H.F. 2456 Section 1. Section 89A.2, subsection 1, Code 2020, is 1 amended by adding the following new paragraph: 2 NEW PARAGRAPH . f. A conveyance installed in a building in a 3 federally designated national historic district as long as each 4 of the following conditions is met: 5 (1) The owner of the building owns a commercial enterprise 6 that occupies the first story of the building. 7 (2) The building has no more than two stories above the 8 first story of the building. 9 (3) The owner of the building lives in the upper stories of 10 the building. 11 (4) The building has sufficient physical barriers or safety 12 protocols to ensure that only the owner, the owner’s guests, or 13 a government official acting in an official capacity can access 14 the elevator. 15 EXPLANATION 16 The inclusion of this explanation does not constitute agreement with 17 the explanation’s substance by the members of the general assembly. 18 This bill establishes an exception to Code chapter 89A, the 19 “Iowa State Elevator Code”, for a conveyance installed in a 20 building in a federally designated national historic district 21 as long as certain conditions are met. The conditions are that 22 the owner of the building owns a commercial enterprise that 23 occupies the first story of the building, the building has no 24 more than two stories above the first story of the building, 25 the owner of the building lives in the upper stories of the 26 building, and the building has sufficient physical barriers or 27 safety protocols to ensure that only the owner, the owner’s 28 guests, or a government official acting in an official capacity 29 can access the elevator. 30 Code chapter 89A defines “conveyance” as an elevator, 31 dumbwaiter, escalator, moving walk, lift, or inclined or 32 vertical wheelchair lift subject to regulation under Code 33 chapter 89A, including hoistways, rails, guides, and all other 34 related mechanical and electrical equipment. 35 -1- LSB 5041HV (2) 88 je/rn 1/ 1
