DAIRY REGULATION. 28 1. LOCAL FOOD AND FARM PROGRAM. 8 1. The department shall enter into a cost-sharing agreement 17 with Iowa state university of science and technology to support 18 the local food and farm program coordinator position as part of 19 the university’s cooperative extension service in agriculture 20 and home economics pursuant to chapter 267A . 21 3. Notwithstanding section 8.33 , moneys appropriated in 22 this section that remain unencumbered or unobligated at the 23 close of the fiscal year shall not revert but shall remain 24 available to be used for the purposes designated until the 25 close of the succeeding fiscal year. 26 Sec. 6. AGRICULTURAL EDUCATION. 27 1. There is appropriated from the general fund of the state 28 to the department of agriculture and land stewardship for the 29 fiscal year beginning July 1, 2017, and ending June 30, 2018, 30 the following amount, or so much thereof as is necessary, to be 31 used for the purposes designated: 32 For purposes of allocating moneys to an Iowa association 33 affiliated with a national organization which promotes 34 agricultural education providing for future farmers: 35 -3- LSB 1047SV (4) 87 da/rn 3/ 50

FARMERS WITH DISABILITIES PROGRAM. 7 1. There is appropriated from the general fund of the state 8 to the department of agriculture and land stewardship for the 9 fiscal year beginning July 1, 2017, and ending June 30, 2018, 10 the following amount, or so much thereof as is necessary, to be 11 used for the purposes designated: 12 For purposes of supporting a program for farmers with 13 disabilities: 14 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 130,000 15 2. The moneys appropriated in subsection 1 shall be used for 16 the public purpose of providing a grant to a national nonprofit 17 organization with over 80 years of experience in assisting 18 children and adults with disabilities and special needs. The 19 moneys shall be used to support a nationally recognized program 20 that began in 1986 and has been replicated in at least 30 other 21 states, but which is not available through any other entity 22 in this state, and that provides assistance to farmers with 23 disabilities in all 99 counties to allow the farmers to remain 24 in their own homes and be gainfully engaged in farming through 25 provision of agricultural worksite and home modification 26 consultations, peer support services, services to families, 27 information and referral, and equipment loan services. 28 3. Notwithstanding section 8.33 , moneys appropriated in 29 this section that remain unencumbered or unobligated at the 30 close of the fiscal year shall not revert but shall remain 31 available for expenditure for the purposes designated until the 32 close of the succeeding fiscal year. 33 DIVISION II 34 GENERAL FUND 35 -4- LSB 1047SV (4) 87 da/rn 4/ 50
S.F. 510 DEPARTMENT OF AGRICULTURE AND LAND STEWARDSHIP 1 WATER QUALITY INITIATIVE 2 APPROPRIATIONS FOR FY 2017-2018 3 Sec. 8. WATER QUALITY INITIATIVE —— GENERAL. 4 1. There is appropriated from the general fund of the state 5 to the department of agriculture and land stewardship for the 6 fiscal year beginning July 1, 2017, and ending June 30, 2018, 7 the following amount, or so much thereof as is necessary, to be 8 used for the purposes designated: 9 For deposit in the water quality initiative fund created in 10 section 466B.45 , for purposes of supporting the water quality 11 initiative administered by the division of soil conservation 12 and water quality as provided in section 466B.42 , including 13 salaries, support, maintenance, and miscellaneous purposes: 14 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 3,000,000 15 2. a. The moneys appropriated in subsection 1 shall be 16 used to support projects in subwatersheds as designated by the 17 division that are part of high-priority watersheds identified 18 by the water resources coordinating council established 19 pursuant to section 466B.3 . 20 b. The moneys appropriated in subsection 1 shall be used to 21 support projects in watersheds generally, including regional 22 watersheds, as designated by the division and high-priority 23 watersheds identified by the water resources coordinating 24 council established pursuant to section 466B.3. 25 3. In supporting projects in subwatersheds and watersheds 26 as provided in subsection 2, all of the following shall apply: 27 a. The demonstration projects shall utilize water quality 28 practices as described in the latest revision of the document 29 entitled “Iowa Nutrient Reduction Strategy” initially presented 30 in November 2012 by the department of agriculture and land 31 stewardship, the department of natural resources, and Iowa 32 state university of science and technology. 33 b. The division shall implement demonstration projects as 34 provided in paragraph “a” by providing for participation by 35 -5- LSB 1047SV (4) 87 da/rn 5/ 50
S.F. 510 persons who hold a legal interest in agricultural land used in 1 farming. To every extent practical, the division shall provide 2 for collaborative participation by such persons who hold a 3 legal interest in agricultural land located within the same 4 subwatershed. 5 c. The division shall implement a demonstration project on 6 a cost-share basis as determined by the division. However, 7 except for edge-of-field practices, the state’s share of the 8 amount shall not exceed 50 percent of the estimated cost of 9 establishing the practice as determined by the division or 10 50 percent of the actual cost of establishing the practice, 11 whichever is less. 12 d. The demonstration projects shall be used to educate other 13 persons about the feasibility and value of establishing similar 14 water quality practices. The division shall promote field day 15 events for purposes of allowing interested persons to establish 16 water quality practices on their agricultural land. 17 e. The division shall conduct water quality evaluations 18 within supported subwatersheds. Within a reasonable period 19 after accumulating information from such evaluations, the 20 division shall create an aggregated database of water quality 21 practices. Any information identifying a person holding a 22 legal interest in agricultural land or specific agricultural 23 land shall be a confidential record under section 22.7 . 