S.F. _____ DIVISION I 1 REBUILD IOWA INFRASTRUCTURE FUND 2 Section 1. REBUILD IOWA INFRASTRUCTURE FUND —— 3 APPROPRIATIONS. There is appropriated from the rebuild Iowa 4 infrastructure fund to the following departments and agencies 5 for the following fiscal years, the following amounts, or so 6 much thereof as is necessary, to be used for the purposes 7 designated: 8 1. (1) For deposit in the water quality initiative fund 14 created in section 466B.45 for purposes of supporting the 15 water quality initiative administered by the division of soil 16 conservation and water quality as provided in section 466B.42, 17 including salaries, support, maintenance, and miscellaneous 18 purposes, notwithstanding section 8.57, subsection 5, paragraph 19 “c”: 20 FY 2018-2019: 21 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 5,200,000 22 (2) (a) The moneys appropriated in this lettered 23 paragraph shall be used to support demonstration projects in 24 subwatersheds as designated by the department that are part 25 of high-priority watersheds identified by the water resources 26 coordinating council. 27 (b) The moneys appropriated in this lettered paragraph 28 shall be used to support demonstration projects in watersheds 29 generally, including regional watersheds, as designated by the 30 division and high-priority watersheds identified by the water 31 resources coordinating council. 32 (3) In supporting projects in watersheds and subwatersheds 33 as provided in subparagraph (2), subparagraph divisions (a) and 34 (b), all of the following shall apply: 35 -1- LSB 5035XC (4) 87 ec/tm 1/ 21
S.F. _____ (a) The demonstration projects shall utilize water quality 1 practices as described in the latest revision of the document 2 entitled “Iowa Nutrient Reduction Strategy” initially presented 3 in November 2012 by the department of agriculture and land 4 stewardship, the department of natural resources, and Iowa 5 state university of science and technology. 6 (b) The division shall implement demonstration projects 7 as provided in subparagraph division (a) by providing 8 for participation by persons who hold a legal interest in 9 agricultural land used in farming. To every extent practical, 10 the division shall provide for collaborative participation by 11 such persons who hold a legal interest in agricultural land 12 located within the same subwatershed. 13 (c) The division shall implement demonstration projects on 14 a cost-share basis as determined by the division. Except for 15 edge-of-field practices, the state’s share of the amount shall 16 not exceed 50 percent of the estimated cost of establishing the 17 practice as determined by the division or 50 percent of the 18 actual cost of establishing the practice, whichever is less. 19 (d) The demonstration projects shall be used to educate 20 other persons about the feasibility and value of establishing 21 similar water quality practices. The division shall promote 22 field day events for purposes of allowing interested persons to 23 establish water quality practices on their agricultural land. 24 (e) The division shall conduct water quality evaluations 25 within supported subwatersheds. Within a reasonable period 26 after accumulating information from such evaluations, the 27 division shall create an aggregated database of water quality 28 practices. Any information identifying a person holding a 29 legal interest in agricultural land or specific agricultural 30 land shall be a confidential record. 31 (4) The moneys appropriated in this lettered paragraph 32 shall be used to support education and outreach in a manner 33 that encourages persons who hold a legal interest in 34 agricultural land used for farming to implement water quality 35 -2- LSB 5035XC (4) 87 ec/tm 2/ 21
S.F. _____ practices, including the establishment of such practices in 1 watersheds generally, and not limited to subwatersheds or 2 high-priority watersheds. 3 (5) The moneys appropriated in this lettered paragraph 4 may be used to contract with persons to coordinate the 5 implementation of efforts provided in this paragraph. 6 (6) The moneys appropriated in this lettered paragraph 7 may be used by the department to support urban soil and water 8 conservation efforts, which may include but are not limited 9 to management practices related to bioretention, landscaping, 10 the use of permeable or pervious pavement, and soil quality 11 restoration. The moneys shall be allocated on a cost-share 12 basis as provided in chapter 161A. 13 (7) Notwithstanding any other provision of law to the 14 contrary, the department may use moneys appropriated in 15 this lettered paragraph to carry out the provisions of this 16 paragraph on a cost-share basis in combination with other 17 moneys available to the department from a state or federal 18 source. 19 (8) Not more than 10 percent of the moneys appropriated in 20 this lettered paragraph may be used for costs of administration 21 and implementation of the water quality initiative administered 22 by the soil conservation division. 