NEW SECTION . 147.11A Health profession practice 1 requirements —— approval. 2 Any practice requirement proposed by a state agency, other 3 than the health profession board with authority over a specific 4 health profession, that restricts the practice of a health 5 professional to a greater extent than the requirements imposed 6 by the applicable health profession board, shall not be imposed 7 prior to approval of the practice requirement by the board of 8 health and the applicable licensing board. For the purposes 9 of this section, “state agency” means the same as defined in 10 section 8A.101. 11 EXPLANATION 12 The inclusion of this explanation does not constitute agreement with 13 the explanation’s substance by the members of the general assembly. 14 This bill provides that a practice requirement proposed by 15 a state agency other than the health profession board for a 16 specific health profession that restricts the practice of a 17 health professional to a greater extent than the requirements 18 imposed by the applicable health profession board, shall not 19 be imposed prior to approval of the practice requirement by 20 the board of health and the applicable licensing board. For 21 the purposes of the bill, “state agency” means a unit of 22 state government, which is an authority, board, commission, 23 committee, council, department, or independent agency, 24 including but not limited to each principal central department 25 enumerated in Code section 7E.5. “State agency” does not 26 mean the office of the governor or the office of an elective 27 constitutional or statutory officer; the general assembly, or 28 any office or unit under its administrative authority; the 29 judicial branch; or a political subdivision of the state or its 30 offices or units, including but not limited to a county, city, 31 or community college. 32 -1- LSB 5314YH (2) 88 pf/rh 1/ 1
