H.F. 2192 Section 1. Section 514C.34, subsection 1, Code 2020, is 1 amended by adding the following new paragraphs: 2 NEW PARAGRAPH . 0a. “Covered person” means the same as 3 defined in section 514J.102. 4 NEW PARAGRAPH . 00a. “Facility” means the same as defined in 5 section 514J.102. 6 NEW PARAGRAPH . 0c. “Health carrier” means the same as 7 defined in section 514J.102. 8 Sec. 2. Section 514C.34, subsection 1, paragraph c, Code 9 2020, is amended to read as follows: 10 c. “Telehealth” means the delivery of health care 11 services through the use of interactive audio and video , 12 or other electronic media, regardless of where the health 13 care professional and the covered person are each located . 14 “Telehealth” does not include the delivery of health care 15 services delivered solely through an audio-only telephone, 16 electronic mail message, or facsimile transmission. 17 Sec. 3. Section 514C.34, Code 2020, is amended by adding the 18 following new subsection: 19 NEW SUBSECTION . 3A. A health carrier shall reimburse 20 a health care professional and a facility for health care 21 services provided to a covered person by telehealth on the same 22 basis and at the same rate as the health carrier would apply to 23 the same health care services provided to a covered person by 24 the health care professional and a facility in person. 25 Sec. 4. APPLICABILITY. This Act applies to health care 26 services provided by a health care professional or a facility 27 to a covered person by telehealth on or after January 1, 2021. 28 EXPLANATION 29 The inclusion of this explanation does not constitute agreement with 30 the explanation’s substance by the members of the general assembly. 31 This bill requires a health carrier to reimburse a health 32 care professional or facility for health care services provided 33 to a covered person by telehealth on or after January 1, 2021, 34 on the same basis and at the same rate as the health carrier 35 -1- LSB 5672HV (2) 88 ko/rn 1/ 2
