H.F. 2396 Section 1. Section 34.2, subsection 4, Code 2020, is amended 1 to read as follows: 2 4. A 911 system shall be capable of transmitting requests 3 for law enforcement, fire fighting, and emergency medical 4 and ambulance services to a public safety agency or agencies 5 that provide the requested service at the place where the call 6 originates. A 911 system may also provide for transmitting 7 requests for emergency management, poison control, suicide 8 prevention, and other emergency services. The public safety 9 answering point shall be capable of receiving calls from deaf 10 and hard-of-hearing persons through a telecommunications device 11 for the deaf and hard of hearing . Conferencing capability 12 with counseling, aid to persons with disabilities, and other 13 services as deemed necessary for identifying appropriate 14 emergency response services may be provided by the 911 service. 15 A public safety answering point may transmit emergency 16 response requests to private safety entities. 17 Sec. 2. Section 34A.9, Code 2020, is amended to read as 18 follows: 19 34A.9 Telecommunications devices for the speech impaired and 20 hearing-impaired hard of hearing . 21 Each public safety answering point shall provide for the 22 installation and use of telecommunications devices for the 23 speech impaired and hearing-impaired hard of hearing . 24 Sec. 3. Section 48A.19, subsection 1, paragraph b, 25 subparagraph (1), subparagraph division (c), Code 2020, is 26 amended to read as follows: 27 (c) Office of deaf and hard-of-hearing services of the 28 department of human rights or its successor agency. 29 Sec. 4. Section 70A.14, subsection 3, paragraph c, Code 30 2020, is amended to read as follows: 31 c. In the case of employees at the Iowa school for the 32 deaf and hard of hearing and the Iowa braille and sight saving 33 school, twenty-five or more participants. 34 Sec. 5. Section 70A.17A, subsection 1, paragraph d, 35 -1- LSB 5911YH (2) 88 pf/rh 1/ 17
H.F. 2396 subparagraph (3), Code 2020, is amended to read as follows: 1 (3) Twenty-five or more state officers or employees 2 employed at the Iowa school for the deaf and hard of hearing or 3 at the Iowa braille and sight saving school. 4 Sec. 6. Section 135L.2, subsection 1, paragraph a, 5 subparagraph (1), Code 2020, is amended to read as follows: 6 (1) A video, to be developed by a person selected through a 7 request for proposals process or other contractual agreement, 8 which provides information regarding the various options 9 available to a pregnant minor with regard to the pregnancy, 10 including a decision to continue the pregnancy to term and 11 retain parental rights following the child’s birth, a decision 12 to continue the pregnancy to term and place the child for 13 adoption following the child’s birth, and a decision to 14 terminate the pregnancy through abortion. The video shall 15 provide the information in a manner and language, including 16 but not limited to the use of closed captioning for the 17 hearing-impaired hard of hearing , which could be understood by 18 a minor. 19 Sec. 7. Section 147.14, subsection 1, paragraph u, Code 20 2020, is amended to read as follows: 21 u. For sign language interpreting and transliterating, four 22 members licensed to practice interpreting and transliterating, 23 three of whom shall be practicing interpreters and 24 transliterators at the time of appointment to the board and 25 at least one of whom is employed in an educational setting; 26 and three members who are consumers of interpreting or 27 transliterating services as defined in section 154E.1 , each of 28 whom shall be deaf or hard of hearing . 29 Sec. 8. Section 216A.1, subsection 1, paragraph a, 30 subparagraph (4), Code 2020, is amended to read as follows: 31 (4) Office of deaf and hard-of-hearing services. 32 Sec. 9. Section 216A.3, subsection 2, paragraph a, Code 33 2020, is amended to read as follows: 34 a. The voting members shall consist of nine voting members 35 -2- LSB 5911YH (2) 88 pf/rh 2/ 17
H.F. 2396 selected by each of the permanent commissions within the 1 department, and two voting members, appointed by the governor. 2 For purposes of this paragraph “a” , “permanent commissions” 3 means the commission of Latino affairs, commission on the 4 status of women, commission of persons with disabilities, 5 commission on community action agencies, commission of deaf and 6 hard-of-hearing services, justice advisory board, commission 7 on the status of African Americans, commission of Asian and 8 Pacific Islander affairs, and commission of Native American 9 affairs. The term of office for voting members is four years. 10 Sec. 10. Section 216A.111, Code 2020, is amended to read as 11 follows: 12 216A.111 Definitions. 