Section
1.
Section
256.9,
subsection
17,
Code
2020,
is

amended
to
read
as
follows:

17.
Hear
and
decide
appeals
arising
from
the
school
laws
not

otherwise
specifically
granted
to
the
state
board.
If
a
school
4
district,
accredited
nonpublic
school,
or
area
education
agency
5
requests
that
the
director
review
information
contained
in
a
6
basic
education
data
survey
submission
and
the
director
finds
7
that
an
error
in
the
basic
education
data
survey
submission
8
resulted
in
an
incorrect
determination
by
the
board
of
9
educational
examiners
or
the
executive
director
of
the
board
of
10
educational
examiners
relating
to
licensure
of
a
practitioner,
11
the
director
shall
notify
the
executive
director
of
the
board
12
of
educational
examiners
of
the
director’s
findings.

Sec.
2.
Section
272.2,
subsection
14,
paragraph
d,
Code
14
2020,
is
amended
to
read
as
follows:

d.
An
applicant
for
a
license
or
certificate
under
this
16
chapter
shall
demonstrate
that
the
requirements
of
the
license
17
or
certificate
have
been
met
and
the
burden
of
proof
shall
18
be
on
the
applicant.
However,
if
the
executive
director
of
19
the
board
receives
notice
from
the
director
of
the
department
20
of
education
under
section
256.9,
subsection
17,
that
an
21
error
in
the
basic
education
data
survey
submission
resulted
22
in
an
incorrect
determination
relating
to
licensure
of
a
23
practitioner,
the
executive
director
shall
initiate
corrective
24
action
with
the
board
and
the
findings
of
the
director
of
the
25
department
of
education
shall
be
sufficient
evidence
to
correct
26
such
error.

EXPLANATION
28
The
inclusion
of
this
explanation
does
not
constitute
agreement
with
29
the
explanation’s
substance
by
the
members
of
the
general
assembly.

This
Act
provides
that
if
a
school
district,
accredited
31
nonpublic
school,
or
area
education
agency
requests
the
32
director
of
the
department
of
education
to
review
information
33
contained
in
a
basic
education
data
survey
submission
and
the
34
director
of
the
department
of
education
finds
that
an
error
35

receiving
such
a
notice,
the
executive
director
shall

to
correct
such
error.
