S.F. 498 Section 1. SUBSTANCE ABUSE APPROPRIATION. 1 1. The appropriations made in this subsection are in the 8 amounts anticipated to be received from the federal government 9 for the designated federal fiscal years under 42 U.S.C., ch. 10 6A, subch. XVII, part B, subpart ii, which provides for the 11 prevention and treatment of substance abuse block grant. 12 The department shall expend the funds appropriated in this 13 subsection as provided in the federal law making the funds 14 available and in conformance with chapter 17A . 15 b. Of the funds appropriated for each federal fiscal year 16 in this subsection, an amount not exceeding 5 percent shall be 17 used by the department for administrative expenses. 18 c. (1) For the state fiscal year beginning July 1, 2017, 19 the department shall expend no less than an amount equal to 20 the amount expended for treatment services in the state fiscal 21 year beginning July 1, 2016, for pregnant women and women with 22 dependent children. 23 (2) For the state fiscal year beginning July 1, 2018, the 24 department shall expend no less than an amount equal to the 25 amount expended for treatment services in the state fiscal 26 year beginning July 1, 2017, for pregnant women and women with 27 dependent children. 28 2. At least 20 percent of the funds remaining from the 29 appropriation made in subsection 1 for each federal fiscal year 30 shall be allocated for prevention programs. 31 3. In implementing the federal prevention and treatment of 32 substance abuse block grant under 42 U.S.C., ch. 6A, subch. 33 XVII, and any other applicable provisions of the federal Public 34 Health Service Act under 42 U.S.C., ch. 6A, the department 35 -1- LSB 2661SV (2) 87 rn/tm 1/ 20
S.F. 498 shall apply the provisions of Pub. L. No. 106-310, §3305, 1 as codified in 42 U.S.C. §300x-65, relating to services 2 under such federal law being provided by religious and other 3 nongovernmental organizations. 4 Sec. 2. COMMUNITY MENTAL HEALTH SERVICES APPROPRIATION. 5 1. a. The appropriations made in this subsection are in the 12 amounts anticipated to be received from the federal government 13 for the designated federal fiscal years under 42 U.S.C., ch. 14 6A, subch. XVII, part B, subpart i, which provides for the 15 community mental health services block grant. The department 16 shall expend the funds appropriated in this subsection as 17 provided in the federal law making the funds available and in 18 conformance with chapter 17A . 19 c. The department shall allocate not less than 95 percent 20 of the amount of the block grant each federal fiscal year for 21 eligible community mental health services for carrying out the 22 plan submitted to and approved by the federal substance abuse 23 and mental health services administration for the fiscal year 24 involved. 25 d. Of the amount allocated to eligible services providers 26 in paragraph “c”, 70 percent of the amount each federal fiscal 27 year shall be distributed to the state’s accredited community 28 mental health centers established in accordance with chapter 29 230A or applicable administrative rule. If a mental health 30 services provider was designated as authorized in section 31 230A.107, subsection 2, the provider remains eligible to 32 receive funding distributed pursuant to this paragraph as 33 a community mental health center. The funding distributed 34 shall be used by recipients of the funding for the purpose of 35 -2- LSB 2661SV (2) 87 rn/tm 2/ 20
S.F. 498 staff training or services to adults with a serious mental 1 illness and children with a serious emotional disturbance. 2 The distribution amounts shall be announced at the beginning 3 of the federal fiscal year and distributed on a quarterly 4 basis. Recipients shall submit quarterly reports containing 5 data consistent with the performance measures approved 6 by the federal substance abuse and mental health services 7 administration. 8 2. An amount not exceeding 5 percent of the funds 9 appropriated in subsection 1 for each federal fiscal year shall 10 be used by the department of human services for administrative 11 expenses. From the funds set aside by this subsection for 12 administrative expenses, the department shall pay to the 13 auditor of state an amount sufficient to pay the cost of 14 auditing the use and administration of the state’s portion of 15 the funds appropriated in subsection 1. The auditor of state 16 shall bill the department for the costs of the audits. 