H.F. 223 Section 1. Section 622.69, subsection 1, Code 2019, is 1 amended to read as follows: 2 1. Witnesses shall receive ten dollars for each full day’s 3 attendance, and five dollars for each attendance less than a 4 full day, and mileage expenses pursuant to section 602.1509 5 reimbursement for actual and necessary expenses incurred for 6 each mile actually traveled in the performance of duties, not 7 to exceed a maximum rate established by the supreme court . 8 The supreme court shall prescribe procedures to establish the 9 maximum rate, terms, and conditions for reimbursement of the 10 expenses. 11 Sec. 2. Section 819.3, unnumbered paragraph 1, Code 2019, 12 is amended to read as follows: 13 A witness named in an order described in section 819.2 is 14 entitled to ten cents per mile reimbursement of the actual 15 and necessary expenses incurred for each mile traveled by the 16 most direct route to and from the proceedings the witness is 17 required to attend, not to exceed a maximum rate established 18 by the supreme court, and is also entitled to ten dollars per 19 day for each day spent in such travel or in attending the 20 proceedings as a witness. The supreme court shall prescribe 21 procedures to establish the maximum rate, terms, and conditions 22 for reimbursement of the expenses. 23 EXPLANATION 24 The inclusion of this explanation does not constitute agreement with 25 the explanation’s substance by the members of the general assembly. 26 This bill relates to reimbursement of witness mileage 27 expenses. The bill amends Code section 622.69 (witness fees) 28 to provide that a witness no longer receives mileage expenses 29 pursuant to Code section 602.1509, but instead receives 30 reimbursement for actual and necessary expenses incurred for 31 each mile actually traveled in the performance of duties, not 32 to exceed a maximum rate established by the supreme court. H.F. 223 reimbursement of the expenses. 1 The bill also amends Code section 819.3 (fees and 2 enforcement of order) to provide that a witness named in an 3 order described in Code section 819.2 (witnesses from another 4 state required to testify in this state) is no longer entitled 5 to 10 cents per mile but rather to reimbursement of the actual 6 and necessary expenses incurred for each mile traveled by the 7 most direct route to and from the proceeding the witness is 8 required to attend, not to exceed the maximum rate established 9 by the supreme court.