13 For purposes of this subchapter , unless the context 14 otherwise requires: 15 1. “Commission” means the commission of deaf and 16 hard-of-hearing services. 17 2. “Office” means the office of deaf and hard-of-hearing 18 services of the department of human rights. 19 Sec. 11. Section 216A.112, Code 2020, is amended to read as 20 follows: 21 216A.112 Office of deaf and hard-of-hearing services. 22 The office of deaf and hard-of-hearing services is 23 established, and shall do all of the following: 24 1. Serve as the central permanent agency to advocate for 25 persons who are deaf or hard of hearing. 26 2. Coordinate and cooperate with the efforts of state 27 departments and agencies to serve the needs of persons who are 28 deaf or hard of hearing in participating fully in the economic, 29 social, and cultural life of the state, and provide direct 30 assistance to individuals who request it. 31 3. Develop, coordinate, and assist other public or private 32 organizations which serve persons who are deaf or hard of 33 hearing. 34 4. Serve as an information clearinghouse on programs and 35 -3- LSB 5911YH (2) 88 pf/rh 3/ 17
H.F. 2396 agencies operating to assist persons who are deaf or hard of 1 hearing. 2 Sec. 12. Section 216A.113, Code 2020, is amended to read as 3 follows: 4 216A.113 Deaf and hard-of-hearing services commission 5 established. 6 1. The commission of deaf and hard-of-hearing services 7 is established, and shall consist of seven voting members 8 appointed by the governor, subject to confirmation by the 9 senate pursuant to section 2.32 . Membership of the commission 10 shall include at least four members who are deaf and who cannot 11 hear human speech with or without use of amplification and at 12 least one member who is hard of hearing. All members shall 13 reside in Iowa. 14 2. Members of the commission shall serve four-year 15 staggered terms which shall begin and end pursuant to section 16 69.19 . Members whose terms expire may be reappointed. 17 Vacancies on the commission may be filled for the remainder 18 of the term in the same manner as the original appointment. 19 Members shall receive actual expenses incurred while serving in 20 their official capacity, subject to statutory limits. Members 21 may also be eligible to receive compensation as provided in 22 section 7E.6 . 23 3. Members of the commission shall appoint a chairperson 24 and vice chairperson and other officers as the commission 25 deems necessary. The commission shall meet at least quarterly 26 during each fiscal year. A majority of the members currently 27 appointed to the commission shall constitute a quorum. A 28 quorum shall be required for the conduct of business of the 29 commission, and the affirmative vote of a majority of the 30 currently appointed members is necessary for any substantive 31 action taken by the commission. A member shall not vote on any 32 action if the member has a conflict of interest on the matter, 33 and a statement by the member of a conflict of interest shall 34 be conclusive for this purpose. 35 -4- LSB 5911YH (2) 88 pf/rh 4/ 17

Section 235A.15, subsection 2, paragraph c, 1 subparagraph (5), Code 2020, is amended to read as follows: 2 (5) To the superintendent of the school for the deaf and 3 hard of hearing if the data concerns a person employed or being 4 considered for employment or living in the school. 5 Sec. 14. Section 256B.3, subsection 9, Code 2020, is amended 6 to read as follows: 7 9. To cooperate with existing agencies such as the 8 department of human services, the Iowa department of public 9 health, the state school for the deaf and hard of hearing , the 10 Iowa braille and sight saving school, the children’s hospitals, 11 or other agencies concerned with the welfare and health of 12 children requiring special education in the coordination of 13 their educational activities for such children. 14 Sec. 15. Section 261E.2, subsection 10, Code 2020, is 15 amended to read as follows: 16 10. “Student” means any individual enrolled in grades nine 17 through twelve in a school district who meets the criteria in 18 section 261E.3, subsection 1 . “Student” includes an individual 19 attending an accredited nonpublic school or the Iowa school 20 for the deaf and hard of hearing or the Iowa braille and sight 21 saving school for purposes of sections 261E.4 and 261E.6 . 22 Sec. 16. Section 261E.6, subsections 3, 4, and 6, Code 2020, 23 are amended to read as follows: 24 3. Authorization. To participate in this program, an 25 eligible student shall make application to an eligible 26 postsecondary institution to allow the eligible student to 27 enroll for college credit in a nonsectarian course offered at 28 the institution. A comparable course, as defined in rules 29 adopted by the board of directors of the school district 30 consistent with department administrative rule, must not be 31 offered by the school district or accredited nonpublic school 32 the student attends. A course is ineligible for purposes 33 of this section if the school district has a contractual 34 agreement with the eligible postsecondary institution under 35 -5- LSB 5911YH (2) 88 pf/rh 5/ 17