17 Sec. 3. MATERNAL AND CHILD HEALTH SERVICES APPROPRIATIONS. 18 1. The appropriations made in this subsection are in the 25 amounts anticipated to be received from the federal government 26 for the designated federal fiscal years under 42 U.S.C., ch. 27 7, subch. V, which provides for the maternal and child health 28 services block grant. The department shall expend the funds 29 appropriated in this subsection as provided in the federal law 30 making the funds available and in conformance with chapter 17A . 31 b. Funds appropriated in this subsection shall not be used 32 by the university of Iowa hospitals and clinics for indirect 33 costs. 34 2. An amount not exceeding 10 percent of the funds 35 -3- LSB 2661SV (2) 87 rn/tm 3/ 20
S.F. 498 appropriated in subsection 1 for each federal fiscal year shall 1 be used by the department of public health for administrative 2 expenses. 3 3. The departments of public health, human services, and 4 education and the university of Iowa’s mobile and regional 5 child health specialty clinics shall continue to pursue to the 6 maximum extent feasible the coordination and integration of 7 services to women and children. 8 4. a. Sixty-three percent of the amount remaining after 9 the allocation made in subsection 2 for each federal fiscal 10 year shall be allocated to supplement appropriations for 11 maternal and child health programs within the department of 12 public health. Thirty-seven percent of the amount remaining after 18 the allocation made in subsection 2 for each federal fiscal 19 year shall be allocated to the university of Iowa hospitals 20 and clinics under the control of the state board of regents 21 for mobile and regional child health specialty clinics. The 22 university of Iowa hospitals and clinics shall not receive an 23 allocation for indirect costs from the funds for this program. 24 Priority shall be given to establishment and maintenance of a 25 statewide system of mobile and regional child health specialty 26 clinics. 27 5. The department of public health shall administer the 28 statewide maternal and child health program and the disabled 29 children’s program by conducting mobile and regional child 30 health specialty clinics and conducting other activities to 31 improve the health of low-income women and children and to 32 promote the welfare of children with actual or potential 33 handicapping conditions and chronic illnesses in accordance 34 with the requirements of Tit. XVII, part A, which provides for the preventive 13 health and health services block grant. The department shall 14 expend the funds appropriated in this subsection as provided in 15 the federal law making the funds available and in conformance 16 with chapter 17A . 17 2. Of the funds appropriated in subsection 1 for each 18 federal fiscal year, an amount not exceeding 10 percent shall 19 be used by the department for administrative expenses. 20 3. Of the funds appropriated in subsection 1 for each 21 federal fiscal year, the specific amount of funds stipulated 22 by the notice of the block grant award shall be allocated for 23 services to victims of sex offenses and for rape prevention 24 education. 25 4. After deducting the funds allocated in subsections 2 and 26 3, the remaining funds appropriated in subsection 1 for each 27 federal fiscal year may be used by the department for healthy 28 people 2020 and Iowa’s health improvement plan 2012-2016 29 program objectives, preventive health advisory committee, and 30 risk reduction services, including nutrition programs, health 31 incentive programs, chronic disease services, emergency medical 32 services, monitoring of the fluoridation program and start-up 33 fluoridation grants, and acquired immune deficiency syndrome 34 services. The moneys specified in this subsection shall not be 35 -5- LSB 2661SV (2) 87 rn/tm 5/ 20
