S.F. 460 Section 1. Section 481A.67, subsections 2 and 3, Code 2017, 1 are amended to read as follows: 2 2. a. Notwithstanding any provision of law to the contrary, 3 the natural resource commission shall adopt rules pursuant to 4 chapter 17A establishing seasons and daily catch limits for the 5 noncommercial harvest of turtles in any waters of the state 6 pursuant to section 483A.28 . Seasons established pursuant to 7 this subsection shall not apply to the noncommercial harvest of 8 snapping turtles. 9 b. (1) The annual season for the noncommercial harvest of 10 turtles shall begin on July 15 and end on May 15. 11 (2) Beginning on July 15, 2017, the following limits on the 12 noncommercial harvest of turtles are applicable: 13 (a) Daily catch limit: 14 (i) Four common snapping turtles. 15 (ii) One spiny or smooth softshell turtle. 16 (iii) One painted turtle. 17 (b) A person with a valid fishing license issued pursuant to 18 chapter 483A is entitled to take and possess a maximum amount 19 of turtles as provided in section 483A.28. 20 (3) This paragraph “b” is repealed effective July 1, 2021. 21 3. a. Notwithstanding any provision of law to the contrary, 22 the natural resource commission shall adopt rules pursuant to 23 chapter 17A establishing seasons and daily catch limits for the 24 commercial harvest of turtles in any waters of the state. 25 b. (1) The annual season for the commercial harvest of 26 turtles shall begin on July 15 and end on May 15. 27 (2) Beginning on July 15, 2017, the following limits on the 28 commercial harvest of turtles are applicable: 29 (a) Daily catch limit: 30 (i) Ten common snapping turtles. 31 (ii) Ten spiny and smooth softshell turtles, in aggregate. 32 (iii) Five painted turtles. 33 (b) Possession limit: 34 (i) Thirty common snapping turtles. 35 -1- LSB 2415SV (2) 87 av/nh 1/ 3
S.F. 460 (ii) Thirty spiny and smooth softshell turtles, in 1 aggregate. 2 (iii) Fifteen painted turtles. 3 (3) This paragraph “b” is repealed effective July 1, 2021. 4 Sec. 2. Section 481A.67, Code 2017, is amended by adding the 5 following new subsection: 6 NEW SUBSECTION . 3A. Beginning on the effective date of 7 this Act, a person shall not be issued or allowed to renew a 8 commercial turtle harvester license pursuant to chapter 482 9 unless the person held a commercial turtle harvester license at 10 any time during the period beginning on January 1, 2015, and 11 ending on the effective date of this Act. This subsection is 12 repealed effective July 1, 2021. 13 Sec. 3. RESCISSION OF AMENDMENTS TO ADMINISTRATIVE RULES. 14 1. The amendments to 571 Iowa administrative code, 15 chapter 86, as appearing in ARC 2951C, as published in the 16 Iowa administrative bulletin, volume XXXIX, number 17, dated 17 February 15, 2017, pp. 1685-1687, are rescinded. 18 2. As soon as practicable, the Iowa administrative code 19 editor shall restore the language of the Iowa administrative 20 code chapter referenced in subsection 1 of this section to the 21 language that existed on February 14, 2017. 22 Sec. 4. EFFECTIVE UPON ENACTMENT. This Act, being deemed of 23 immediate importance, takes effect upon enactment. 24 EXPLANATION 25 The inclusion of this explanation does not constitute agreement with 26 the explanation’s substance by the members of the general assembly. 27 This bill relates to the noncommercial and commercial 28 harvest of turtles. 29 The bill provides that the annual season for the 30 noncommercial and commercial harvest of turtles shall begin on 31 July 15 and end May 15. 32 The bill also specifies daily catch limits and possession 33 limits on the noncommercial and commercial harvest of turtles, 34 beginning on July 15, 2017. S.F. 460 effective July 1, 2021. 1 The bill provides that, beginning on the effective date of 2 the bill, a person shall not be issued or allowed to renew a 3 commercial turtle harvester license unless the person held such 4 a license at any time during the period beginning on January 5 1, 2015, and ending on the effective date of the bill. This 6 provision is repealed effective July 1, 2021. 7 The bill rescinds amendments to specified rules relating 8 to harvesting commercial and noncommercial turtles that were 9 published in the Iowa administrative code on February 15, 2017, 10 and directs the Iowa administrative code editor to restore the 11 language of the Iowa administrative code to the language that 12 existed on February 14, 2017. 13 The bill is effective upon enactment. 14 -3- LSB 2415SV (2) 87 av/nh 3/ 3
