Section
1.
Section
321G.1,
subsection
21,
Code
2017,
is
1
amended
to
read
as
follows:

21.
“Public
land”
means
land
owned
by
the
federal
3
government,
the
state,
or
political
subdivisions
of
the
state
4
and
land
acquired
or
developed
for
public
recreation
pursuant
5
to
section
321G.7
.
“Public
land”
includes
but
is
not
limited
to
6
a
roadway
or
highway.
However,
this
subsection
shall
not
be
7
construed
to
permit
the
operation
of
snowmobiles
on
a
roadway
8
or
highway
except
as
provided
in
section
321G.9.

Sec.
2.
Section
321G.7,
subsection
2,
Code
2017,
is
amended
10
to
read
as
follows:

2.
The
department
shall
remit
the
fees,
including
user
12
permit
fees
collected
pursuant
to
section
321G.4A
,
to
the
13
treasurer
of
state,
who
shall
place
the
money
in
a
special
14
snowmobile
fund.
The
money
is
appropriated
to
the
department
15
for
the
snowmobile
programs
of
the
state.
The
programs
shall
16
include
grants,
subgrants,
contracts,
or
cost-sharing
of
17
snowmobile
programs
with
political
subdivisions
or
incorporated
18
private
organizations
or
both
,
which
may
include
the
purchase,
19
ownership,
and
maintenance
of
trail
grooming
equipment,
in
20
accordance
with
rules
adopted
by
the
commission.
Snowmobile
21
fees
may
be
used
to
support
snowmobile
programs
on
a
usage
22
basis.
At
least
fifty
seventy
percent
of
the
special
fund
23
shall
be
available
for
political
subdivisions
or
incorporated
24
private
organizations
or
both.
Moneys
from
the
special
fund
25
not
used
by
the
political
subdivisions
or
incorporated
private
26
organizations
or
both
shall
remain
in
the
fund
and
may
be
used
27
by
the
department
for
the
administration
of
the
snowmobile
28
programs.
Notwithstanding
section
8.33
,
moneys
in
the
special
29
fund
shall
not
revert
to
the
general
fund
of
the
state
at
30
the
end
of
a
fiscal
year.
Notwithstanding
section
12C.7,
31
subsection
2
,
interest
or
earnings
on
moneys
in
the
special
32
fund
shall
remain
in
the
fund.

Sec.
3.
Section
321G.7,
Code
2017,
is
amended
by
adding
the

following
new
subsection:

3.
Notwithstanding
any
provision
of
law
1
to
the
contrary,
the
department
may
donate
trail
grooming
2
equipment
owned
by
the
department
to
a
political
subdivision
3
or
incorporated
private
organization
receiving
moneys
from
the
4
fund
after
the
useful
life
of
the
trail
grooming
equipment
to
5
the
department
has
expired.

Sec.
4.
Section
321G.8,
Code
2017,
is
amended
by
adding
the
7
following
new
subsection:

.
3.
Snowmobiles
registered
in
an
organized
9
special
event
authorized
pursuant
to
section
321G.16
when
such
10
snowmobiles
are
operated
within
the
boundaries
of
the
event.

EXPLANATION

The
inclusion
of
this
explanation
does
not
constitute
agreement
with

the
explanation’s
substance
by
the
members
of
the
general
assembly.

This
bill
defines
“public
land”
as
the
term
relates
to
15
snowmobile
operation
under
Code
chapter
321G
to
include
16
roadways
and
highways.
Under
current
law,
the
operation
of
17
snowmobiles
on
roadways
and
highways
is
regulated
by
Code
18
section
321G.9.
19
The
bill
increases
the
share
of
the
special
snowmobile
fund
20
to
be
allocated
to
political
subdivisions
or
incorporated
21
private
organizations
from
50
percent
to
70
percent,
and
allows
22
political
subdivisions
and
incorporated
private
organizations
23
to
use
moneys
from
the
fund
for
the
purchase,
ownership,
and
24
maintenance
of
trail
grooming
equipment.
Under
current
law,
25
the
remainder
of
the
fund
is
allocated
to
the
department
of
26
natural
resources
(DNR)
for
administration
of
snowmobile
27
programs.
The
bill
permits
the
DNR
to
donate
trail
grooming
28
equipment
owned
by
the
DNR
to
a
political
subdivision
or
29
incorporated
private
organization
receiving
moneys
from
the
30
fund
after
the
useful
life
of
the
trail
grooming
equipment
to
31
the
DNR
has
expired.
32
The
bill
exempts
from
the
snowmobile
registration
33
requirements
snowmobiles
registered
in
an
organized
special
34
event
authorized
by
the
DNR
when
such
snowmobiles
are
operated
