Section
1.
Section
20.9,
subsection
1,
Code
2020,
is
amended
1
to
read
as
follows:
2
1.
For
negotiations
regarding
a
bargaining
unit
with
3
at
least
thirty
percent
of
members
who
are
public
safety
4
employees,
the
public
employer
and
the
employee
organization
5
shall
meet
at
reasonable
times,
including
meetings
reasonably
6
in
advance
of
the
public
employer’s
budget-making
process,
7
to
negotiate
in
good
faith
with
respect
to
wages,
hours,
8
vacations,
insurance,
holidays,
leaves
of
absence,
shift
9
differentials,
overtime
compensation,
supplemental
pay,
10
seniority,
transfer
procedures,
job
classifications,
health
11
and
safety
matters,
evaluation
procedures,
procedures
for
12
staff
reduction,
in-service
training,
grievance
procedures
13
for
resolving
any
questions
arising
under
the
agreement,
14
and
other
matters
mutually
agreed
upon.
For
negotiations
15
regarding
a
bargaining
unit
that
does
not
have
at
least
thirty
16
percent
of
members
who
are
public
safety
employees,
the
public
17
employer
and
the
employee
organization
shall
meet
at
reasonable
18
times,
including
meetings
reasonably
in
advance
of
the
public
19
employer’s
budget-making
process,
to
negotiate
in
good
faith
20
with
respect
to
base
wages
and
other
matters
mutually
agreed
21
upon.
Negotiations
regarding
all
bargaining
units
shall
also
22
include
terms
authorizing
dues
checkoff
for
members
of
the
23
employee
organization.
If
an
agreement
provides
for
dues
24
checkoff,
a
member’s
dues
may
be
checked
off
only
upon
the
25
member’s
written
request
and
the
member
may
terminate
the
dues
26
checkoff
at
any
time
by
giving
thirty
days’
written
notice.
27
Such
obligation
to
negotiate
in
good
faith
does
not
compel
28
either
party
to
agree
to
a
proposal
or
make
a
concession.
29
Mandatory
subjects
of
negotiation
specified
in
this
subsection
30
shall
be
interpreted
narrowly
and
restrictively.

Sec.
2.
Section
70A.17A,
Code
2020,
is
amended
by
adding
the
32
following
new
subsection:

.
3.
This
section
shall
not
affect
a
payroll
34
deduction
elected
by
a
state
employee
pursuant
to
section
35

70A.19,
Code
2020,
is
amended
by
striking
2
the
section
and
inserting
in
lieu
thereof
the
following:

Duration
of
state
payroll
deduction
for
dues
of

employee
organization
member.

A
state
employee
who
elects
a
payroll
deduction
for
6
membership
dues
to
an
employee
organization
pursuant
to
the
7
provisions
of
a
collective
bargaining
agreement
negotiated
8
under
the
provisions
of
chapter
20
shall
maintain
the
deduction
9
for
a
period
of
one
year
or
until
the
expiration
of
the
10
collective
bargaining
agreement,
whichever
occurs
first.
A
11
state
employee
who
transfers
employment
to
a
position
covered
12
by
a
different
collective
bargaining
agreement
or
who
becomes
13
a
management
employee
is
not
subject
to
this
requirement.

With
respect
to
state
employees,
this
section
supersedes
the
15
provisions
of
section
20.9
allowing
termination
of
a
dues
16
checkoff
at
any
time
but
does
not
supersede
the
requirement
for
17
thirty
days’
written
notice
of
termination.

Sec.
4.
EFFECTIVE
DATE.
This
Act,
being
deemed
of
immediate
19
importance,
takes
effect
upon
enactment.
20
Sec.
5.
APPLICABILITY.
This
Act
applies
to
collective
21
bargaining
procedures
pursuant
to
chapter
20
initiated
on
or
22
after
the
effective
date
of
this
Act.

EXPLANATION
24
The
inclusion
of
this
explanation
does
not
constitute
agreement
with
25
the
explanation’s
substance
by
the
members
of
the
general
assembly.
26
This
bill
provides
that
the
scope
of
negotiations
for
27
collective
bargaining
between
public
employers
and
public
28
employees
shall
include
terms
authorizing
dues
checkoff
for
29
employees
who
are
members
of
employee
organizations.
30
The
bill
strikes
a
prohibition
on
public
employers
31
authorizing
or
administering
a
deduction
from
the
salaries
32
or
wages
of
its
employees
for
membership
dues
to
an
employee
33
organization.
The
bill
provides
procedures
for
administering
34
such
dues
deductions.

bill
takes
effect
upon
enactment
and
applies
to

pursuant
to
Code
chapter