24 4. The moneys appropriated in subsection 1 shall be used 25 to support education and outreach in a manner that encourages 26 persons who hold a legal interest in agricultural land used for 27 farming to implement water quality practices, including the 28 establishment of such practices in watersheds generally, and 29 not limited to subwatersheds or high-priority watersheds. 30 5. The moneys appropriated in subsection 1 may be used 31 to contract with persons to coordinate the implementation of 32 efforts provided in this section. 33 6. The moneys appropriated in subsection 1 may be used by 34 the department to support urban soil and water conservation 35 -6- LSB 1047SV (4) 87 da/rn 6/ 50
S.F. 510 efforts, which may include but are not limited to management 1 practices related to bioretention, landscaping, the use of 2 permeable or pervious pavement, and soil quality restoration. 3 The moneys shall be allocated on a cost-share basis as provided 4 in chapter 161A. 5 7. Notwithstanding any other provision of law to the 6 contrary, the department may use moneys appropriated in 7 subsection 1 to carry out the provisions of this section on a 8 cost-share basis in combination with other moneys available to 9 the department from a state or federal source. 10 8. Not more than 10 percent of the moneys appropriated in 11 this section may be used to pay for the costs of administering 12 and implementing the water quality initiative by the 13 department’s division of soil conservation and water quality as 14 provided in section 466B.42 and this section. 15 DIVISION III 16 DEPARTMENT OF NATURAL RESOURCES 17 GENERAL APPROPRIATIONS FOR FY 2017-2018 18 Sec. 9. GENERAL FUND —— DEPARTMENT. 19 1. There is appropriated from the general fund of the state 20 to the department of natural resources for the fiscal year 21 beginning July 1, 2017, and ending June 30, 2018, the following 22 amount, or so much thereof as is necessary, to be used for the 23 purposes designated: 24 For purposes of supporting the department, including its 25 divisions, for administration, regulation, and programs; for 26 salaries, support, maintenance, and miscellaneous purposes; and 27 for not more than the following full-time equivalent positions: 28 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 11,299,811 29 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . STATE FISH AND GAME PROTECTION FUND —— REGULATION 12 AND ADVANCEMENT OF OUTDOOR ACTIVITIES. 13 1. There is appropriated from the state fish and game 14 protection fund to the department of natural resources for the 15 fiscal year beginning July 1, 2017, and ending June 30, 2018, 16 the following amount, or so much thereof as is necessary, to be 17 used for the purposes designated: 18 For purposes of supporting the regulation or advancement of 19 hunting, fishing, or trapping, or the protection, propagation, 20 restoration, management, or harvest of fish or wildlife, 21 including for administration, regulation, law enforcement, and 22 programs; and for salaries, support, maintenance, equipment, 23 and miscellaneous purposes: 24 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 43,147,993 25 2. Notwithstanding section 455A.10 , the department may use 26 the unappropriated balance remaining in the state fish and game 27 protection fund to provide for the funding of health and life 28 insurance premium payments from unused sick leave balances of 29 conservation peace officers employed in a protection occupation 30 who retire, pursuant to section 97B.49B . 31 3. Notwithstanding section 455A.10 , the department of 32 natural resources may use the unappropriated balance remaining 33 in the state fish and game protection fund for the fiscal 34 year beginning July 1, 2017, and ending June 30, 2018, as is 35 -8- LSB 1047SV (4) 87 da/rn 8/ 50

VETERINARY DIAGNOSTIC LABORATORY. 8 1. Iowa state university of science and technology 20 shall not reduce the amount that it allocates to support the 21 college of veterinary medicine from any other source due to the 22 appropriation made in this section. 23 b. Paragraph “a” does not apply to a reduction made to 24 support the college of veterinary medicine, if the same 25 percentage of reduction imposed on the college of veterinary 26 medicine is also imposed on all of Iowa state university of 27 science and technology’s budget units. 28 3. If by June 30, 2018, Iowa state university of science and 29 technology fails to allocate the moneys appropriated in this 30 section to the college of veterinary medicine in accordance 31 with this section, the moneys appropriated in this section for 32 that fiscal year shall revert to the general fund of the state. 33 DIVISION V 34 ENVIRONMENT FIRST FUND 35 -11- LSB 1047SV (4) 87 da/rn 11/ 50

