H.F. 2404 Section 1. Section 481A.122, Code 2020, is amended by 1 striking the section and inserting in lieu thereof the 2 following: 3 481A.122 Hunters’ orange apparel. 4 1. A person shall not hunt deer with firearms unless the 5 person is at the time wearing one or more of the following 6 articles of visible, external apparel, the color and material 7 of which shall be solid blaze orange: 8 a. A vest. 9 b. A coat. 10 c. A jacket. 11 d. A sweatshirt. 12 e. A sweater. 13 f. A shirt. 14 g. Coveralls. 15 2. A person shall not hunt upland game birds, as defined by 16 the department, unless the person is at the time wearing one or 17 more of the following articles of visible, external apparel, 18 the color and material of which shall be at least fifty percent 19 solid blaze orange: 20 a. A hat. 21 b. A cap. 22 c. A vest. 23 d. A coat. 24 e. A jacket. 25 f. A sweatshirt. 26 g. A sweater. 27 h. A shirt. 28 i. Coveralls. 29 3. A person shall not pass through public land or water 30 while approaching or leaving a tree stand on public land during 31 a muzzleloading season established by the commission unless 32 the person is at the time wearing one or more of the following 33 articles of visible, external apparel, the color and material 34 of which shall be solid blaze orange: 35 -1- LSB 5841HV (1) 88 js/rn 1/ 2

This section is not applicable to a person who is legally 10 hunting with a raptor. 11 EXPLANATION 12 The inclusion of this explanation does not constitute agreement with 13 the explanation’s substance by the members of the general assembly. 14 This bill relates to apparel requirements for persons 15 hunting on public land or water. The bill prohibits a person 16 from passing through public land or water while approaching 17 or leaving a tree stand on public land during a muzzleloading 18 season established by the commission unless the person is 19 wearing one or more specified articles of visible, external 20 apparel, the color and material of which shall be solid blaze 21 orange. Under current law, only persons hunting deer with 22 firearms or persons hunting upland game birds are subject to 23 blaze orange apparel requirements. 24 The bill also modifies the structure of Code section 25 481A.122 in order to make grammatical and stylistic changes. 26 A person who violates the provisions of the bill is guilty of 27 a simple misdemeanor and subject to a scheduled fine of $50. 28 -2- LSB 5841HV (1) 88 js/rn 2/ 2
