H.F. 2035 Section 1. Section 331.907, subsection 1, Code 2020, is 1 amended to read as follows: 2 1. a. The annual compensation of the auditor, treasurer, 3 recorder, sheriff, county attorney, and supervisors shall 4 be determined as provided in this section . The county 5 compensation board annually shall review the compensation 6 paid to comparable officers in other counties of this state, 7 other states, private enterprise, and the federal government. 8 In setting the salary of the county sheriff, the county 9 compensation board shall consider setting the sheriff’s salary 10 so that it is comparable to salaries paid to professional 11 law enforcement administrators and command officers of the 12 state patrol, the division of criminal investigation of the 13 department of public safety, and city police agencies in 14 this state. The county compensation board shall prepare a 15 compensation schedule for the elective county officers for the 16 succeeding fiscal year. A recommended compensation schedule 17 requires a majority vote of the membership of the county 18 compensation board. 19 b. In setting the salary of the county sheriff, the county 20 compensation board shall consider setting the sheriff’s salary 21 so that it is comparable to salaries paid to professional 22 law enforcement administrators and command officers of the 23 state patrol, the division of criminal investigation of the 24 department of public safety, and city police agencies in this 25 state. 26 c. The county compensation board shall not recommend a 27 compensation schedule that annually compensates a county 28 supervisor in an amount greater than the median annual 29 household income for the county based on current United States 30 census bureau median household income statistics. 31 EXPLANATION 32 The inclusion of this explanation does not constitute agreement with 33 the explanation’s substance by the members of the general assembly. 34 This bill relates to limits on the compensation of county 35 -1- LSB 5125YH (2) 88 js/ns 1/ 2

Under current law, a county compensation board 1 recommends the annual compensation of certain county officials, 2 including supervisors, after reviewing the compensation paid 3 to comparable officers in other counties of this state, other 4 states, private enterprise, and the federal government. The 5 bill prohibits the county compensation board from recommending 6 a compensation schedule that annually compensates supervisors 7 in an amount greater than the median annual household income 8 for the county.
