H.F. 2166 Section 1. Section 321.285, subsection 3, Code 2020, is 1 amended to read as follows: 2 3. Unless otherwise provided in this section or by other 3 speed restrictions, the speed limit for all vehicular traffic 4 shall be fifty-five sixty miles per hour. 5 Sec. 2. Section 321.285, subsection 5, paragraph a, Code 6 2020, is amended to read as follows: 7 a. Notwithstanding any other speed restrictions, the speed 8 limit for all vehicular traffic on fully controlled-access, 9 divided, multilaned highways is sixty-five seventy miles per 10 hour. However, the speed limit for all vehicular traffic 11 on highways that are part of the interstate road system, as 12 defined in section 306.3 , is seventy seventy-five miles per 13 hour. The department may establish a speed limit of sixty-five 14 seventy miles per hour on certain divided, multilaned highways 15 not otherwise described in this paragraph. 16 EXPLANATION 17 The inclusion of this explanation does not constitute agreement with 18 the explanation’s substance by the members of the general assembly. 19 Current law provides that the speed limit for all vehicular 20 traffic is 55 miles per hour (mph) unless otherwise provided 21 for by other speed restrictions. The speed limit on fully 22 controlled-access, divided, multilaned highways is 65 mph. 23 The speed limit on highways that are part of the interstate 24 road system is 70 mph. The department of transportation (DOT) 25 is allowed to establish a speed limit of 65 mph on certain 26 divided, multilaned highways not already covered by Code 27 section 321.285(5)(a). 28 This bill increases the speed limit on certain roads. The 29 bill provides that the speed limit for all vehicular traffic 30 not otherwise provided for is 60 mph. The speed limit on fully 31 controlled-access, divided, multilaned highways is 70 mph. 32 The speed limit on highways that are part of the interstate 33 road system is 75 mph. The speed limit the DOT is allowed to 34 establish on certain divided, multilaned highways not already 35 -1- LSB 5822YH (3) 88 mo/ns 1/ 2
H.F. 2166 covered by Code section 321.285(5)(a) is increased to 70 mph. 1 A violation of a speed restriction is punishable by a 2 scheduled fine with the amount of the fine determined by the 3 speed in excess of the limit under Code section 805.8A(5) 4 (speed violations) or 805.8A(10) (school bus violations). 5 However, a school bus violation of more than 10 mph in excess 6 of the limit is not a scheduled violation and is punishable as 7 a simple misdemeanor.