H.F. 2396 section 261E.8 that meets the requirements of section 257.11, 1 subsection 3 , and the course may be delivered through such an 2 agreement in accordance with section 257.11, subsection 3 . 3 If the postsecondary institution accepts an eligible student 4 for enrollment under this section , the institution shall send 5 written notice to the student, the student’s parent or legal 6 guardian in the case of a minor child, and the student’s school 7 district or accredited nonpublic school and the school district 8 in the case of a nonpublic school student, or the Iowa school 9 for the deaf and hard of hearing, or the Iowa braille and 10 sight saving school. The notice shall list the course, the 11 clock hours the student will be attending the course, and the 12 number of hours of college credit that the eligible student 13 will receive from the eligible postsecondary institution upon 14 successful completion of the course. 15 4. Credits. 16 a. A school district, the Iowa school for the deaf and 17 hard of hearing , the Iowa braille and sight saving school, or 18 accredited nonpublic school shall grant high school credit to 19 an eligible student enrolled in a course under this chapter 20 if the eligible student successfully completes the course as 21 determined by the eligible postsecondary institution. The 22 board of directors of the school district, the board of regents 23 for the Iowa school for the deaf and hard of hearing and the 24 Iowa braille and sight saving school, or authorities in charge 25 of an accredited nonpublic school shall determine the number 26 of high school credits that shall be granted to an eligible 27 student who successfully completes a course. Eligible students 28 may take up to seven semester hours of credit during the summer 29 months when school is not in session and receive credit for 30 that attendance, if the student pays the cost of attendance for 31 those summer credit hours. 32 b. The high school credits granted to an eligible 33 student under this section shall count toward the graduation 34 requirements and subject area requirements of the school 35 -6- LSB 5911YH (2) 88 pf/rh 6/ 17
H.F. 2396 district of residence, the Iowa school for the deaf and hard 1 of hearing , the Iowa braille and sight saving school, or 2 accredited nonpublic school of the eligible student. Evidence 3 of successful completion of each course and high school credits 4 and college credits received shall be included in the student’s 5 high school transcript. 6 6. Definition. For purposes of this section and section 7 261E.7 , unless the context otherwise requires, “eligible 8 student” means a student classified by the board of directors 9 of a school district, by the state board of regents for pupils 10 of the Iowa school for the deaf and hard of hearing and the 11 Iowa braille and sight saving school, or by the authorities 12 in charge of an accredited nonpublic school as a ninth or 13 tenth grade student who is identified according to the school 14 district’s gifted and talented criteria and procedures, 15 pursuant to section 257.43 , as a gifted and talented child, 16 or an eleventh or twelfth grade student, during the period 17 the student is participating in the postsecondary enrollment 18 options program. 19 Sec. 17. Section 261E.7, subsection 1, unnumbered paragraph 20 1, Code 2020, is amended to read as follows: 21 Not later than June 30 of each year, a school district 22 shall pay a tuition reimbursement amount to a postsecondary 23 institution that has enrolled its resident eligible 24 students under this chapter , unless the eligible student is 25 participating in open enrollment under section 282.18 , in which 26 case, the tuition reimbursement amount shall be paid by the 27 receiving district. However, if a child’s residency changes 28 during a school year, the tuition shall be paid by the district 29 in which the child was enrolled as of the date specified in 30 section 257.6, subsection 1 , or the district in which the child 31 was counted under section 257.6, subsection 1 , paragraph “a” , 32 subparagraph (6). For students enrolled at the Iowa school for 33 the deaf and hard of hearing and the Iowa braille and sight 34 saving school, the state board of regents shall pay a tuition 35 -7- LSB 5911YH (2) 88 pf/rh 7/ 17
