Section
1.
SHORT
TITLE.
This
Act
shall
be
known
as
“Logan’s
1
Law”.

Sec.
2.
Section
142C.2,
subsection
6,
Code
2019,
is
amended
3
to
read
as
follows:

“Document
of
gift”
means
a
donor
card
or
other
record
5
used
to
make
an
anatomical
gift,
including
a
statement
or
6
symbol
on
a
driver’s
license
,
or
identification
card,
or
7
hunting,
fishing,
or
fur
harvester
license,
or
an
entry
in
a
8
donor
registry.

Sec.
3.
Section
142C.2,
Code
2019,
is
amended
by
adding
the
10
following
new
subsection:

SUBSECTION
.
13A.
“Hunting,
fishing,
or
fur
harvester

license”
means
a
license
issued
by
the
department
of
natural

resources
or
an
authorized
license
agent
pursuant
to
chapter
14
483A.

subsection
1,
paragraph
a,
Code

is
amended
by
adding
the
following
new
subparagraph:

.
(4)
A
minor,
if
the
minor
is
authorized

under
state
law
to
apply
for
a
hunting,
fishing,
or
fur

harvester
license,
the
minor
is
at
least
14
years
of
age,
and

the
minor
authorizes
a
symbol
indicating
an
anatomical
gift
on
21
a
hunting,
fishing,
or
fur
harvester
license
with
the
signed
22
approval
of
a
parent
or
guardian.

142C.3,
subsection
2,
paragraph
a,

invalidate

a
hospital
refers
an
individual
at
or
near
death

to
a
procurement
organization,
the
procurement
organization

shall
make
a
reasonable
search
of
the
records
of
the
state
4
department
of
transportation
,
department
of
natural
resources,
5
and
any
donor
registry
that
the
hospital
knows
exists
for
the
6
geographical
area
in
which
the
individual
resides
to
ascertain
7
whether
the
individual
has
made
an
anatomical
gift.

2.
A
procurement
organization
shall
be
allowed
reasonable
9
access
to
information
in
the
records
of
the
state
department
10
of
transportation
and
the
department
of
natural
resources
to
11
ascertain
whether
an
individual
at
or
near
death
is
a
donor.

8.
Section
142C.18,
Code
2019,
is
amended
by
adding
the
13
following
new
subsection:

.
2A.
The
department
of
natural
resources

shall
cooperate
with
a
person
that
administers
the
Iowa
donor
16
registry
for
the
purpose
of
transferring
to
the
donor
registry
17
all
relevant
information
regarding
a
donor’s
making
of
an
18
anatomical
gift.

Sec.
9.
Section
142C.18,
subsection
3,
paragraph
d,
Code

2019,
is
amended
to
read
as
follows:

d.
Provide
a
centralized,
automated
system
to
compile
22
donation
information
received
by
the
state
department
of
23
transportation,
department
of
natural
resources,
county
24
treasurers,
and
the
Iowa
donor
network.

10.
Section
483A.10,
Code
2019,
is
amended
by
adding
26
the
following
new
subsection:

.
3.
An
application
for
a
hunting,
fishing,

or
fur
harvester
license
shall
include
a
section
where
an
29
applicant
may
request
that
the
applicant’s
license
include
a
30
symbol
that
indicates
that
the
applicant
is
a
donor
under
the
31
revised
uniform
anatomical
gift
Act
as
provided
in
chapter
32
142C.

Sec.
11.
Section
483A.18,
Code
2019,
is
amended
to
read
as

of
licenses.

1.
All
hunting,
fishing,
and
fur
harvester
licenses
shall
2
contain
a
general
description
of
the
licensee.
Such
licenses
3
shall
be
upon
such
forms
as
the
commission
shall
adopt.
The
4
address
and
the
signature
of
the
applicant
and
all
signatures
5
and
other
required
information
shall
be
in
writing.
All
6
licenses
shall
clearly
indicate
the
nature
of
the
privilege
7
granted.

2.
Upon
request
of
an
applicant
pursuant
to
section
483A.10,
9
the
department
shall
indicate
on
the
license
that
the
applicant
10
is
a
donor
under
the
revised
uniform
anatomical
gift
Act
as
11
provided
in
chapter
142C.
12
Sec.
12.
Section
483A.27,
subsection
2,
paragraph
a,
Code
13
2019,
is
amended
to
read
as
follows:
14
a.
A
certificate
of
completion
shall
not
be
issued
to
15
a
person
who
has
not
satisfactorily
completed
an
approved
16
hunter
education
course.
The
department
shall
establish
the
17
curriculum
based
on
the
standards
adopted
by
the
international
18
hunter
education
association
——
United
States
of
America
for
19
the
approved
hunter
education
course.
The
curriculum
shall
20
include
instruction
relating
to
becoming
an
organ
donor
under
21
the
revised
uniform
anatomical
gift
Act
as
provided
in
chapter
22
142C.
Upon
completion
of
the
course,
each
person
shall
pass
23
an
individual
oral
test
or
a
written
test
provided
by
the
24
department.
The
department
shall
establish
the
criteria
for
25
successfully
passing
the
tests.
Based
on
the
results
of
26
the
test
and
demonstrated
safe
handling
of
a
firearm,
the
27
instructor
shall
determine
the
persons
who
shall
be
issued
a
28
certificate
of
completion.

The
inclusion
of
this
explanation
does
not
constitute
agreement
with
31
the
explanation’s
substance
by
the
members
of
the
general
assembly.

Current
law
does
not
require
the
department
of
natural

resources
to
include
on
a
hunting,
fishing,
or
fur
harvester

license
application
a
section
where
an
applicant
may
request

applicant

the

uniform
anatomical

Act.
This

bill
requires
the
department
to
include
such
a
section.
If

any
adult
applicant
or
any
minor
applicant
who
is
at
least
4
14
years
of
age
and
has
the
signed
approval
of
a
parent
or
5
guardian
requests
that
the
applicant’s
hunting,
fishing,
or
6
fur
harvester
license
indicate
that
the
applicant
is
a
donor
7
under
the
revised
uniform
anatomical
gift
Act,
the
department
8
must
place
a
symbol
on
the
applicant’s
license
that
makes
the
9
indication.
An
applicant’s
authorization
to
have
the
symbol
10
placed
on
the
applicant’s
hunting,
fishing,
or
fur
harvester
11
license
is
a
valid
method
of
making
an
anatomical
gift
under
12
the
bill.
13
The
bill
requires
the
department
to
provide
reasonable
14
access
to
information
to
a
procurement
organization
to
15
ascertain
whether
an
individual
at
or
near
death
is
a
donor.
16
The
bill
also
requires
the
department
to
cooperate
with
a
17
person
that
administers
the
Iowa
donor
registry
for
the
purpose
18
of
transferring
to
the
registry
all
relevant
information
19
regarding
a
donor’s
making
of
an
anatomical
gift.
The
20
department
shall
also
include
instruction
relating
to
becoming

an

donor

program
curriculum.
