Section
1.
Section
282.1,
subsection
2,
Code
2018,
is
1
amended
to
read
as
follows:

2.
For
purposes
of
this
section
,
“resident”
means
a
child
3
who
is
meets
either
of
the
following
requirements:
4
a.
Is
physically
present
in
a
district,
whose
residence
has
5
not
been
established
in
another
district
by
operation
of
law,
6
and
who
meets
any
of
the
following
conditions:
7
a.
(1)
Is
in
the
district
for
the
purpose
of
making
a
home
8
and
not
solely
for
school
purposes.
9
b.
(2)
Meets
the
definitional
requirements
of
the
term
10
“homeless
individual”
under
42
U.S.C.
§11302(a)
and
(c).
11
c.
(3)
Lives
in
a
juvenile
detention
center
or
residential
12
facility
in
the
district.
13
b.
Is
domiciled
with
the
child’s
parent
or
guardian
who
is
14
on
active
duty
in
the
military
service
of
the
United
States
and
15
is
stationed
and
domiciled
at
a
federal
military
installation
16
located
in
an
out-of-state
county
that
is
contiguous
to
a
17
county
in
this
state.

Sec.
2.
Section
282.1,
Code
2018,
is
amended
by
adding
the
19
following
new
subsections:

NEW
SUBSECTION
.
3.
The
parent
or
guardian
of
a
child
21
who
meets
the
requirements
of
subsection
2,
paragraph
“b”
,
22
paragraph
may
enroll
the
child
in
a
school
district
in
a
county
23
in
this
state
that
is
contiguous
to
the
out-of-state
county
in
24
which
the
military
installation
is
located.
Notwithstanding
25
section
285.1
relating
to
transportation
of
resident
pupils,
26
the
parent
or
guardian
is
responsible
for
transporting
the
27
child
without
reimbursement
to
and
from
a
point
on
a
regular
28
school
bus
route
of
the
district
of
enrollment.

NEW
SUBSECTION
.
4.
Notwithstanding
section
282.6,
if
a
30
parent
or
guardian
enrolls
a
child
in
a
school
district
in
31
accordance
with
subsection
3,
the
school
district
shall
be
free
32
of
tuition
for
such
child.

bill
provides
that
a
child
who
lives
with
the
child’s

parent
or
guardian
who
is
on

duty
in
the
military

is
stationed

installations
is
considered
a
resident

of
the
state
and
may
enroll
in
a
school
district
in
this
state,

free
of
tuition,
that
is
located
in
a
county
contiguous
to
the
7
county
in
which
the
military
installation
is
located.
The
8
parent
or
guardian
is
responsible
for
transporting
the
child
9
without
reimbursement
to
and
from
a
point
on
a
regular
school
10
bus
route
of
the
district
of
enrollment.

The
bill
makes
conforming
changes.
