H.F. 120 Section 1. Section 216E.1, Code 2019, is amended by adding 1 the following new subsection: 2 NEW SUBSECTION . 14. Telecoil assistive device” means a 3 tiny coil of wire around a core that supplements or replaces an 4 input device within a hearing assistive device that will induce 5 an electric current in the coil when it is in the presence of 6 a magnetic field. 7 Sec. 2. NEW SECTION . 216E.5A Telecoil assistive device 8 notification requirements. 9 1. At the time of receiving a purchase order for a hearing 10 assistive device is received, the assistive device dealer 11 or assistive device lessor shall provide the consumer with 12 written information pertaining to a telecoil assistive device, 13 including all of the following: 14 a. The setting on the telecoil assistive device. 15 b. The compatibility of the telecoil assistive device 16 with other assistive devices which are compliant with the 17 federal Americans with Disabilities Act pursuant to 42 U.S.C. 18 §12101-12117. 19 2. A consumer receiving the written information shall sign 20 a copy of the written information which shall be retained by 21 the assistive device dealer or assistive device lessor for the 22 period corresponding to the number of years of warranty set out 23 by the manufacturers. 24 Sec. 3. APPLICABILITY. This Act applies to hearing 25 assistive device purchase orders received on or after September 26 1, 2019. 27 EXPLANATION 28 The inclusion of this explanation does not constitute agreement with 29 the explanation’s substance by the members of the general assembly. 30 This bill relates to telecoil assistive devices. 31 The bill defines a telecoil assistive device as a tiny coil 32 of wire around a core that supplements or replaces an input 33 device within a hearing assistive device that will induce an 34 electric current in the coil when it is in the presence of a 35 -1- LSB 1597YH (2) 88 hb/rn 1/ 2
H.F. 120 magnetic field. 1 The bill provides that at the time of receiving an order 2 for a hearing assistive device, the consumer will be provided 3 written information by the assistive device dealer or assistive 4 device lessor related to a telecoil assistive device. 5 The bill provides that the written information shall 6 include the setting on the telecoil assistive device and the 7 compatibility of the device with other assistive devices which 8 are compliant with the Americans with Disabilities Act. 9 The bill requires that a copy of the written information 10 signed by the consumer be retained by the assistive device 11 dealer or assistive device manufacturer for the period 12 corresponding to the number of years of warranty set out by the 13 manufacturer. 14 The bill applies to telecoil purchase orders received on or 15 after September 1, 2019. 16 -2- LSB 1597YH (2) 88 hb/rn 2/ 2