H.F. 2396 reimbursement amount by June 30 of each year. The amount of 1 tuition reimbursement for each separate course shall equal the 2 lesser of: 3 Sec. 18. Section 262.7, subsection 5, Code 2020, is amended 4 to read as follows: 5 5. The state school for the deaf and hard of hearing . 6 Sec. 19. Section 262.9, subsections 2 and 21, Code 2020, are 7 amended to read as follows: 8 2. Elect a president of each of the institutions of higher 9 learning; a superintendent of each of the other institutions; 10 a treasurer and a secretarial officer for each institution 11 annually; professors, instructors, officers, and employees; 12 and fix their compensation. Sections 279.12 through 279.19 13 and section 279.27 apply to employees of the Iowa braille and 14 sight saving school and the state school for the deaf and hard 15 of hearing , who are licensed pursuant to chapter 272 . In 16 following those sections in chapter 279 , the references to 17 boards of directors of school districts shall be interpreted to 18 apply to the board of regents. 19 21. Establish a hall of fame for distinguished graduates at 20 the Iowa braille and sight saving school and at the Iowa school 21 for the deaf and hard of hearing . 22 Sec. 20. Section 262.43, Code 2020, is amended to read as 23 follows: 24 262.43 Students residing on state-owned land. 25 The state board of regents shall pay to the local school 26 boards the tuition payments and transportation costs, as 27 otherwise authorized by statutes for the elementary or high 28 school education of students residing on land owned by the 29 state and under the control of the state board of regents. 30 Such payments for the three institutions of higher learning, 31 the state university of Iowa, the Iowa state university of 32 science and technology, and the university of northern Iowa, 33 shall be made from the funds of the respective institutions 34 other than state appropriations, and for the two noncollegiate 35 -8- LSB 5911YH (2) 88 pf/rh 8/ 17
H.F. 2396 institutions, the Iowa braille and sight saving school and the 1 state school for the deaf and hard of hearing , the payments and 2 costs shall be paid from moneys appropriated to the state board 3 of regents. 4 Sec. 21. Section 263.11, subsection 2, Code 2020, is amended 5 to read as follows: 6 2. Persons who are not eligible for admission to the schools 7 already established for persons with an intellectual disability 8 or epilepsy or persons who are deaf or hard of hearing or 9 blind. 10 Sec. 22. Section 263.21, Code 2020, is amended to read as 11 follows: 12 263.21 Transfer of patients from state institutions. 13 The director of the department of human services, in respect 14 to institutions under the director’s control, the administrator 15 of any of the divisions of the department, in respect to the 16 institutions under the administrator’s control, the director of 17 the department of corrections, in respect to the institutions 18 under the department’s control, and the state board of regents, 19 in respect to the Iowa braille and sight saving school and the 20 Iowa school for the deaf and hard of hearing , may send any 21 inmate, student, or patient of an institution, or any person 22 committed or applying for admission to an institution, to the 23 university of Iowa hospitals and clinics for treatment and 24 care. The department of human services, the department of 25 corrections, and the state board of regents shall respectively 26 pay the traveling expenses of such patient, and when necessary 27 the traveling expenses of an attendant for the patient, out of 28 funds appropriated for the use of the institution from which 29 the patient is sent. 30 Sec. 23. Section 270.1, Code 2020, is amended to read as 31 follows: 32 270.1 Superintendent. 33 The superintendent of the school for the deaf and hard of 34 hearing shall be a trained and experienced educator of the deaf 35 -9- LSB 5911YH (2) 88 pf/rh 9/ 17
H.F. 2396 and hard of hearing . The superintendent’s salary may include 1 residence in the institution, but no such allowance shall be 2 made except by express contract in advance. 3 Sec. 24. Section 270.3, Code 2020, is amended to read as 4 follows: 5 270.3 Admission. 6 Any resident of the state less than twenty-one years of 7 age, who has a hearing loss which is too severe to acquire 8 an education in the public schools is eligible to attend 9 the school for the deaf and hard of hearing . Nonresidents 10 similarly situated may be admitted to an education therein upon 11 such terms as may be fixed by the state board of regents. The 12 fee for nonresidents shall be not less than the average expense 13 of resident pupils and shall be paid in advance. 14 Sec. 25. Section 270.9, Code 2020, is amended to read as 15 follows: 16 270.9 School for deaf and hard of hearing and sight saving 17 school. 