H.F. 2187 Section 1. Section 155A.27, subsection 2, paragraph b, Code 1 2020, is amended by adding the following new subparagraph: 2 NEW SUBPARAGRAPH . (12) A prescription issued by a free 3 clinic, as defined in section 135.24, subsection 7, paragraph 4 “c” . 5 Sec. 2. EFFECTIVE DATE. This Act, being deemed of immediate 6 importance, takes effect upon enactment. 7 Sec. 3. RETROACTIVE APPLICABILITY. This Act applies 8 retroactively to January 1, 2020. 9 EXPLANATION 10 The inclusion of this explanation does not constitute agreement with 11 the explanation’s substance by the members of the general assembly. 12 This bill exempts free clinics, defined as a facility that is 13 exempt from taxation under section 501(c)(3) of the Internal 14 Revenue Code and that has the sole purpose of providing health 15 care services without charge to individuals who are otherwise 16 unable to pay for the services, from the requirement that every 17 prescription issued for a prescription drug be transmitted 18 electronically to a pharmacy. 19 The bill takes effect upon enactment and is retroactively 20 applicable to January 1, 2020. 21 -1- LSB 5982YH (2) 88 ss/rh 1/ 1
