NEW SECTION . 232.41A Routine use of bodily 1 restraints during juvenile court hearings. 2 A juvenile court officer may use shackles, handcuffs, or 3 other similar restraints on a child during a juvenile court 4 hearing held pursuant to this division, unless the court 5 determines the use of restraints is not necessary or would not 6 be in the child’s best interest. 7 EXPLANATION 8 The inclusion of this explanation does not constitute agreement with 9 the explanation’s substance by the members of the general assembly. 10 This bill relates to the use of bodily restraints on a child 11 during a juvenile court hearing. 12 The bill permits a juvenile court officer to use shackles, 13 handcuffs, or other similar restraints on a child during a 14 juvenile court hearing unless the court determines the use of 15 restraints is not necessary or would not be in the child’s best 16 interest. 17 -1- LSB 5374XC (1) 87 hb/rh 1/ 1