S.F. 498 used by the university of Iowa hospitals and clinics or by the 1 state hygienic laboratory for the funding of indirect costs. 2 Sec. 5. STOP VIOLENCE AGAINST WOMEN GRANT PROGRAM 3 APPROPRIATION. 4 1. XII-H which provides for grants to combat violent 14 crimes against women. The department of justice shall expend 15 the funds appropriated in this subsection as provided in the 16 federal law making the funds available and in conformance with 17 chapter 17A . 18 2. An amount not exceeding 10 percent of the funds 19 appropriated in subsection 1 shall be used by the department of 20 justice for administrative expenses. From the funds set aside 21 by this subsection for administrative expenses, the department 22 shall pay to the auditor of state an amount sufficient to pay 23 the cost of auditing the use and administration of the state’s 24 portion of the funds appropriated in subsection 1. 25 Sec. 6. RESIDENTIAL SUBSTANCE ABUSE TREATMENT FOR STATE 26 PRISONERS FORMULA GRANT PROGRAM. The drug 3 policy coordinator shall expend the funds appropriated in this 4 section as provided in federal law making the funds available 5 and in conformance with chapter 17A . 6 Sec. 7. EDWARD BYRNE MEMORIAL JUSTICE ASSISTANCE GRANT 7 PROGRAM APPROPRIATION. COMMUNITY SERVICES APPROPRIATIONS. 22 1. a. S.F. 498 subsection as provided in the federal law making the funds 1 available and in conformance with chapter 17A . 2 b. Each federal fiscal year, the administrator of the 3 division of community action agencies of the department 4 of human rights shall allocate not less than 96 percent of 5 the amount of the block grants to eligible community action 6 agencies for programs benefiting low-income persons. Each 7 eligible agency shall receive a minimum allocation of not 8 less than $100,000. The minimum allocation shall be achieved 9 by redistributing increased funds from agencies experiencing 10 a greater share of available funds. The funds shall be 11 distributed on the basis of the poverty-level population in the 12 area represented by the community action areas compared to the 13 size of the poverty-level population in the state. 14 2. An amount not exceeding 4 percent of the funds 15 appropriated in subsection 1 for each federal fiscal year shall 16 be used by the division of community action agencies of the 17 department of human rights for administrative expenses. From 18 the funds set aside by this subsection for administrative 19 expenses, the division of community action agencies of the 20 department of human rights shall pay to the auditor of state 21 an amount sufficient to pay the cost of auditing the use and 22 administration of the state’s portion of the funds appropriated 23 in subsection 1. The auditor of state shall bill the division 24 of community action agencies for the costs of the audits. 25 Sec. 9. COMMUNITY DEVELOPMENT APPROPRIATIONS. 26 1. S.F. 498 69, which provides for community development block grants. 1 The economic development authority shall expend the funds 2 appropriated in this subsection as provided in the federal law 3 making the funds available and in conformance with chapter 17A . 4 2. a. An amount not exceeding $1,000,000 for the federal 5 fiscal year beginning October 1, 2017, shall be used by the 6 economic development authority for administrative expenses for 7 the community development block grant. The total amount used 8 for administrative expenses includes $550,000 for the federal 9 fiscal year beginning October 1, 2017, of funds appropriated 10 in subsection 1 and a matching contribution from the state 11 equal to $450,000 from the appropriation of state funds for 12 the community development block grant and state appropriations 13 for related activities of the economic development authority. 14 From the funds set aside for administrative expenses by this 15 subsection, the economic development authority shall pay to 16 the auditor of state an amount sufficient to pay the cost of 17 auditing the use and administration of the state’s portion of 18 the funds appropriated in subsection 1. The auditor of state 19 shall bill the authority for the costs of the audit. 20 b. An amount not exceeding $1,000,000 for the federal 21 fiscal year beginning October 1, 2018, shall be used by the 22 economic development authority for administrative expenses for 23 the community development block grant. The total amount used 24 for administrative expenses includes $550,000 for the federal 25 fiscal year beginning October 1, 2018, of funds appropriated 26 in subsection 1 and a matching contribution from the state 27 equal to $450,000 from the appropriation of state funds for 28 the community development block grant and state appropriations 29 for related activities of the economic development authority. 30 From the funds set aside for administrative expenses by this 31 subsection, the economic development authority shall pay to 32 the auditor of state an amount sufficient to pay the cost of 33 auditing the use and administration of the state’s portion of 34 the funds appropriated in subsection 1. L. No. 113-2, 11 Disaster Relief Appropriations Act of 2013. 