S.J.R. 4 Section 1. The following amendment to the Constitution of 1 the State of Iowa is proposed: 2 Article I of the Constitution of the State of Iowa is amended 3 by adding the following new section: 4 Right to hunt, fish, and harvest wildlife. SEC. 24A. 5 1. The citizens of this state have the right to hunt, fish, 6 and harvest wildlife, including by the use of traditional 7 methods, subject to reasonable laws enacted by the general 8 assembly and reasonable rules adopted by the state executive 9 branch to promote wildlife conservation and management, to 10 maintain natural resources held in trust by the state for 11 public use, and to preserve the future of hunting, fishing, and 12 harvesting wildlife. 13 2. Public hunting, fishing, and harvesting of wildlife 14 shall be a preferred means of managing and controlling 15 wildlife. 16 3. This section shall not be construed to modify any 17 provision of law relating to eminent domain, trespass, or 18 property rights. 19 Sec. 2. REFERRAL AND PUBLICATION. The foregoing proposed 20 amendment to the Constitution of the State of Iowa is referred 21 to the general assembly to be chosen at the next general 22 election for members of the general assembly and the secretary 23 of state is directed to cause it to be published for three 24 consecutive months before the date of the election as provided 25 by law. 26 EXPLANATION 27 The inclusion of this explanation does not constitute agreement with 28 the explanation’s substance by the members of the general assembly. 29 This joint resolution proposes an amendment to the 30 Constitution of the State of Iowa providing that the citizens 31 of this state have the right to hunt, fish, and harvest 32 wildlife, using traditional methods, subject to reasonable laws 33 enacted by the general assembly and reasonable rules adopted 34 by the state executive branch to promote wildlife conservation 35 -1- LSB 1968XS (2) 87 av/rj 1/ 2

The proposed 3 amendment further states that hunting, fishing, and harvesting 4 wildlife shall be a preferred means of managing and controlling 5 wildlife and that the proposed amendment shall not be construed 6 to modify any provision of law relating to eminent domain, 7 trespass, or property rights. 8 The proposed amendment, if adopted, would be referred to the 9 next general assembly for adoption a second time, before being 10 submitted to the electorate for ratification. 11 -2- LSB 1968XS (2) 87 av/rj 2/ 2
