S.F. _____ H.F. _____ Section 1. Section 321.393, subsection 5, Code 2018, is 1 amended to read as follows: 2 5. a. The provisions of this section shall not prohibit 3 the use of a lighting device or reflector displaying an amber, 4 white, or blue light when the lighting device or reflector is 5 rear-facing and mounted on a motor truck, trailer, tractor, 6 truck-mounted snow blower, or motor grader owned by the 7 department while the equipment is being used for snow and ice 8 treatment or removal on the public streets or highways. 9 b. This subsection is repealed on July 1, 2019. 10 Sec. 2. Section 321.423, subsection 3, paragraph a, 11 subparagraph (4), Code 2018, is amended to read as follows: 12 (4) (a) A motor truck, trailer, tractor, truck-mounted 13 snow blower, or motor grader owned by the department if the 14 blue light is rear-facing and used in conjunction with amber 15 and white lighting devices or reflectors while the equipment is 16 being used for snow and ice treatment or removal on the public 17 streets or highways. 18 (b) This subparagraph (4) is repealed on July 1, 2019. 19 Sec. 3. Section 321.423, subsection 7, paragraph a, 20 subparagraph (4), Code 2018, is amended to read as follows: 21 (4) (a) On a motor truck, trailer, tractor, truck-mounted 22 snow blower, or motor grader owned by the department if the 23 white light is rear-facing and used in conjunction with amber 24 and blue lighting devices or reflectors while the equipment is 25 being used for snow and ice treatment or removal on the public 26 streets or highways. 27 (b) This subparagraph (4) is repealed on July 1, 2019. 28 Sec. 4. REPEAL. 2015 Iowa Acts, chapter 81, section 5, is 29 repealed. 30 EXPLANATION 31 The inclusion of this explanation does not constitute agreement with 32 the explanation’s substance by the members of the general assembly. 33 In 2015, the general assembly amended Code sections 321.393 34 (color and mounting) and 321.423 (flashing lights) to allow 35 -1- LSB 5325XD (4) 87 ns/rh 1/ 2
S.F. _____ H.F. _____ the use of blue and white lighting devices and reflectors in 1 conjunction with amber lighting devices and reflectors on 2 certain motor vehicles and equipment owned by the department of 3 transportation and used for snow and ice treatment or removal. 4 Those provisions are set to be repealed effective July 1, 2019. 5 This bill strikes the future repeal provisions. The bill also 6 repeals a provision requiring the department of transportation 7 to submit a report to the general assembly prior to July 1, 8 2019, documenting the effectiveness of displaying blue and 9 white lighting devices on such vehicles and equipment. 10 -2- LSB 5325XD (4) 87 ns/rh 2/ 2