12 2. The economic development authority shall expend the 13 funds appropriated in this section to make Iowa communities 14 more resilient to flooding and improve Iowa’s water quality as 15 provided in the federal law making the funds available and in 16 conformance with chapter 17A. 17 3. An amount not exceeding 3 percent of the funds 18 appropriated in subsection 1 shall be used by the authority 19 for administrative expenses. From the funds set aside by this 20 subsection for administrative expenses, the authority shall pay 21 to the auditor of state an amount sufficient to pay the cost of 22 auditing the use and administration of the state’s portion of 23 the funds appropriated in subsection 1. 24 Sec. 11. SURFACE TRANSPORTATION BLOCK GRANT PROGRAM 25 APPROPRIATION. The 1 department shall expend the moneys appropriated in this section 2 as provided in the federal law making the funds available and 3 in conformance with chapter 17A. 4 Sec. 12. LOW-INCOME HOME ENERGY ASSISTANCE APPROPRIATIONS. 5 1. There is appropriated from the fund created by section 6 8.41 to the division of community action agencies of the 7 department of human rights for the following federal fiscal 8 years beginning October 1, and ending September 30, the 9 following amounts: 10 FFY 2017-2018: . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 52,905,010 11 FFY 2018-2019: . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . . $ 52,905,010 12 The appropriations made in this subsection are in the 13 amounts anticipated to be received from the federal government 14 for the designated federal fiscal years under 42 U.S.C., ch. 15 94, subch. II, which provides for the low-income home energy 16 assistance block grants. The division of community action 17 agencies of the department of human rights shall expend the 18 funds appropriated in this subsection as provided in the 19 federal law making the funds available and in conformance with 20 chapter 17A . 21 2. Up to 15 percent, or up to 25 percent if a waiver is 22 approved by the United States department of health and human 23 services, of the amount appropriated in this section that is 24 actually received for each federal fiscal year shall be used 25 for residential weatherization or other related home repairs 26 for low-income households. Of this allocation amount, not more 27 than 10 percent may be used for administrative expenses. 28 3. After subtracting the allocation in subsection 2, up to 29 10 percent of the remaining moneys for each federal fiscal year 30 are allocated for administrative expenses of the low-income 31 home energy assistance program of which $377,000 is allocated 32 each federal fiscal year for administrative expenses of the 33 division. The costs of auditing the use and administration 34 of the portion of the appropriation in this section that is 35 -11- LSB 2661SV (2) 87 rn/tm 11/ 20
S.F. 498 retained by the state shall be paid from the amount allocated 1 in this subsection each federal fiscal year to the division. 2 The auditor of state shall bill the division for the audit 3 costs. 4 4. The remaining moneys of the appropriation made in this 5 section for each federal fiscal year following the allocations 6 made in subsections 2 and 3, shall be used to help eligible 7 households as defined in 42 U.S.C., ch. 94, subch. II, to meet 8 home energy costs. 9 5. Not more than 10 percent of the amount appropriated in 10 this section each federal fiscal year that is actually received 11 may be carried forward for use in the succeeding federal fiscal 12 year. 13 6. Expenditures for assessment and resolution of energy 14 problems shall be limited to not more than 5 percent of the 15 amount appropriated in this section for each federal fiscal 16 year that is actually received. 17 Sec. 13. SOCIAL SERVICES APPROPRIATIONS. 18 1. SOCIAL SERVICES BLOCK GRANT PLAN. The department 17 of human services during each state fiscal year shall develop a 18 plan for the use of federal social services block grant funds 19 for the subsequent state fiscal year. 20 The proposed plan shall include all programs and services 21 at the state level which the department proposes to fund with 22 federal social services block grant funds, and shall identify 23 state and other funds which the department proposes to use to 24 fund the state programs and services. 