H.F. 2096 Section 1. Section 8A.413, subsection 21, paragraph b, Code 1 2020, is amended to read as follows: 2 b. Annual sick leave , family leave, and vacation time shall 3 be granted in accordance with section 70A.1 . 4 Sec. 2. Section 70A.1, Code 2020, is amended by adding the 5 following new subsection: 6 NEW SUBSECTION . 10. a. For purposes of this subsection: 7 (1) “Child” means a biological, adopted, or foster child, 8 or a stepchild. 9 (2) “Serious health condition” means the same as defined in 10 29 U.S.C. §2611. 11 b. A permanent, full-time state employee, after completing 12 six months of employment with the employee’s state employer, 13 shall be eligible for twenty weeks of paid family leave per 14 calendar year. Permanent, part-time state employees shall be 15 eligible for paid sick leave on a prorated basis. 16 c. Family leave shall not accrue and shall expire upon the 17 conclusion of a calendar year or the employee’s separation from 18 state employment. However, if an employee is laid off and 19 the employee is reemployed by any state employer within one 20 calendar year of the date of the layoff, the six-month period 21 provided in paragraph “b” shall not apply. 22 d. An employee is eligible to take family leave under this 23 subsection for the following reasons: 24 (1) The birth of a child of the employee. 25 (2) The placement of a child with the employee for adoption 26 or foster care. 27 (3) The provision of care for the spouse, child, parent, 28 grandparent, or sibling of the employee for a serious health 29 condition. 30 e. A state employer may require documentation of the reason 31 for the employee’s family leave and the probable duration of 32 the leave. 33 f. If this subsection conflicts with the provisions of a 34 collective bargaining agreement, the collective bargaining 35 -1- LSB 5567YH (2) 88 je/rn 1/ 3
H.F. 2096 agreement shall prevail. 1 g. The department of administrative services shall adopt 2 rules pursuant to chapter 17A to administer this subsection. 3 Sec. 3. Section 218.17, Code 2020, is amended to read as 4 follows: 5 218.17 Authorized leave. 6 Vacations , and sick leave with pay , and family leave with 7 pay as authorized in section 70A.1 shall only be taken at such 8 times as the superintendent or the business manager in charge 9 of an officer or employee, as the case may be, may direct, 10 and only after written authorization by the superintendent or 11 business manager, and for the number of days specified in the 12 authorization. A copy of the authorization shall be attached 13 to the institution’s copy of the payroll of the institution, 14 for audit purposes, for the period during which the vacation 15 was taken, and the semimonthly payroll shall show the number of 16 days the person was absent under the authorization. 17 EXPLANATION 18 The inclusion of this explanation does not constitute agreement with 19 the explanation’s substance by the members of the general assembly. 20 This bill provides that a permanent, full-time state 21 employee, after completing six months of employment with the 22 employee’s state employer, shall be eligible for 20 weeks of 23 paid family leave per calendar year. Permanent, part-time 24 state employees shall be eligible for paid sick leave on a 25 prorated basis. 26 Family leave shall not accrue and shall expire upon the 27 conclusion of a calendar year or the employee’s separation 28 from state employment. The bill includes provisions governing 29 reemployment by the state. 30 An employee is eligible to take family leave for the birth 31 of a child of the employee; the placement of a child with the 32 employee for adoption or foster care; or the provision of care 33 for the spouse, child, parent, grandparent, or sibling of the 34 employee for a serious health condition.