18 Funds appropriated to the school for the deaf and hard 19 of hearing and the Iowa braille and sight saving school for 20 payments to the parents or guardians of pupils in either 21 institution shall be expended as follows: 22 1. Transportation reimbursement at a rate established 23 annually by the state board of regents to the parents or 24 guardians of children who do not reside in the institution, but 25 are transported to the institution on a daily basis. 26 2. Transportation reimbursement at a rate established 27 annually by the state board of regents to the parents or 28 guardians for transportation from the institution to the 29 residence of the parent or guardian and return to the 30 institution for children who reside in the institution. 31 Sec. 26. Section 270.10, subsection 1, Code 2020, is amended 32 to read as follows: 33 1. The state board of regents shall not merge the school for 34 the deaf and hard of hearing at Council Bluffs with the Iowa 35 -10- LSB 5911YH (2) 88 pf/rh 10/ 17
H.F. 2396 braille and sight saving school at Vinton or close either of 1 those institutions until all of the following requirements have 2 been met: 3 a. The department of management has presented to the general 4 assembly a comprehensive plan, program, and fiscal analysis of 5 the existing circumstances and the circumstances which would 6 prevail upon the proposed merger or closing, together with 7 data which would support the contention that the merger or 8 closing will be more efficient and effective than continuation 9 of the existing facilities. The analysis shall include a 10 detailed study of the educational implications of the merger 11 or closing, the impact on the students, and the opinions and 12 research of nationally recognized experts in the field of the 13 education of visually impaired and deaf or hard of hearing 14 students. The comprehensive plan shall further include a 15 study relating to the programming, fiscal consequences, and 16 political implications which would result if either a merger or 17 an agreement under chapter 28E should be implemented between 18 the school for the deaf and hard of hearing in Council Bluffs 19 and comparable state programs in the state of Nebraska. 20 b. The general assembly has studied the plans, programs, and 21 fiscal analysis and has reviewed their impact on the programs. 22 c. The general assembly has enacted legislation authorizing 23 either the closing or the merger to take effect not sooner than 24 two years after the enactment of the legislation. 25 Sec. 27. Section 280.16, subsection 7, Code 2020, is amended 26 to read as follows: 27 7. The Iowa braille and sight saving school, the state 28 school for the deaf and hard of hearing , and the institutions 29 under the control of the department of human services as 30 provided in section 218.1 are exempt from the provisions of 31 this section . 32 Sec. 28. Section 299.18, Code 2020, is amended to read as 33 follows: 34 299.18 Education of certain children who are deaf or hard of 35 -11- LSB 5911YH (2) 88 pf/rh 11/ 17
H.F. 2396 hearing , blind, or have severe disabilities. 1 Children who are of compulsory attendance age and who are 2 so deaf or hard of hearing, or blind , or have such severe 3 disabilities so as to be unable to obtain an education in the 4 public or accredited nonpublic schools shall be sent to the 5 appropriate state-operated school, or shall receive appropriate 6 special education under chapter 256B , unless exempted, and 7 any person having such a child under the person’s control or 8 custody shall see that the child attends the state-operated 9 school or special education program during the scholastic year. 10 Sec. 29. Section 299.19, Code 2020, is amended to read as 11 follows: 12 299.19 Proceeding against parent. 13 Upon the failure of a person having the custody and control 14 of a child who is blind, deaf or hard of hearing , or has severe 15 disabilities to require the child’s attendance as provided in 16 section 299.18 , the state board of regents may make application 17 to the district court or the juvenile court of the county in 18 which the person resides for an order requiring the person to 19 compel the attendance of the child at the proper state-operated 20 school. 21 Sec. 30. Section 299.22, Code 2020, is amended to read as 22 follows: 23 299.22 When deaf or hard of hearing and blind children 24 excused. 25 Attendance at the state-operated school may be excused when 26 the superintendent of the state-operated school certifies that 27 an interdisciplinary staffing team has determined, pursuant to 28 the requirements of chapter 256B , that the child is efficiently 29 taught for the scholastic year in an accredited nonpublic or 30 other school devoted to the instruction, by a private tutor, in 31 the public schools, or is shown to be physically or mentally 32 unable to attend school under section 299.5 . 33 Sec. 31. Section 299.23, Code 2020, is amended to read as 34 follows: 35 -12- LSB 5911YH (2) 88 pf/rh 12/ 17
