H.F. 2113 Section 1. Section 8C.3, subsection 5, Code 2020, is amended 1 by striking the subsection. 2 Sec. 2. Section 8C.3, subsection 7, Code 2020, is amended by 3 striking the subsection. 4 EXPLANATION 5 The inclusion of this explanation does not constitute agreement with 6 the explanation’s substance by the members of the general assembly. 7 This bill relates to prohibitions on the actions of an 8 authority under the Iowa cell siting Act. The bill strikes 9 Code section 8C.3, subsection 5, which prohibits an authority 10 from imposing environmental testing, sampling, or monitoring 11 requirements, or other compliance measures, for radio frequency 12 emissions from transmission equipment that are categorically 13 excluded under the federal communications commission’s rules 14 for radio frequency emissions. In addition, the bill strikes 15 Code section 8C.3, subsection 7, which prohibits an authority 16 from rejecting an application, in whole or in part, based on 17 perceived or alleged environmental effects of radio frequency 18 emissions. 19 -1- LSB 5604YH (1) 88 ja/rn 1/ 1