25 The proposed plan shall also include all local programs and 26 services which are eligible to be funded with federal social 27 services block grant funds, the total amount of federal social 28 services block grant funds available for the local programs and 29 services, and the manner of distribution of the federal social 30 services block grant funds to the counties. The proposed plan 31 shall identify state and local funds which will be used to fund 32 the local programs and services. 33 The proposed plan shall be submitted with the department’s 34 budget requests to the governor and the general assembly. 35 -14- LSB 2661SV (2) 87 rn/tm 14/ 20
S.F. 498 Sec. 15. PROJECTS FOR ASSISTANCE IN TRANSITION FROM 1 HOMELESSNESS. 2 1. Upon receipt of the minimum formula grant from 3 the federal substance abuse and mental health services 4 administration to provide mental health services for the 5 homeless, for the federal fiscal years beginning October 1, 6 2017, and October 1, 2018, the department of human services 7 shall assure that a project which receives funds under the 8 formula grant shall do all of the following: 9 a. Provide outreach and engagement to homeless individuals 10 and individuals at risk of homelessness and assesses those 11 individuals for serious mental illness. 12 b. Enroll those individuals with serious mental illness who 13 are willing to accept services through the project. 14 c. Provide case management to homeless persons. 15 d. Provide appropriate training to persons who provide 16 services to persons targeted by the grant. 17 e. Assure a local match share of 25 percent. 18 f. Refer homeless individuals and individuals at risk of 19 homelessness to primary health care, job training, educational 20 services, and relevant housing services. 21 2. A project may expend funds for community mental health 22 services, diagnostic services, crisis intervention services, 23 habilitation and rehabilitation services, substance-related 24 disorder services, supportive and supervisory services to 25 homeless persons living in residential settings that are 26 not otherwise supported, and housing services including 27 minor renovation, expansion, and repair of housing, security 28 deposits, planning of housing, technical assistance in 29 applying for housing, improving the coordination of housing 30 services, the costs associated with matching eligible homeless 31 individuals with appropriate housing, and one-time rental 32 payments to prevent eviction. 33 Sec. 16. CHILD CARE AND DEVELOPMENT APPROPRIATION. There 34 is appropriated from the fund created by section 8.41 to 35 -15- LSB 2661SV (2) 87 rn/tm 15/ 20

II-B, which provides for the child care and 9 development block grant. The department shall expend the funds 10 appropriated in this section as provided in the federal law 11 making the funds available and in conformance with chapter 17A . 12 Moneys appropriated in this section that remain unencumbered 13 or unobligated at the close of the fiscal year shall revert to 14 be available for appropriation for purposes of the child care 15 and development block grant in the succeeding fiscal year. 16 Sec. 17. PROCEDURE FOR REDUCED FEDERAL FUNDS. 17 1. If the funds received from the federal government for the 18 block grants specified in this Act are less than the amounts 19 appropriated, the funds actually received shall be prorated 20 by the governor for the various programs, other than for the 21 services to victims of sex offenses and for rape prevention 22 education under section 4, subsection 3, of this Act, for which 23 each block grant is available according to the percentages that 24 each program is to receive as specified in this Act. However, 25 if the governor determines that the funds allocated by the 26 percentages will not be sufficient to accomplish the purposes 27 of a particular program, or if the appropriation is not 28 allocated by percentage, the governor may allocate the funds in 29 a manner which will accomplish to the greatest extent possible 30 the purposes of the various programs for which the block grants 31 are available. 32 2. Before the governor implements the actions provided for 33 in subsection 1, the following procedures shall be taken: 34 a. The chairpersons and ranking members of the senate and 35 -16- LSB 2661SV (2) 87 rn/tm 16/ 20
