H.F. 2209 Section 1. Section 29A.7, Code 2020, is amended by adding 1 the following new subsection: 2 NEW SUBSECTION . 4. Notwithstanding any provision of law 3 to the contrary, the governor shall not authorize the military 4 forces of the state to serve on federal active duty in an area 5 designated by the president of the United States or the United 6 States Congress as a combat zone unless the United States 7 Congress has passed an official declaration of war. 8 EXPLANATION 9 The inclusion of this explanation does not constitute agreement with 10 the explanation’s substance by the members of the general assembly. 11 This bill provides that the governor shall not authorize the 12 military forces of the state to serve on federal active duty 13 in a combat zone unless the United States Congress has passed 14 an official declaration of war. 15 -1- LSB 5541YH (3) 88 ec/rn 1/ 1
