paragraph

is
amended
by
adding
the
following
new
subparagraph:

Notwithstanding
paragraph
“a”
,

subparagraph
(5),
if
transmitted
by
an
authorized
agent,
4
the
electronic
prescription
shall
not
require
the
written
5
or
electronic
signature
of
the
practitioner
issuing
the
6
prescription.

EXPLANATION

The
inclusion
of
this
explanation
does
not
constitute
agreement
with
9
the
explanation’s
substance
by
the
members
of
the
general
assembly.

This
bill
provides,
with
regard
to
an
electronic
11
prescription,
that
if
the
prescription
is
transmitted
by
12
an
authorized
agent
of
the
practitioner,
the
electronic
13
prescription
shall
not
require
the
written
or
electronic
14
signature
of
the
practitioner
issuing
the
prescription.
15
Similarly,
under
current
law,
if
a
prescription
is
oral,
the
16
practitioner
is
not
required
to
provide
a
written
signature
17
or
the
address
of
the
practitioner.
An
“authorized
agent”
is
18
defined
in
Code
section
155A.3
as
an
individual
designated
by
a
19
practitioner
who
is
under
the
supervision
of
the
practitioner
20
and
for
whom
the
practitioner
assumes
legal
responsibility.
