H.F. 2063 Section 1. Section 321.194, subsection 2, paragraph a, Code 1 2020, is amended by adding the following new subparagraph: 2 NEW SUBPARAGRAPH . (03) If the licensee is employed, the 3 licensee may operate a motor vehicle during the hours of 5:00 4 a.m. to 10:00 p.m. over the most direct and accessible route 5 between the licensee’s residence or school of enrollment and 6 the licensee’s place of employment, provided the driving 7 distance between the licensee’s place of employment and the 8 nearest point on the route on which the licensee is authorized 9 to travel under subparagraph (1), subparagraph division (a), or 10 subparagraph (2), subparagraph division (a), is no more than 11 fifteen miles. 12 Sec. 2. Section 321.194, subsection 2, paragraph a, 13 subparagraph (3), Code 2020, is amended to read as follows: 14 (3) To a service station for the purpose of refueling, so 15 long as the service station is the station closest to the route 16 on which the licensee is traveling under subparagraph (1) , or 17 (2) , or (03) . 18 Sec. 3. Section 321.194, subsection 3, paragraph b, Code 19 2020, is amended to read as follows: 20 b. Upon receipt of a statement of necessity, the department 21 shall issue the driver’s license provided the applicant is 22 otherwise eligible for issuance of the license. The fact that 23 the applicant resides at a distance less than one mile from the 24 applicant’s school of enrollment is prima facie evidence of the 25 nonexistence of necessity for the issuance of a license. 26 EXPLANATION 27 The inclusion of this explanation does not constitute agreement with 28 the explanation’s substance by the members of the general assembly. 29 Under current law, a person holding a special minor’s 30 driver’s license is allowed to operate a motor vehicle during 31 the hours of 5:00 a.m. to 10:00 p.m. between the licensee’s 32 residence, schools of enrollment, bus stops, and sites, 33 facilities, or schools designated by the licensee’s district 34 or school of enrollment for the accommodation of the school’s 35 -1- LSB 5072YH (7) 88 mo/ns 1/ 2
H.F. 2063 extracurricular activities, with certain limitations. This 1 bill allows a person holding a special minor’s driver’s license 2 who is employed to operate a motor vehicle during the hours of 3 5:00 a.m. to 10:00 p.m. to the licensee’s place of employment, 4 so long as the driving distance between the licensee’s place 5 of employment and the nearest point on an authorized route 6 between the licensee’s residence and school of enrollment or 7 the closest bus stop is no more than 15 miles. The bill also 8 allows a licensee to operate a motor vehicle to a service 9 station along the associated route. 10 Under current law, an applicant for a special minor’s 11 driver’s license is required to submit a certification from the 12 applicant’s school stating that a need exists for the license. 13 The fact that an applicant resides at a distance less than one 14 mile from the applicant’s school of enrollment is prima facie 15 evidence of the nonexistence of necessity for the issuance of 16 the license. The bill strikes this exclusion. 17 A violation of Code section 321.194 is punishable by a 18 scheduled fine of $50. 19 -2- LSB 5072YH (7) 88 mo/ns 2/ 2