Of the moneys appropriated in paragraph “c”, 5 percent 19 shall be allocated for financial incentives to establish 20 practices to protect watersheds above publicly owned lakes of 21 the state from soil erosion and sediment as provided in section 22 161A.73 . 23 g. The state soil conservation committee established by 24 section 161A.4 may allocate moneys appropriated in paragraph 25 “c” to conduct research and demonstration projects to promote 26 conservation tillage and nonpoint source pollution control 27 practices. 28 h. The allocation of moneys as financial incentives as 29 provided in section 161A.73 may be used in combination with 30 moneys allocated by the department of natural resources. 31 i. Not more than 15 percent of the moneys appropriated 32 in paragraph “c” may be used for costs of administration and 33 implementation of soil and water conservation practices. 34 j. REVERSION. 21 1. a. Except as provided in paragraph “b”, and 22 notwithstanding section 8.33 , moneys appropriated for the 23 fiscal year beginning July 1, 2017, in this division of this 24 Act that remain unencumbered or unobligated at the close of the 25 fiscal year shall not revert but instead shall remain available 26 to be used for the purposes designated until the close of the 27 succeeding fiscal year, or until the project for which the 28 appropriation was made is completed, whichever is earlier. 29 b. Notwithstanding section 8.33, moneys appropriated for 30 the fiscal year beginning July 1, 2017, in this division of 31 this Act to the department of agriculture and land stewardship 32 to provide financial assistance for the establishment of 33 permanent soil and water conservation practices that remain 34 unencumbered or unobligated at the close of the fiscal year 35 -16- LSB 1047SV (4) 87 da/rn 16/ 50

Subsection 1 does not apply to moneys transferred 4 pursuant to this division to the hungry canyons account of 5 the loess hills development and conservation fund created in 6 section 161D.2 which shall not revert as provided in that 7 section. 8 DIVISION VI 9 ENVIRONMENT FIRST FUND 10 SPECIAL APPROPRIATIONS FOR FY 2017-2018 11 Sec. 20. WATER QUALITY INITIATIVE —— DEPARTMENT OF 12 AGRICULTURE AND LAND STEWARDSHIP. 13 1. There is appropriated from the environment first fund 14 created in section 8.57A to the department of agriculture 15 and land stewardship for the fiscal year beginning July 1, 16 2017, and ending June 30, 2018, the following amount, or so 17 much thereof as is necessary, to be used for the purposes 18 designated: 19 For deposit in the water quality initiative fund created in 20 section 466B.45 , for purposes of supporting the water quality 21 initiative administered by the division of soil conservation 22 and water quality as provided in section 466B.42 , including 23 salaries, support, maintenance, and miscellaneous purposes: 24 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 2,375,000 25 2. a. The moneys appropriated in subsection 1 shall be 26 used to support projects in subwatersheds as designated by the 27 division that are part of high-priority watersheds identified 28 by the water resources coordinating council established 29 pursuant to section 466B.3 . 30 b. The moneys appropriated in subsection 1 shall be used to 31 support projects in watersheds generally, including regional 32 watersheds, as designated by the division and high-priority 33 watersheds identified by the water resources coordinating 34 council established pursuant to section 466B.3. 35 -17- LSB 1047SV (4) 87 da/rn 17/ 50
S.F. 510 3. In supporting projects in subwatersheds and watersheds 1 as provided in subsection 2, all of the following shall apply: 2 a. The demonstration projects shall utilize water quality 3 practices as described in the latest revision of the document 4 entitled “Iowa Nutrient Reduction Strategy” initially presented 5 in November 2012 by the department of agriculture and land 6 stewardship, the department of natural resources, and Iowa 7 state university of science and technology. 8 b. The division shall implement demonstration projects as 9 provided in paragraph “a” by providing for participation by 10 persons who hold a legal interest in agricultural land used in 11 farming. To every extent practical, the division shall provide 12 for collaborative participation by such persons who hold a 13 legal interest in agricultural land located within the same 14 subwatershed. 15 c. The division shall implement a demonstration project on 16 a cost-share basis as determined by the division. However, 17 except for edge-of-field practices, the state’s share of the 18 amount shall not exceed 50 percent of the estimated cost of 19 establishing the practice as determined by the division or 20 50 percent of the actual cost of establishing the practice, 21 whichever is less. 22 d. The demonstration projects shall be used to educate other 23 persons about the feasibility and value of establishing similar 24 water quality practices. The division shall promote field day 25 events for purposes of allowing interested persons to establish 26 water quality practices on their agricultural land. 27 e. The division shall conduct water quality evaluations 28 within supported subwatersheds. Within a reasonable period 29 after accumulating information from such evaluations, the 30 division shall create an aggregated database of water quality 31 practices. Any information identifying a person holding a 32 legal interest in agricultural land or specific agricultural 33 land shall be a confidential record under section 22.7 . 34 4. The moneys appropriated in subsection 1 shall be used 35 -18- LSB 1047SV (4) 87 da/rn 18/ 50
S.F. 510 to support education and outreach in a manner that encourages 1 persons who hold a legal interest in agricultural land used for 2 farming to implement water quality practices, including the 3 establishment of such practices in watersheds generally, and 4 not limited to subwatersheds or high-priority watersheds. 5 5. The moneys appropriated in subsection 1 may be used 6 to contract with persons to coordinate the implementation of 7 efforts provided in this section. 8 6. The moneys appropriated in subsection 1 may be used by 9 the department to support urban soil and water conservation 10 efforts, which may include but are not limited to management 11 practices related to bioretention, landscaping, the use of 12 permeable or pervious pavement, and soil quality restoration. 13 The moneys shall be allocated on a cost-share basis as provided 14 in chapter 161A. 15 7. Notwithstanding any other provision of law to the 16 contrary, the department may use moneys appropriated in 17 subsection 1 to carry out the provisions of this section on a 18 cost-share basis in combination with other moneys available to 19 the department from a state or federal source. 