H.F. 2262 Section 1. Section 135.166, subsection 1, paragraph a, Code 1 2020, is amended to read as follows: 2 a. The department of public health shall enter into a 3 memorandum of understanding with the contractor selected 4 through a request for proposals process to act as the 5 department’s intermediary in collecting, maintaining, and 6 disseminating hospital inpatient, outpatient, and ambulatory 7 data, as initially authorized in 1996 Iowa Acts, ch. 1212, §5, 8 subsection 1, paragraph “a” , subparagraph (4), and 641 IAC 9 177.3. The request for proposals shall prohibit the contractor 10 from charging a hospital a fee for access to the data collected 11 from a hospital in the state. 12 Sec. 2. 2019 Iowa Acts, chapter 85, section 97, is amended 13 to read as follows: 14 SEC. 97. REQUEST FOR PROPOSALS PROCESS —— TRANSITION. The 15 department of public health shall continue the memorandum of 16 understanding with the entity acting as intermediary on June 17 30, 2019, pursuant to section 135.166 , until the contractor 18 selected through a request for proposals process assumes the 19 duties of intermediary on January July 1, 2021, as specified 20 under this division of this Act. The request for proposals 21 shall be issued by July 1, 2020, and a contract shall be 22 executed with the contractor selected by October 1, 2020. 23 Sec. 3. HEALTH DATA WORK GROUP —— ESTABLISHED —— MEMBERSHIP 24 —— DUTIES —— REPORTS. A health data work group is established 25 to evaluate the health data needs of the state. The work group 26 shall be comprised of the members of the data sharing and use 27 work group of the Iowa healthcare innovation and visioning 28 roundtable established in 2017. The work group shall continue 29 the work of the roundtable by implementing and building on the 30 real time healthcare information strategy, the data privacy 31 strategy, and the oversight strategy recommended by the data 32 sharing and use work group of the roundtable as submitted 33 in September 2018, and the data steering committee update 34 and recommendations submitted in June 2019, relating to the 35 -1- LSB 5875YH (7) 88 pf/rh 1/ 3
H.F. 2262 governance model for and the functionality of the Iowa health 1 information network. The work group shall submit an initial 2 report to the governor and the general assembly by December 15, 3 2020, and periodic progress reports on the implementation of 4 recommendations, measures, and milestones of success, and any 5 future actions thereafter. 6 Sec. 4. EFFECTIVE DATE. This Act, being deemed of immediate 7 importance, takes effect upon enactment. 8 Sec. 5. APPLICABILITY. The following apply retroactively 9 to July 1, 2019: 10 1. The section of this Act amending section 135.166. 11 2. The section of this Act amending 2019 Iowa Acts, chapter 12 85, section 97. 13 EXPLANATION 14 The inclusion of this explanation does not constitute agreement with 15 the explanation’s substance by the members of the general assembly. 16 This bill relates to health data including the collection 17 and use of hospital data. 18 2019 Iowa Acts, House File 766, directed the department of 19 public health (DPH) to enter into a memorandum of understanding 20 with a contractor selected through a request for proposals 21 process, rather than with the Iowa hospital association, 22 to act as the department’s intermediary in collecting, 23 maintaining, and disseminating hospital inpatient, outpatient, 24 and ambulatory data, and further directed DPH to continue the 25 memorandum of understanding with the Iowa hospital association 26 until the contractor selected through a request for proposals 27 process assumed the duties of intermediary on January 1, 2021. 28 The bill changes the transition period for continuation 29 of the memorandum of understanding from January 1, 2021, to 30 July 1, 2021. The bill also requires that the request for 31 proposals to select a contractor prohibit the contractor from 32 charging a hospital a fee for access to data collected by the 33 contractor from a hospital in the state, and that the request 34 for proposals be issued by July 1, 2020, and the contract with 35 -2- LSB 5875YH (7) 88 pf/rh 2/ 3
H.F. 2262 the contractor selected be executed by October 1, 2020. 1 The bill establishes a health data work group to evaluate the 2 health data needs of the state. The work group is comprised 3 of the members of the data sharing and use work group of the 4 Iowa healthcare innovation and visioning roundtable established 5 in 2017. The work group is tasked with continuing the work of 6 the roundtable by implementing and building on the real time 7 healthcare information strategy, the data privacy strategy, and 8 the oversight strategy recommended by the data sharing and use 9 work group of the roundtable as submitted in September 2018, 10 and the data steering committee update and recommendations 11 submitted in June 2019 relating to the governance model for 12 and the functionality of the Iowa health information network. 13 The work group shall submit an initial report to the governor 14 and the general assembly by December 15, 2020, and periodic 15 progress reports on the implementation of recommendations, 16 measures, and milestones of success, and any future actions 17 thereafter. 18 The bill takes effect upon enactment, and certain provisions 19 are retroactively applicable to July 1, 2019. 20 -3- LSB 5875YH (7) 88 pf/rh 3/ 3
