1.
Section
321G.1,
subsection
21,
Code
2017,
is
1
amended
to
read
as
follows:

21.
“Public
land”
means
land
owned
by
the
federal
3
government,
the
state,
or
political
subdivisions
of
the
state
4
and
land
acquired
or
developed
for
public
recreation
pursuant
5
to
section
321G.7
.
“Public
land”
includes
but
is
not
limited
6
to
a
roadway
or
highway.

2.
Section
321G.7,
subsection
2,
Code
2017,
is
amended
8
to
read
as
follows:

2.
The
department
shall
remit
the
fees,
including
user
10
permit
fees
collected
pursuant
to
section
321G.4A
,
to
the
11
treasurer
of
state,
who
shall
place
the
money
in
a
special
12
snowmobile
fund.
The
money
is
appropriated
to
the
department
13
for
the
snowmobile
programs
of
the
state.
The
programs
shall
14
include
grants,
subgrants,
contracts,
or
cost-sharing
of
15
snowmobile
programs
with
political
subdivisions
or
incorporated
16
private
organizations
or
both
,
which
may
include
the
purchase,
17
ownership,
and
maintenance
of
trail
grooming
equipment,
in
18
accordance
with
rules
adopted
by
the
commission.
Snowmobile
19
fees
may
be
used
to
support
snowmobile
programs
on
a
usage
20
basis.
At
least
fifty
seventy
percent
of
the
special
fund
21
shall
be
available
for
political
subdivisions
or
incorporated
22
private
organizations
or
both.
Moneys
from
the
special
fund
23
not
used
by
the
political
subdivisions
or
incorporated
private
24
organizations
or
both
shall
remain
in
the
fund
and
may
be
used
25
by
the
department
for
the
administration
of
the
snowmobile
26
programs.
Notwithstanding
section
8.33
,
moneys
in
the
special
27
fund
shall
not
revert
to
the
general
fund
of
the
state
at
28
the
end
of
a
fiscal
year.
Notwithstanding
section
12C.7,
29
subsection
2
,
interest
or
earnings
on
moneys
in
the
special
30
fund
shall
remain
in
the
fund.

Sec.
3.
Section
321G.7,
Code
2017,
is
amended
by
adding
the
32
following
new
subsection:

.
3.
Notwithstanding
any
provision
of
law

to
the
contrary,
the
department
may
donate
trail
grooming

equipment
owned
by
the
department
to
a
political
subdivision
1
or
incorporated
private
organization
receiving
moneys
from
the

fund
after
the
useful
life
of
the
trail
grooming
equipment
to

the
department
has
expired.

Sec.
4.
Section
321G.8,
Code
2017,
is
amended
by
adding
the
5
following
new
subsection:

SUBSECTION
.
3.
Snowmobiles
registered
in
an
organized
7
special
event
authorized
pursuant
to
section
321G.16
when
such
8
snowmobiles
are
operated
within
the
boundaries
of
the
event.

EXPLANATION

The
inclusion

this
explanation
does

constitute

the

the

assembly.

This
bill
defines
“public
land”
as
the
term
relates
to
13
snowmobile
operation
under
Code
chapter
321G
to
include
14
roadways
and
highways.
Under
current
law,
the
operation
of
15
snowmobiles
on
roadways
and
highways
is
regulated
by
Code
16
section
321G.9.
17
The
bill
increases
the
share
of
the
special
snowmobile
fund
18
to
be
allocated
to
political
subdivisions
or
incorporated
19
private
organizations
from
50
percent
to
70
percent,
and
allows
20
political
subdivisions
and
incorporated
private
organizations
21
to
use
moneys
from
the
fund
for
the
purchase,
ownership,
and
22
maintenance
of
trail
grooming
equipment.
Under
current
law,
23
the
remainder
of
the
fund
is
allocated
to
the
department
of
24
natural
resources
(DNR)
for
administration
of
snowmobile
25
programs.
The
bill
permits
the
DNR
to
donate
trail
grooming
26
equipment
owned
by
the
DNR
to
a
political
subdivision
or
27
incorporated
private
organization
receiving
moneys
from
the
28
fund
after
the
useful
life
of
the
trail
grooming
equipment
to
29
the
DNR
has
expired.
30
The
bill
exempts
from
the
snowmobile
registration
31
requirements
snowmobiles
registered
in
an
organized
special
32
event
authorized
by
the
DNR
when
such
snowmobiles
are
operated
33
within
the
boundaries
of
the
event.