23 b. REVERSION. For purposes of section 8.33, unless 18 specifically provided otherwise, unencumbered or unobligated 19 moneys made from an appropriation in this division of this Act 20 shall not revert but shall remain available for expenditure for 21 the purposes designated until the close of the fiscal year that 22 ends three years after the end of the fiscal year for which the 23 appropriation is made. Section 8.57C, subsection 3, paragraph a, 15 subparagraph (2), Code 2018, is amended to read as follows: 16 (2) The fiscal year beginning July 1, 2018 2019 , and for 17 each subsequent fiscal year thereafter. 18 Sec. 14. Section 8.57C, subsection 3, Code 2018, is amended 19 by adding the following new paragraph: 20 NEW PARAGRAPH . g. There is appropriated from the rebuild 21 Iowa infrastructure fund for the fiscal year beginning July 1, 22 2018, and ending June 30, 2019, the sum of fourteen million 23 four hundred thousand dollars to the technology reinvestment 24 fund, notwithstanding section 8.57, subsection 5, paragraph 25 “c” . 26 DIVISION V 27 LAKE RESTORATION 28 Sec. 15. Section 456A.33B, subsection 1, paragraph b, 29 subparagraph (1), Code 2018, is amended to read as follows: 30 (1) Is owned by the federal government, the state of Iowa, a 31 county, or a municipal government, or a public entity organized 32 pursuant to chapter 357E, and is maintained principally for 33 public use. 34 Sec. 16. Section 456A.33B, subsection 1, paragraph c, 9 subparagraph (4), Code 2018, is amended by striking the 10 subparagraph. 11 EXPLANATION 12 The inclusion of this explanation does not constitute agreement with 13 the explanation’s substance by the members of the general assembly. 14 This bill relates to and makes appropriations to state 15 departments and agencies from the rebuild Iowa infrastructure 16 fund and the technology reinvestment fund, and provides for 17 related matters. The bill is organized by divisions. 18 DIVISION I —— REBUILD IOWA INFRASTRUCTURE FUND. This 19 division appropriates project funding for FY 2018-2019 from 20 the rebuild Iowa infrastructure fund for projects for the 21 departments of administrative services, agriculture and land 22 stewardship, human rights, human services, natural resources, 23 public defense, public safety, and transportation, and for the 24 office of the chief information officer, economic development 25 authority, treasurer of state, and the judicial branch. The 26 division also appropriates project funding from the rebuild 27 Iowa infrastructure fund for multiple fiscal years to the 28 department of cultural affairs, the board of regents, and the 29 law enforcement academy. 30 DIVISION II —— TECHNOLOGY REINVESTMENT FUND. This division 31 appropriates project funding for FY 2018-2019 from the 32 technology reinvestment fund for the departments of education, 33 human rights, management, public health, homeland security and 34 emergency management, public safety, and natural resources, 35 -19- LSB 5035XC (4) 87 ec/tm 19/ 21
S.F. _____ and for the office of the chief information officer, the 1 state public defender, judicial branch, and board of parole. 2 This division also appropriates project funding for multiple 3 fiscal years beginning in FY 2018-2019 from the technology 4 reinvestment fund to the department of human services and the 5 secretary of state. 6 DIVISION III —— CHANGES TO PRIOR APPROPRIATIONS. This 7 division makes a change to the reversion provision for 8 moneys appropriated to the department of education from the 9 technology reinvestment fund in FY 2012-2013. The division 10 makes a change to moneys appropriated from the rebuild Iowa 11 infrastructure fund to the board of regents for a project at 12 the state university of Iowa and for projects at the Iowa 13 state university of science and technology, and the state 14 fair authority to authorize reimbursement of infrastructure 15 costs incurred in the prior fiscal year. The division also 16 changes project funding for a project at the Iowa state 17 university of science and technology. The division also makes 18 a change to the reversion provision applicable to moneys 19 appropriated from the rebuild Iowa infrastructure fund to the 20 department of natural resources for FY 2014-2015, and adds a 21 reversion provision to moneys appropriated from the technology 22 reinvestment fund in the 2017 Iowa Acts. 23 This division takes effect upon enactment. 24 DIVISION IV —— MISCELLANEOUS PROVISIONS. Code section 25 8.57C, concerning the technology reinvestment fund, is amended 26 to provide that the appropriation to the fund from the general 27 fund for fiscal years beginning on or after July 1, 2018, is 28 changed to fiscal years beginning on or after July 1, 2019, and 29 to provide for an appropriation to the fund from the rebuild 30 Iowa infrastructure fund for the fiscal year beginning July 1, 31 2018, of $14.4 million. 32 DIVISION V —— LAKE RESTORATION. Code section 456A.33B, 33 concerning lake restoration plan and report, is amended to 34 provide that the terms “public shallow lake or wetland” and a 35 -20- LSB 5035XC (4) 87 ec/tm 20/ 21
S.F. _____ “significant public lake” include a lake or wetland owned by 1 a public entity organized pursuant to Code chapter 357E. In 2 addition, the division strikes the requirement that a “public 3 shallow lake or wetland” and a “significant public lake” does 4 not have a watershed-to-lake surface area ratio of greater than 5 two hundred to one. 6 -21- LSB 5035XC (4) 87 ec/tm 21/ 21
