work, provided the driving distance between the point of origin 10 and the destination is no more than fifty miles. 11 Sec. 2. Section 321.194, subsection 2, paragraph a, 12 subparagraph (3), Code 2020, is amended to read as follows: 13 (3) To a service station for the purpose of refueling, so 14 long as the service station is the station closest to the route 15 on which the licensee is traveling under subparagraph (1) , or 16 (2) , or (03) . 17 Sec. 3. Section 321.194, subsection 3, paragraph b, Code 18 2020, is amended to read as follows: 19 b. Upon receipt of a statement of necessity, the department 20 shall issue the driver’s license provided the applicant is 21 otherwise eligible for issuance of the license. The fact that 22 the applicant resides at a distance less than one mile from the 23 applicant’s school of enrollment is prima facie evidence of 24 the nonexistence of necessity for the issuance of a license. 25 However, the distance between the applicant’s residence and 26 school of enrollment shall not be considered if the applicant 27 resides on a farm or is employed for compensation on a farm. 28 EXPLANATION 29 The inclusion of this explanation does not constitute agreement with 30 the explanation’s substance by the members of the general assembly. 31 Under current law, a person holding a special minor’s 32 driver’s license is allowed to operate a motor vehicle during 33 the hours of 5:00 a.m. to 10:00 p.m. between the licensee’s 34 residence, schools of enrollment, bus stops, and sites, 35 -1- LSB 5820HV (2) 88 mo/ns 1/ 2
H.F. 2548 facilities, or schools designated by the licensee’s district 1 or school of enrollment for the accommodation of the school’s 2 extracurricular activities, with certain limitations. This 3 bill allows a person holding a special minor’s driver’s license 4 who resides on a farm or is employed for compensation on a 5 farm in this state to operate a motor vehicle during the hours 6 of 5:00 a.m. to 10:00 p.m. for the purpose of assisting the 7 person’s parents, guardians, or employers with farm work or in 8 connection with any farm job, employment, or other farm-related 9 work, including traveling to or from the location of the farm 10 work, provided the driving distance between the point of origin 11 and the destination is no more than 50 miles. The bill also 12 allows a licensee to operate a motor vehicle to a service 13 station along the associated routes. 14 Under current law, an application for a special minor’s 15 driver’s license must be accompanied by a statement from 16 the applicant’s school of enrollment certifying that a need 17 exists for the license. The fact that an applicant resides 18 at a distance less than one mile from the applicant’s school 19 of enrollment is prima facie evidence of the nonexistence of 20 necessity for the issuance of the license. However, the bill 21 provides that the distance between the applicant’s residence 22 and school of enrollment shall not be considered regarding the 23 existence of a necessity if the applicant resides on a farm or 24 is employed for compensation on a farm. 25 A violation of Code section 321.194 is punishable by a 26 scheduled fine of $50. 27 -2- LSB 5820HV (2) 88 mo/ns 2/ 2