H.F. 2396 299.23 Agent of state board of regents. 1 The state board of regents may employ an agent to aid in 2 the enforcement of law relative to the education of deaf or 3 hard-of-hearing children and blind children. The agent shall 4 seek out children who should be in attendance at the state 5 schools but who are not, and require such attendance. The 6 agent shall institute proceedings against persons who violate 7 the provisions of said law. The agent shall be allowed 8 compensation at a rate fixed by the board of regents, and 9 necessary traveling and hotel expenses while away from home in 10 the performance of duty. 11 Sec. 32. Section 321.1, subsection 8, paragraph g, Code 12 2020, is amended to read as follows: 13 g. If authorized to transport students or clients by the 14 superintendent of the Iowa braille and sight saving school or 15 of the Iowa school for the deaf and hard of hearing , or the 16 superintendent’s respective designee, an employee of the Iowa 17 braille and sight saving school or the Iowa school for the deaf 18 is not a chauffeur when transporting the students or clients. 19 Sec. 33. Section 321.189, subsection 9, Code 2020, is 20 amended to read as follows: 21 9. Deaf or hard-of-hearing status. A licensee who is a 22 deaf person or a hard-of-hearing person, as those terms are 23 defined in section 622B.1 , may request that the license be 24 marked to reflect the licensee’s deaf or hard-of-hearing status 25 on the face of the license when the licensee applies for the 26 issuance or renewal of a license. The department may adopt 27 rules pursuant to chapter 17A establishing criteria under which 28 a license may be marked, including requiring the licensee to 29 submit medical proof of the licensee’s deaf or hard-of-hearing 30 status. When a driver’s license is so marked, the licensee’s 31 deaf or hard-of-hearing status shall be noted in the electronic 32 database used by the department and law enforcement to access 33 registration, titling, and driver’s license information. The 34 department, in consultation with the commission of deaf and 35 -13- LSB 5911YH (2) 88 pf/rh 13/ 17
H.F. 2396 hard-of-hearing services, shall develop educational media to 1 raise awareness of a licensee’s ability to request the license 2 be marked to reflect the licensee’s deaf or hard-of-hearing 3 status. 4 Sec. 34. Section 321.190, subsection 1, paragraph b, 5 subparagraph (5), Code 2020, is amended to read as follows: 6 (5) An applicant for a nonoperator’s identification card 7 who is a deaf person or a hard-of-hearing person, as those 8 terms are defined in section 622B.1 , may request that the card 9 be marked to reflect the applicant’s deaf or hard-of-hearing 10 status on the face of the card when the applicant applies for 11 the issuance or renewal of a card. The department may adopt 12 rules pursuant to chapter 17A establishing criteria under which 13 a card may be marked, including requiring the applicant to 14 submit medical proof of the applicant’s deaf or hard-of-hearing 15 status. The department, in consultation with the commission of 16 deaf and hard-of-hearing services, shall develop educational 17 media to raise awareness of an applicant’s ability to 18 request the card be marked to reflect the applicant’s deaf or 19 hard-of-hearing status. 20 Sec. 35. Section 331.381, subsection 9, Code 2020, is 21 amended to read as follows: 22 9. Comply with chapters 269 and 270 in regard to the payment 23 of costs for pupils at the Iowa braille and sight saving school 24 and the school for the deaf and hard of hearing . 25 Sec. 36. Section 331.424, subsection 1, paragraph a, 26 subparagraph (1), subparagraph division (b), Code 2020, is 27 amended to read as follows: 28 (b) Clothing, transportation, medical, or other services 29 provided persons attending the Iowa braille and sight saving 30 school, the Iowa school for the deaf and hard of hearing , 31 or the university of Iowa hospitals and clinics’ center 32 for disabilities and development for children with severe 33 disabilities at Iowa City, for which the county becomes 34 obligated to pay pursuant to sections 263.12 , 269.2 , and 270.4 35 -14- LSB 5911YH (2) 88 pf/rh 14/ 17