20 8. Not more than 10 percent of the moneys appropriated in 21 this section may be used to pay for the costs of administering 22 and implementing the water quality initiative by the 23 department’s division of soil conservation and water quality as 24 provided in section 466B.42 and this section. 25 Sec. 21. REAP —— IN LIEU OF GENERAL FUND APPROPRIATION. 26 Notwithstanding the standing appropriation in section 455A.18, 27 there is appropriated from the environment first fund created 28 in section 8.57A to the Iowa resources enhancement and 29 protection fund, in lieu of the appropriation made in section 30 455A.18, for the fiscal year beginning July 1, 2017, and 31 ending June 30, 2018, the following amount, to be allocated as 32 provided in section 455A.19: 33 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 12,000,000 34 DIVISION VII 35 -19- LSB 1047SV (4) 87 da/rn 19/ 50
S.F. 510 ELIMINATION OF WATERSHED IMPROVEMENT REVIEW BOARD 1 SPECIAL APPROPRIATION FOR FY 2017-2018 2 RELATED STATUTORY CHANGES 3 Sec. 22. MANAGEMENT OF MONEYS IN THE WATERSHED IMPROVEMENT 4 FUND —— APPROPRIATION. 5 1. Notwithstanding section 466A.2, and the repeal of 6 chapter 466A as provided in this division of this Act, on and 7 after December 31, 2017, the department of agriculture and land 8 stewardship shall manage the watershed improvement fund in the 9 same manner as required in 2016 Acts, chapter 1134, section 10 35, including by making necessary payments to satisfy any 11 outstanding obligations incurred by the watershed improvement 12 review board prior to December 31, 2017. 13 2. Any unobligated and unencumbered moneys remaining in 14 the watershed improvement fund on December 31, 2017, are 15 appropriated to the department for use by the department in 16 providing for soil and water conservation administration, the 17 conservation of soil and water resources, or the support of 18 soil and water conservation districts in the same manner as 19 provided in the section of this Act appropriating moneys to the 20 department from the environment first fund created in section 21 8.57A. 22 Sec. 23. Section 461.33, subsection 2, paragraph a, Code 23 2017, is amended to read as follows: 24 a. Soil conservation and watershed protection, including by 25 supporting the division of soil conservation and water quality 26 within the department of agriculture and land stewardship 27 and soil and water conservation district commissioners. The 28 department may provide for the installation of conservation 29 practices and watershed protection improvements as provided in 30 chapters 161A , 161C , 461A , and 466 , and 466A . 31 Sec. 24. REPEAL. Chapter 466A, Code 2017, is repealed. 32 Sec. 25. EFFECTIVE DATES. 33 1. The remainder of the provisions in this division take 1 effect July 1, 2017. 2 DIVISION VIII 3 IOWA RESOURCES ENHANCEMENT AND PROTECTION FUND 4 SPECIAL USE OF MONEYS FOR FY 2017-2018 5 Sec. 26. OPEN SPACES ACCOUNT —— PARK MAINTENANCE AND 6 REPAIR. Notwithstanding section 455A.19, subsection 1, 7 paragraph “a”, subparagraph (1), of the moneys allocated to 8 the open spaces account of the Iowa resources enhancement and 9 protection fund, $288,000 shall be used by the department of 10 natural resources for state park maintenance and repair for 11 the fiscal year beginning July 1, 2017, and ending on June 30, 12 2018. 13 DIVISION IX 14 LIVESTOCK HEALTH SPECIAL APPROPRIATION FOR FY 2017-2018 15 GENERAL FUND —— RELATED STATUTORY CHANGES 16 Sec. 27. FOREIGN ANIMAL DISEASES AFFLICTING LIVESTOCK —— 17 APPROPRIATION. There is appropriated from the general fund of 18 the state to the department of agriculture and land stewardship 19 for the fiscal year beginning July 1, 2017, and ending June 30, 20 2018, the following amount, or so much thereof as is necessary, 21 to be used for the purposes designated: 22 1. For deposit in the foreign animal disease preparedness 23 and response fund created in section 163.3B as enacted in this 24 division of this Act: 25 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 100,000 26 2. In developing a foreign animal disease preparedness and 27 response strategy as required in section 163.3C as enacted in 28 this division of this Act, the department shall prepare an 29 interim report to be submitted to the joint appropriations 30 subcommittee on agriculture and natural resources not later 31 than January 10, 2018. The interim report shall include 32 preliminary findings and recommendations together with plans 33 for completing the strategy. The department shall prepare 34 a final report to be submitted to the joint appropriations 35 -21- LSB 1047SV (4) 87 da/rn 21/ 50
S.F. 510 subcommittee on agriculture and natural resources not later 1 than January 10, 2019. The report shall include final 2 findings and recommendations for establishing the strategy, 3 and may include any proposed notice of intended action for 4 consideration by the department or proposed legislation for 5 consideration by the general assembly. 6 Sec. 28. NEW SECTION . 163.3B Foreign animal disease 7 preparedness and response fund. 8 1. A foreign animal disease preparedness and response 9 fund is created in the state treasury under the control and 10 management of the department. 11 2. The fund shall include moneys appropriated by the general 12 assembly credited to the fund. The fund may include other 13 moneys available to and obtained or accepted by the department 14 as provided in section 159.6A, including but not limited to the 15 federal government, other public sources, or private sources. 16 3. Moneys in the fund are appropriated to the department and 17 shall be used exclusively to develop, establish, and implement 18 a foreign animal disease preparedness and response strategy 19 as described in section 163.3C, and shall not require further 20 special authorization by the general assembly. 21 4. a. Notwithstanding section 12C.7, interest or earnings 22 on moneys in the fund shall be credited to the fund. 23 b. Notwithstanding section 8.33, moneys credited to the fund 24 that remain unexpended or unobligated at the end of a fiscal 25 year shall not revert to any other fund. 26 Sec. 29. NEW SECTION . 163.3C Foreign animal disease 27 preparedness and response strategy. 28 1. As used in this section, unless the context otherwise 29 requires: 30 a. “Foreign animal disease” means a disease introduced into 31 this state that negatively affects the health of livestock 32 and is transmittable between the same or different species of 33 livestock. 34 b. “Livestock” means an animal belonging to the bovine, 35 -22- LSB 1047SV (4) 87 da/rn 22/ 50
