Section
1.
Section
453A.3,
Code
2019,
is
amended
by
adding
1
the
following
new
subsection:

The
court
records
of
a
person
for

a
violation
of
section
453A.2,
subsection
2,
shall
be
4
confidential
and
are
not
public
records,
but
may
be
disclosed
5
in
the
same
manner
as
juvenile
court
records
are
pursuant
to

section
232.147,
subsection
3.

The
inclusion
of
this
explanation
does
not
constitute
agreement
with

the
explanation’s
substance
by
the
members
of
the
general
assembly.

This
bill
relates
to
the
confidentiality
of
court
records
of
11
persons
under
legal
age
for
cigarette
and
tobacco
violations.
12
Under
current
law,
a
person
under
18
years
of
age
may
not
13
smoke,
use,
possess,
purchase,
or
attempt
to
purchase
any
14
tobacco,
tobacco
products,
alternative
nicotine
products,
vapor
15
products,
or
cigarettes.
The
bill
provides
that
the
court
16
records
of
a
person
who
violates
this
law
are
confidential
and
17
are
not
public
records,
but
may
be
disclosed
in
the
same
manner
18
as
juvenile
court
records
are
pursuant
Code
section
232.147(3).

This
includes
but
is
not
limited
to
the
following:
a
judge
and
20
professional
staff;
the
child
and
child’s
counsel;
the
child’s
21
parent,
guardian,
or
custodian;
a
county
attorney;
an
agency,
22
individual,
association,
facility,
or
institution
responsible
23
for
the
care,
treatment,
or
supervision
of
the
child;
persons
24
involved
in
connection
with
the
preparation
of
a
presentence
25
report;
the
state
public
defender;
the
department
of
human
26
services;
and
the
department
of
corrections.