S.F. 498 house standing committees on appropriations, the appropriate 1 chairpersons and ranking members of subcommittees of those 2 committees, and the director of the legislative services agency 3 shall be notified of the proposed action. 4 b. The notice shall include the proposed allocations, 5 and information on the reasons why particular percentages or 6 amounts of funds are allocated to the individual programs, 7 the departments and programs affected, and other information 8 deemed useful. Chairpersons and ranking members notified shall 9 be allowed at least two weeks to review and comment on the 10 proposed action before the action is taken. 11 Sec. 18. PROCEDURE FOR INCREASED FEDERAL FUNDS. 12 1. If funds received from the federal government in the form 13 of block grants exceed the amounts appropriated in sections 1, 14 2, 3, 4, 7, 9, and 13 of this Act, the excess shall be prorated 15 to the appropriate programs according to the percentages 16 specified in those sections, except additional funds shall not 17 be prorated for administrative expenses. 18 2. If actual funds received from the federal government 19 from block grants exceed the amount appropriated in section 12 20 of this Act for the low-income home energy assistance program, 21 not more than 15 percent of the excess may be allocated to the 22 low-income residential weatherization program and not more than 23 10 percent of the excess may be used for administrative costs. 24 3. If funds received from the federal government from 25 community services block grants exceed the amount appropriated 26 in section 8 of this Act, 100 percent of the excess is 27 allocated to the community services block grant program. 28 Sec. 19. PROCEDURE FOR EXPENDITURE OF ADDITIONAL FEDERAL 29 FUNDS. If other federal grants, receipts, and funds and other 30 nonstate grants, receipts, and funds become available or are 31 awarded which are not available or awarded during the period 32 in which the general assembly is in session, but which require 33 expenditure by the applicable department or agency prior to 34 March 15 of the fiscal years beginning July 1, 2017, and July 35 -17- LSB 2661SV (2) 87 rn/tm 17/ 20
S.F. 498 1, 2018, these grants, receipts, and funds are appropriated to 1 the extent necessary, provided that the fiscal committee of 2 the legislative council is notified within 30 days of receipt 3 of the grants, receipts, or funds and the fiscal committee of 4 the legislative council has an opportunity to comment on the 5 expenditure of the grants, receipts, or funds. 6 Sec. 20. OTHER GRANTS, RECEIPTS, AND FUNDS. Federal grants, 7 receipts, and funds and other nonstate grants, receipts, and 8 funds, available in whole or in part of the state fiscal years 9 beginning July 1, 2017, and July 1, 2018, are appropriated to 10 the following departments and agencies that are designated 11 by and for the purposes set forth in the grants, receipts, 12 or conditions accompanying the receipt of the funds, unless 13 otherwise provided by law: 14 1. The section of this Act 19 making an appropriation to the economic development authority 20 in the amount anticipated to be received from the federal 21 government under Pub. L. No. 113-2, being deemed of immediate 22 importance, takes effect upon enactment. 23 Sec. 22. RETROACTIVE APPLICABILITY. The section of this Act 24 making an appropriation to the economic development authority 25 in the amount anticipated to be received from the federal 26 government under Pub. L. No. 113-2 applies retroactively to 27 October 1, 2014. 28 EXPLANATION 29 The inclusion of this explanation does not constitute agreement with 30 the explanation’s substance by the members of the general assembly. 31 This bill makes appropriations of federal block grants, 32 other federal funds, and nonstate funds. 33 The bill appropriates for the 2017-2018 federal fiscal year 34 and the 2018-2019 federal fiscal year block grants available 35 -19- LSB 2661SV (2) 87 rn/tm 19/ 20

The federal fiscal year begins on October 1, and 4 the state fiscal year begins July 1. 5 The bill also makes standing appropriations for the 6 2017-2018 state fiscal year and the 2018-2019 state fiscal year 7 of other federal grants receipts, and funds, and other nonstate 8 funds. 9 The section of the bill making an appropriation to the 10 economic development authority in an amount anticipated to be 11 received from the federal government under Pub.