S.F. 510 caprine, equine, ovine, or porcine species, ostriches, rheas, 1 emus; farm deer as defined in section 170.1; or turkeys, 2 chickens, or other poultry. 3 2. The department shall develop and establish a foreign 4 animal disease preparedness and response strategy for use by 5 the department in order to prevent, control, or eradicate the 6 transmission of foreign animal diseases among populations 7 of livestock. The strategy may be part of the department’s 8 veterinary emergency preparedness and response services 9 as provided in section 163.3A. The strategy shall provide 10 additional expertise and resources to increase biosecurity 11 efforts that assist in the prevention of a foreign animal 12 disease outbreak in this state. In developing and establishing 13 the strategy, the department shall consult with interested 14 persons including but not limited to the following: 15 a. The Iowa cattlemen’s association. 16 b. The Iowa state dairy association. 17 c. The Iowa pork producers association. 18 d. The Iowa sheep producers industry association. 19 e. The Iowa turkey federation. 20 f. The Iowa poultry association. 21 g. The college of veterinary medicine at Iowa state 22 university. 23 h. The livestock health advisory council created in section 24 267.2. 25 3. The department shall implement the foreign animal 26 disease preparedness and response strategy if necessary 27 to prevent, control, or eradicate the transmission and 28 incidence of foreign animal diseases that may threaten or 29 actually threaten livestock in this state. In implementing 30 the strategy, the department may utilize emergency response 31 measures as otherwise required under section 163.3A. The 32 department may but is not required to consult with interested 33 persons when implementing the strategy. 34 DIVISION X 35 -23- LSB 1047SV (4) 87 da/rn 23/ 50
S.F. 510 APPROPRIATION AND STATUTORY CHANGES —— ELIMINATION 1 OF LEOPOLD CENTER FOR SUSTAINABLE AGRICULTURE 2 Sec. 30. Section 266.39A, Code 2017, is amended to read as 3 follows: 4 266.39A Agricultural research. 5 Iowa state university of science and technology shall 6 conduct continuing agricultural research to provide information 7 about environmental and social impacts of agricultural research 8 on the small or family farm and information about population 9 trends and impact of the trends on Iowa agriculture , in 10 addition to research that may include the categories specified 11 in section 266.39B, subsection 2 . The research shall include 12 an agricultural land tenure study conducted every five years to 13 determine the ownership of farmland, and to analyze ownership 14 trends, using the categories of land ownership defined in 15 chapter 9H . The study shall be conducted on the basis of 16 regions established by the university. A region shall be 17 composed of not more than twenty-three contiguous counties. 18 Sec. 31. Section 455E.11, subsection 2, paragraph b, 19 subparagraph (3), subparagraph division (a), Code 2017, is 20 amended to read as follows: 21 (a) Thirty-five percent is appropriated annually for 22 the Leopold center for sustainable agriculture at Iowa state 23 university of science and technology to the Iowa nutrient 24 research fund created in section 466B.46 . 25 Sec. 32. Section 466B.46, subsection 2, Code 2017, is 26 amended by adding the following new paragraph: 27 NEW PARAGRAPH . 0b. Moneys appropriated from the agriculture 28 management account of the groundwater protection fund pursuant 29 to section 455E.11, subsection 2, paragraph “b” , subparagraph 30 (3), subparagraph division (a). 31 Sec. 33. ONGOING ACTIVITIES AND EXPENSES. 32 1. Until July 1, 2017, the Leopold center for sustainable 33 agriculture established in section 266.39 shall not initiate 34 any new activity that otherwise could be conducted under 35 -24- LSB 1047SV (4) 87 da/rn 24/ 50
S.F. 510 section 266.39 or 266.39B, including but not limited to 1 research grants and projects. The Leopold center for 2 sustainable agriculture shall not incur any obligation or 3 expense unless approved by the college of agriculture and life 4 sciences at Iowa state university of science and technology. 5 The Leopold center for sustainable agriculture shall cancel 6 any existing grant or project that is not in the process of 7 being immediately completed. However, the Leopold center 8 for sustainable agriculture shall not cancel a grant or 9 project that would result in a default of a legal or equitable 10 obligation, including breach of contract. 11 2. On and after July 1, 2017, the college of agriculture 12 and life sciences at Iowa state university of science and 13 technology shall administer any ongoing activity that the 14 Leopold center for sustainable agriculture had administered 15 under section 266.39 or 266.39B prior to that date. The 16 college may expend moneys appropriated from the Iowa nutrient 17 research fund created in section 466B.46 in order to pay for 18 any necessary expenses associated with the Leopold center 19 for sustainable agriculture and for completing any ongoing 20 activity. The college shall cancel any existing grant 21 or project that is not in the process of being completed. 22 However, the college shall not cancel a grant or project that 23 would result in a default of a legal or equitable obligation, 24 including breach of contract. The college shall submit a 25 report to the general assembly by January 10, 2018, which 26 shall include a summary of the ongoing activities and expenses 27 described in this section and the expected completion date of 28 those activities and expenses. 29 Sec. 34. REPEAL. Sections 266.39 and 266.39B, Code 2017, 30 are repealed. 31 Sec. 35. EFFECTIVE DATES. 32 1. The section of this division of this Act providing for 33 ongoing activities and expenses, being deemed of immediate 34 importance, takes effect upon enactment. 35 -25- LSB 1047SV (4) 87 da/rn 25/ 50