H.F. 2396 through 270.7 . 1 Sec. 37. Section 331.502, subsection 15, Code 2020, is 2 amended to read as follows: 3 15. Carry out duties relating to the collection and payment 4 of funds for educating and supporting deaf and hard-of-hearing 5 students as provided in sections 270.6 and 270.7 . 6 Sec. 38. Section 331.552, subsection 13, Code 2020, is 7 amended to read as follows: 8 13. Make transfer payments to the state for school expenses 9 for blind and deaf and hard-of-hearing children and support of 10 persons with mental illness as provided in sections 230.21 , 11 269.2 , and 270.7 . 12 Sec. 39. Section 477C.2, subsections 2 and 5, Code 2020, are 13 amended to read as follows: 14 2. “Communication impairment” means the inability to use the 15 telephone for communication without a telecommunications device 16 for the deaf and hard of hearing . 17 5. “Telecommunications device for the deaf and hard of 18 hearing means any specialized or supplemental telephone 19 equipment used by communication-impaired persons to provide 20 access to the telephone system. 21 Sec. 40. Section 477C.4, Code 2020, is amended to read as 22 follows: 23 477C.4 Telecommunications devices for the deaf and hard of 24 hearing . 25 With the advice of the council, the board may plan, 26 establish, administer, and promote a program to secure, 27 finance, and distribute telecommunications devices for the 28 deaf and hard of hearing . The board may establish eligibility 29 criteria for persons to receive telecommunications devices 30 for the deaf and hard of hearing , including , but not limited 31 to , requiring certification that the recipient cannot use the 32 telephone for communication without a telecommunications device 33 for the deaf and hard of hearing . 34 Sec. 41. Section 477C.5, subsection 2, paragraph c, Code 35 -15- LSB 5911YH (2) 88 pf/rh 15/ 17
H.F. 2396 2020, is amended to read as follows: 1 c. One representative from the office of deaf and 2 hard-of-hearing services of the department of human rights. 3 Sec. 42. Section 483A.24, subsection 7, Code 2020, is 4 amended to read as follows: 5 7. A license shall not be required of minor pupils of the 6 state school for the blind, state school for the deaf and hard 7 of hearing , or of minor residents of other state institutions 8 under the control of an administrator of a division of the 9 department of human services. In addition, a person who is 10 on active duty with the armed forces of the United States, 11 on authorized leave from a duty station located outside of 12 this state, and a resident of the state of Iowa shall not be 13 required to have a license to hunt or fish in this state. The 14 military person shall carry the person’s leave papers and a 15 copy of the person’s current earnings statement showing a 16 deduction for Iowa income taxes while hunting or fishing. In 17 lieu of carrying the person’s earnings statement, the military 18 person may also claim residency if the person is registered to 19 vote in this state. If a deer or wild turkey is taken, the 20 military person shall immediately contact a state conservation 21 officer to obtain an appropriate tag to transport the animal. 22 A license shall not be required of residents of county care 23 facilities or any person who is receiving supplementary 24 assistance under chapter 249 . 25 Sec. 43. Section 622B.4, Code 2020, is amended to read as 26 follows: 27 622B.4 List. 28 The office of deaf and hard-of-hearing services of the 29 department of human rights shall prepare and continually update 30 a listing of qualified and available interpreters. The courts 31 and administrative agencies shall maintain a directory of 32 qualified interpreters for deaf and hard-of-hearing persons 33 as furnished by the department of human rights. The office 34 of deaf and hard-of-hearing services shall maintain a list 35 -16- LSB 5911YH (2) 88 pf/rh 16/ 17
H.F. 2396 of interpreters which shall be made available to a court, 1 administrative agency, or interested parties to an action using 2 the services of an interpreter. 3 Sec. 44. CODE EDITOR’S DIRECTIVE. The Code editor shall 4 correct and eliminate any references to the term “hearing 5 impaired” or other forms of the term anywhere else in the Iowa 6 Code, in any bills awaiting codification, and in any bills 7 enacted by the Eighty-eighth General Assembly, 2020 Regular 8 Session, or any extraordinary session, in accordance with this 9 Act. 10 Sec. 45. ADMINISTRATIVE CODE EDITOR DIRECTIVE. The 11 administrative rules coordinator and the administrative rules 12 review committee, in consultation with the administrative code 13 editor, shall jointly develop a schedule for the necessary 14 updating of the Iowa administrative code to update references 15 in accordance with this Act. 16 EXPLANATION 17 The inclusion of this explanation does not constitute agreement with 18 the explanation’s substance by the members of the general assembly. 19 This bill replaces the term “deaf” with “deaf or hard of 20 hearing” or “deaf and hard of hearing” and the term “hearing 21 impaired” with “hard of hearing”. 22 -17- LSB 5911YH (2) 88 pf/rh 17/ 17
