S.F. 93 Section 1. Section 97B.50A, subsection 5, Code 2017, is 1 amended by striking the subsection. 2 EXPLANATION 3 The inclusion of this explanation does not constitute agreement with 4 the explanation’s substance by the members of the general assembly. 5 This bill concerns disability retirement benefits for 6 special service members under the Iowa public employees’ 7 retirement system (IPERS). 8 Current law provides that any amounts payable to a special 9 service member under any workers’ compensation, unemployment 10 compensation, employer-paid disability plan, program, or 11 policy, or disability payments the member receives pursuant to 12 the federal Social Security Act, shall be offset against and 13 payable in lieu of any disability retirement benefits payable 14 under IPERS. The bill strikes this offset provision and allows 15 a special service member to retain both the member’s non-IPERS 16 disability-related benefit payments and, if eligible, the 17 member’s disability retirement benefits under IPERS. 18 -1- LSB 1536XS (2) 87 ec/sc 1/ 1