GENERAL FUND —— DEPARTMENT. 7 1. The 22 moneys shall be used to support a nationally recognized program 23 that began in 1986 and has been replicated in at least 30 other 24 states, but which is not available through any other entity 25 in this state, and that provides assistance to farmers with 26 disabilities in all 99 counties to allow the farmers to remain 27 in their own homes and be gainfully engaged in farming through 28 provision of agricultural worksite and home modification 29 consultations, peer support services, services to families, 30 information and referral, and equipment loan services. 31 3. Notwithstanding section 8.33 , moneys appropriated in 32 this section that remain unencumbered or unobligated at the 33 close of the fiscal year shall not revert but shall remain 34 available for expenditure for the purposes designated until the 35 -29- LSB 1047SV (4) 87 da/rn 29/ 50
S.F. 510 close of the succeeding fiscal year. 1 DIVISION XII 2 GENERAL FUND 3 DEPARTMENT OF AGRICULTURE AND LAND STEWARDSHIP 4 WATER QUALITY INITIATIVE 5 APPROPRIATIONS FOR FY 2018-2019 6 Sec. 43. WATER QUALITY INITIATIVE —— GENERAL. 7 1. There is appropriated from the general fund of the state 8 to the department of agriculture and land stewardship for the 9 fiscal year beginning July 1, 2018, and ending June 30, 2019, 10 the following amount, or so much thereof as is necessary, to be 11 used for the purposes designated: 12 For deposit in the water quality initiative fund created in 13 section 466B.45 , for purposes of supporting the water quality 14 initiative administered by the division of soil conservation 15 and water quality as provided in section 466B.42 , including 16 salaries, support, maintenance, and miscellaneous purposes: 17 . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 1,500,000 18 2. a. The moneys appropriated in subsection 1 shall be 19 used to support projects in subwatersheds as designated by the 20 division that are part of high-priority watersheds identified 21 by the water resources coordinating council established 22 pursuant to section 466B.3 . 23 b. The moneys appropriated in subsection 1 shall be used to 24 support projects in watersheds generally, including regional 25 watersheds, as designated by the division and high-priority 26 watersheds identified by the water resources coordinating 27 council established pursuant to section 466B.3. 28 3. In supporting projects in subwatersheds and watersheds 29 as provided in subsection 2, all of the following shall apply: 30 a. The demonstration projects shall utilize water quality 31 practices as described in the latest revision of the document 32 entitled “Iowa Nutrient Reduction Strategy” initially presented 33 in November 2012 by the department of agriculture and land 34 stewardship, the department of natural resources, and Iowa 35 -30- LSB 1047SV (4) 87 da/rn 30/ 50
S.F. 510 state university of science and technology. 1 b. The division shall implement demonstration projects as 2 provided in paragraph “a” by providing for participation by 3 persons who hold a legal interest in agricultural land used in 4 farming. To every extent practical, the division shall provide 5 for collaborative participation by such persons who hold a 6 legal interest in agricultural land located within the same 7 subwatershed. 8 c. The division shall implement a demonstration project on 9 a cost-share basis as determined by the division. However, 10 except for edge-of-field practices, the state’s share of the 11 amount shall not exceed 50 percent of the estimated cost of 12 establishing the practice as determined by the division or 13 50 percent of the actual cost of establishing the practice, 14 whichever is less. 15 d. The demonstration projects shall be used to educate other 16 persons about the feasibility and value of establishing similar 17 water quality practices. The division shall promote field day 18 events for purposes of allowing interested persons to establish 19 water quality practices on their agricultural land. 20 e. The division shall conduct water quality evaluations 21 within supported subwatersheds. Within a reasonable period 22 after accumulating information from such evaluations, the 23 division shall create an aggregated database of water quality 24 practices. Any information identifying a person holding a 25 legal interest in agricultural land or specific agricultural 26 land shall be a confidential record under section 22.7 . 27 4. The moneys appropriated in subsection 1 shall be used 28 to support education and outreach in a manner that encourages 29 persons who hold a legal interest in agricultural land used for 30 farming to implement water quality practices, including the 31 establishment of such practices in watersheds generally, and 32 not limited to subwatersheds or high-priority watersheds. 33 5. The moneys appropriated in subsection 1 may be used 34 to contract with persons to coordinate the implementation of 35 -31- LSB 1047SV (4) 87 da/rn 31/ 50
