H.F. 206 Section 1. Section 139A.8, subsection 4, Code 2019, is 1 amended to read as follows: 2 4. a. Immunization is not required for a person’s 3 enrollment in any elementary or secondary school or licensed 4 child care center if either of the following applies: 5 (1) The the applicant, or if the applicant is a minor, the 6 applicant’s parent or legal guardian, submits to the admitting 7 official a statement signed by a physician, advanced registered 8 nurse practitioner, or physician assistant who is licensed by 9 the board of medicine, board of nursing, or board of physician 10 assistants that the immunizations required would be injurious 11 to the health and well-being of the applicant or any member of 12 the applicant’s family. 13 (2) The applicant, or if the applicant is a minor, the 14 applicant’s parent or legal guardian, submits an affidavit 15 signed by the applicant, or if the applicant is a minor, 16 the applicant’s parent or legal guardian, stating that the 17 immunization conflicts with the tenets and practices of a 18 recognized religious denomination of which the applicant is an 19 adherent or member. 20 b. The exemptions exemption under this subsection do does 21 not apply in times of emergency or epidemic as determined by 22 the state board of health and as declared by the director of 23 public health. 24 EXPLANATION 25 The inclusion of this explanation does not constitute agreement with 26 the explanation’s substance by the members of the general assembly. 27 This bill eliminates the exemption from required 28 immunization for a person’s enrollment in any elementary 29 or secondary school or licensed child care center relating 30 to conflicts with the tenets and practices of a recognized 31 religious denomination of which the applicant is an adherent 32 or member. 33 -1- LSB 2086YH (1) 88 pf/rh 1/ 1