S.F. 510 efforts provided in this section. 1 6. The moneys appropriated in subsection 1 may be used by 2 the department to support urban soil and water conservation 3 efforts, which may include but are not limited to management 4 practices related to bioretention, landscaping, the use of 5 permeable or pervious pavement, and soil quality restoration. 6 The moneys shall be allocated on a cost-share basis as provided 7 in chapter 161A. 8 7. Notwithstanding any other provision of law to the 9 contrary, the department may use moneys appropriated in 10 subsection 1 to carry out the provisions of this section on a 11 cost-share basis in combination with other moneys available to 12 the department from a state or federal source. 13 8. Not more than 10 percent of the moneys appropriated in 14 this section may be used to pay for the costs of administering 15 and implementing the water quality initiative by the 16 department’s division of soil conservation and water quality as 17 provided in section 466B.42 and this section. 18 DIVISION XIII 19 DEPARTMENT OF NATURAL RESOURCES 20 GENERAL APPROPRIATIONS FOR FY 2018-2019 21 Sec. 44. GENERAL FUND —— DEPARTMENT. 22 1. WATER QUALITY INITIATIVE —— DEPARTMENT OF 9 AGRICULTURE AND LAND STEWARDSHIP. 10 1. The moneys appropriated in subsection 1 shall be 23 used to support projects in subwatersheds as designated by the 24 division that are part of high-priority watersheds identified 25 by the water resources coordinating council established 26 pursuant to section 466B.3 . 27 b. The moneys appropriated in subsection 1 shall be used to 28 support projects in watersheds generally, including regional 29 watersheds, as designated by the division and high-priority 30 watersheds identified by the water resources coordinating 31 council established pursuant to section 466B.3. 32 3. In supporting projects in subwatersheds and watersheds 33 as provided in subsection 2, all of the following shall apply: 34 a. The demonstration projects shall utilize water quality 35 -42- LSB 1047SV (4) 87 da/rn 42/ 50
S.F. 510 practices as described in the latest revision of the document 1 entitled “Iowa Nutrient Reduction Strategy” initially presented 2 in November 2012 by the department of agriculture and land 3 stewardship, the department of natural resources, and Iowa 4 state university of science and technology. 5 b. The division shall implement demonstration projects as 6 provided in paragraph “a” by providing for participation by 7 persons who hold a legal interest in agricultural land used in 8 farming. To every extent practical, the division shall provide 9 for collaborative participation by such persons who hold a 10 legal interest in agricultural land located within the same 11 subwatershed. 12 c. The division shall implement a demonstration project on 13 a cost-share basis as determined by the division. However, 14 except for edge-of-field practices, the state’s share of the 15 amount shall not exceed 50 percent of the estimated cost of 16 establishing the practice as determined by the division or 17 50 percent of the actual cost of establishing the practice, 18 whichever is less. 19 d. The demonstration projects shall be used to educate other 20 persons about the feasibility and value of establishing similar 21 water quality practices. The division shall promote field day 22 events for purposes of allowing interested persons to establish 23 water quality practices on their agricultural land. 24 e. The division shall conduct water quality evaluations 25 within supported subwatersheds. Within a reasonable period 26 after accumulating information from such evaluations, the 27 division shall create an aggregated database of water quality 28 practices. Any information identifying a person holding a 29 legal interest in agricultural land or specific agricultural 30 land shall be a confidential record under section 22.7 . 31 4. The moneys appropriated in subsection 1 shall be used 32 to support education and outreach in a manner that encourages 33 persons who hold a legal interest in agricultural land used for 34 farming to implement water quality practices, including the 35 -43- LSB 1047SV (4) 87 da/rn 43/ 50
S.F. 510 establishment of such practices in watersheds generally, and 1 not limited to subwatersheds or high-priority watersheds. 2 5. The moneys appropriated in subsection 1 may be used 3 to contract with persons to coordinate the implementation of 4 efforts provided in this section. 5 6. The moneys appropriated in subsection 1 may be used by 6 the department to support urban soil and water conservation 7 efforts, which may include but are not limited to management 8 practices related to bioretention, landscaping, the use of 9 permeable or pervious pavement, and soil quality restoration. 10 The moneys shall be allocated on a cost-share basis as provided 11 in chapter 161A. 12 7. Notwithstanding any other provision of law to the 13 contrary, the department may use moneys appropriated in 14 subsection 1 to carry out the provisions of this section on a 15 cost-share basis in combination with other moneys available to 16 the department from a state or federal source. 17 8. Not more than 10 percent of the moneys appropriated in 18 this section may be used to pay for the costs of administering 19 and implementing the water quality initiative by the 20 department’s division of soil conservation and water quality as 21 provided in section 466B.42 and this section. 22 EXPLANATION 23 The inclusion of this explanation does not constitute agreement with 24 the explanation’s substance by the members of the general assembly. 25 GENERAL. This bill relates to agriculture and natural 26 resources by making appropriations for the fiscal years 27 2017-2018 and 2018-2019 to support related entities, including 28 the department of agriculture and land stewardship (DALS), 29 the department of natural resources (DNR), and Iowa state 30 university (ISU). 31 The bill primarily appropriates moneys to DALS and DNR. 32 The appropriations are made to support those departments for 33 administration, regulation, and support of programs. The bill 34 requires the departments to submit quarterly reports to the 35 -44- LSB 1047SV (4) 87 da/rn 44/ 50
S.F. 510 general assembly and department of management regarding the 1 expenditure of appropriated moneys. The bill also provides 2 moneys to support specific programs or projects administered by 3 those departments. The bill appropriates moneys from a number 4 of sources, including the general fund of the state (general 5 fund), the state fish and game protection fund, the groundwater 6 protection fund (Code section 455E.11), and the environment 7 first fund (EFF) (Code section 8.57A). Special appropriations 8 are made from the open spaces account of the Iowa resources 9 enhancement and protection fund (REAP) (Code sections 455A.18 10 and 455A.19). Appropriations are made from a number of sources 11 to support the water quality initiative (WQI) (Code chapter 12 466B). The bill is organized into divisions. 13 DALS —— GENERAL FUND APPROPRIATIONS —— FY 2017-2018. The 14 bill appropriates moneys to DALS from the general fund for FY 15 2017-2018 in order to support its administrative divisions, 16 including consumer protection and industry services, soil 17 conservation, and food safety and animal health. Moneys are 18 transferred to ISU to support its midwest grape and wine 19 institute. 20 DALS —— MISCELLANEOUS FUNDS —— DESIGNATED APPROPRIATIONS 21 —— FY 2017-2018. The bill appropriates moneys from several 22 sources for FY 2017-2018 to support a number of designated 23 purposes, including moneys derived from unclaimed winnings from 24 horse and dog races, for administration and enforcement of 25 racing regulations (Code section 99D.22); and moneys credited 26 to the renewable fuel infrastructure fund (Code section 27 159A.16), for purposes of motor fuel inspection and auditing 28 biofuel processing and production (Code chapter 214A). 29 DALS —— SPECIAL GENERAL FUND APPROPRIATIONS —— FY 2017-2018. 30 The bill also makes special appropriations from the general 31 fund for FY 2017-2018 to DALS in order to support specific 32 purposes including milk inspection (Code section 192.109), 33 the local food and farm program (Code chapter 267A), an 34 agricultural education organization, and assistance to farmers 35 -45- LSB 1047SV (4) 87 da/rn 45/ 50

The bill makes appropriations from a number 8 of funds for FY 2017-2018 to DNR in order to support its 9 administrative divisions involving natural resources and 10 environmental protection from the general fund, the state fish 11 and game protection fund, and the groundwater protection fund. 12 DNR —— MISCELLANEOUS FUNDS —— DESIGNATED APPROPRIATIONS —— 13 FY 2017-2018. The bill appropriates moneys for FY 2017-2018 to 14 DNR from a number of sources to support designated purposes, 15 including moneys deposited in the special snowmobile fund 16 (Code section 321G.7) to provide for administering and 17 enforcing the state snowmobile programs; and moneys deposited 18 in the unassigned revenue fund for purposes of paying for 19 administration of DNR’s underground storage tanks section. 20 DNR —— SPECIAL GENERAL FUND APPROPRIATIONS —— FY 2017-2018. 21 The bill also makes special appropriations from the general 22 fund for FY 2017-2018 to DNR in order to support specific 23 purposes including floodplain management and dam safety and 24 forestry health management programs. 25 ISU —— SPECIAL GENERAL FUND APPROPRIATIONS —— FY 2017-2018. 26 The bill appropriates moneys from the general fund for FY 27 2017-2018 to ISU to support the operation of its veterinary 28 diagnostic laboratory. 29 DALS AND DNR —— EFF —— GENERAL APPROPRIATIONS —— FY 30 2017-2018. The bill appropriates moneys from the EFF for FY 31 2017-2018 to support a number of programs administered by DALS 32 and DNR. For DALS, the moneys are appropriated to support 33 programs involving soil conservation, watershed protection 34 and nutrient management, and the loess hills development and 35 -46- LSB 1047SV (4) 87 da/rn 46/ 50

For DNR, moneys 1 are appropriated to support programs involving state parks, 2 geographic information systems, water quality monitoring, 3 public water supplies, regulation of animal feeding operations, 4 air quality, water quality regulation, and the geological and 5 water survey. The bill includes provisions that delay the 6 reversion of these moneys. The reversion of the appropriated 7 moneys is delayed. 8 EFF —— SPECIAL APPROPRIATIONS FOR WQI AND REAP —— FY 9 2018-2019. The bill appropriates moneys from the EFF for FY 10 2017-2018 to the water quality initiative fund subject to the 11 same conditions applicable to moneys appropriated to the fund 12 from the general fund. Moneys are appropriated to support REAP 13 from the EFF in lieu of the general fund. 14 DALS —— WATERSHED IMPROVEMENT FUND —— ADMINISTRATION 15 AND RELATED STATUTORY CHANGES TO ELIMINATE THE WATERSHED 16 IMPROVEMENT REVIEW BOARD. The bill eliminates powers, duties, 17 and funding for the watershed improvement review board. DALS 18 is required to manage the watershed improvement fund and make 19 necessary payments to satisfy outstanding obligations incurred 20 by the board prior to December 31, 2017. Any unobligated and 21 unencumbered moneys remaining in the fund are appropriated to 22 DALS to support soil conservation efforts. 23 DNR —— OPEN SPACES ACCOUNT OF REAP —— PARK MAINTENANCE AND 24 REPAIR —— FY 2017-2018. A portion of moneys allocated to 25 REAP’s open spaces account are to be used by DNR for state park 26 maintenance and repair. 27 DALS —— GENERAL FUND —— LIVESTOCK HEALTH AND RELATED 28 STATUTORY CHANGES —— FY 2017-2018. The bill appropriates 29 moneys from the general fund for FY 2017-2018 to DALS for 30 purposes of developing a foreign animal disease preparedness 31 and response strategy and for the possible implementation of 32 that strategy.
